SECURITY DEED
GEORGIA, PEACH COUNTY
Under and by virtue of that Power of
sale contained in that certain deed to
secure debt executed by CHARLES T.
MORONEY in favor of MIDDLE
GEORGIA BANK dated September 18,
1990, recorded in Deed Book 893, Page
554, Clerk's Office Houston Superior
Court, the undersigned will sell at public
outcry to the highest bidder for cash
before the doors of the Courthouse of
Houston County, Georgia, during the
legal hours of sale on the First Tuesday
in November, 1992, (11/3/92), the
following described property, to-wit:
All that tract or parcel of land lying
and being in Land Lot 11 of the 11 th
Land District of Houston County,
Georgia, being known and designated
as Lots 10 and 11, Block "B”. Section
No 1 of Walnut Ridge Estates,
according to that certain plat of survey
prepared by Story Surveying Company,
and filed of record in Plat Book 17, Page
265, Clerk's Office, Houston Superior
Court Said plat and the recorded copy
thereof, including the metes,
boundaries, courses, distances and
dimensions, are incorporated herein by
reference thereto for all purposes. Said
tract of land herein is subject to those
restrictive covenants filed of record in
Deed Book 444, Page 697; and a twenty
(20) foot easement for drainage and
utility purposes across the rear or north
line of said property and a ten (10) foot
easement for drainage and utility

herein.

The debt secured by said deed is
evidenced by a note dated September
18, 1990.
Default has occurred in the payment
of the debt evidenced by said note and
secured by said deed by the
nonpayment of installments The total
balance of said debt has, therefore,
been declared due and said deed
foreclosable according to the terms of
said security deed and the note which it
secures.
Said property shall be sold subject to
the highest bidder for cash, and
proceeds shall be applied to the
payment of said indebtedness and the
lawful expenses of said sale, all as
provided in said note and said security

original principal amount of $36,899 41,

The debt secured by said deed to
secure debt has been declared due

promissory note and deed to secure

WHEREAS, on January 27, 1988,
Edward Nieves and Teresa Nieves
executed a security deed to C&S Family
Credit, Inc., now known as Nationsßanc
Financial Services Corporation, to the
following land, to-wit:
All that tract or parcel of land lying

Land District of Houston County, City of
Warner Robins, Georgia, being known
and designated as Lot 14, Block "B",
Section No. 1, Karen Villa Estates, as

been appointed Receiver for First
Federal Savings Association, Warner
Robins, Georgia, by Order Nos. 90-1509
and 90-1510, both dated August 16,
1990, from the Director, for the purpose
of liquidation, pursuant to subdivision
(F) of §s(d) (2) of HOLA, as amended by
§3Ol of FIRREA; there will be sold by the
undersigned at public outcry to the
highest bidder for cash before the
Courthouse door at HOUSTON County,
Georgia, within the legal hours of sale on
the first Tuesday in NOVEMBER, 1992,
the following described properly:
All that tract or parcel of land lying
and being in Land Lot 170 of the Fifth
Land District of Houston County,
Georgia, being known and designated
as Unit 1, Building No, 15, Harbour
Towne Condominiums, together with its
appurtenant percentage of undivided
interest in the common elements, as
described in that certain Declaration for
Harbour Towne Condominiums, of record
in Deed Book 712, Page 482-517, as the
same may be amended from time to
time, and on As Built Plan prepared by
Waddle & Company, dated January 23,
1987, together with the Condominium
Plans, which are on file with the Office of
the Clerk of the Superior Court of
Houston County, Georgia. Said
Declaration, As Built Site Plan and
Condominium Plans, as amended from
time to time, are incorporated herein by
reference thereto for all purposes.
This conveyance is subject to all of
the provisions of said Declaration and
the Georgia Condominium Act (O.C.G.A.
Title 44-3-70), as amended from time to
time.
To the best of the undersigned's

The debt secured by said Security
Deed has been and is hereby declared
due because of, among other possible
events of default, non-payment of the
monthly installments on said loan. The
debt remaining in default, this sale will
be made for the purpose of paying the
same and all expenses of this sale,
including attorney's fees. Said property
will be sold subject to any outstanding
ad valorem taxes, special
assessments, unpaid utility bills
constituting liens against the property,
and any other matters of record superior

dated August 25, 1987, recorded
August 30, 1987, in Deed Book 853,
Page 523, Houston County Records;
said Security Deed being given to
secure a Notice of even date in the
original principal amount of Thirteen
Thousand Five Hundred and No/100
Dollars ($13,500.00), with interest from
date as stated therein; there will be sold
by the undersigned at public outcry to
the highest bidder for cash before the
Courthouse door at Houston County,
Georgia, within the legal hours of sale on
