Council Chamber, April 22, 1902. Council met in regular session, Mayor Parker in the chair. J. M. Hubbard, C. C. Staton, T. Y Eberhart, S. C. Dunlap and L. D. Puckett present. Minutes of last meeting read and confirmed. On motion the following ordi nance was repealed: AST ORDINANCE TO REGULATE THE SALE OF COCAINE, ETC. Section 1. Be it ordained by the Mayor and council of the city of Gainesville, and it is hereby ordained by the authority of the same, that it shall hereafter be unlawful for any per son, firm or corporation within the limits of the city of Gainesville to sell or give cocaine or any preparation con taining cocaine or morphine or any form of opium to any person, in any quantity whatever, unless the person who is to use the. same shall produce at the time of the purchase a certificate Or prescription from some licensed phy sician, on which prescription shall also be written the name of the party who is to use the cochine, stating that such person needs cocaine for his or her physical welfare, and a separate certifi cate or prescription shall be produced for each purchase. Each certificate or prescription shall bear the date on which it is issued, aud no sale shall be made upon the certificate or prescrip tion except on the date that it is issued. Section 2. It shall be the duty of the person, firm or corporation who shall sell or give cocaine or any preparation containing cocaine, as stat ed in Section 1, to mark the bottle or package with a scarlet label with the word *‘cocaine’'* in white letters, and the package or bottle shall be wrapped in a scarlet paper before being so fur nished. The person so selling or giv ing cocaine or any preparation contain ing cocaine as aforesaid, shall preserve saeh certificate or prescription thus re ceived, first endorsing thereon the date it is filled. He shall also record in a separate book, in which no other entries shall be made, and which book shall at all times be open to the inspection of the police officers on demand, the date my cocaine is sold, to whom sold, the amount sold and the physician issuing the prescription therefor. Said drug' gist shall whenever called upon by the City Board of Health at least once ev ery three (3) months file with the said Board of Health, on blanks to be fur nished by said Board, a transcript of said Poison Book relating to the sale of said cocaine, and said report shall be kept on file in the office of said Board. Section 3. It shall be unlawful for any person, firm or corporation to open or maintain any room, house or place of any description for the “whiffing,’ “snuffing” or taking in any form, co caine or any preparation containing cocaine or for any person to frequent or beeome the inmate of such place, or to take cocaine or any preparation con taining cocaine at such place, or to be connected with such place as owner, agent, clerk or otherwise, or knowingly permit or suffer such place to be open ed, maintained upon any lot or within any house owned, held or controlled by them as agent, leesee or otherwise. Section 4. The provisions of this ordinance shall not apply to wholesale druggists who sell • drugs to other licensed druggists for retailing, but it is intended that this ordinance shall apply only where the same is sold for consumption by the party purchasing same, or for whom it is purchased. Section 5. Any person, firm or cor poration, violating this ordinance, or any of the provisions thereof, within the City of Gainesville, shall be sum moned before the Mayor’s court, and on conviction fined not exceeding one ; hundred ($100) dollars, or by imprison ment in the county jail or the station house of the city for a term not exceed ing ninety (90) days. Section 6. All ordinances and parts of ordinances in conflict with this ordi nance be and the same are hereby re pealed.
