A bill—To be entitled an act to
provide foi a board of equalization
of real aDd personal property sub
ject to taxation n t his State, and ;
for oiher purposes.
Section 1. Be it enacted by the
General Assembly of Georgia, that
the Commissioners of Roads and
Revenue, or in case there are no such
commissioners, then the Ordinaries
of the counties of this State, shad,
on or before the first day ot April
next and annually thereafter, ap
point live upright and intelligent
citizens, wIiopC place ot residence
shall be in different localities in said
county, all of whom shall be free¬
holders of tlai; counties, who shall
constitute a board of equalization for
said counties, of all property, real and
personal, subject to taxation in their
counties. The persons appointed
shall, before ent< nng upon the dis
charge of tit- luties of their office,
take uu oath be tore the Commissioners
of Roads and Revenue or Ordinary,
to faithfully und impartially discharge
the duties of tin a* office. They shall
each receive a mpensation the sum
of $9sjf»er day while engaged in the
discharge of their official duties, to be
paid out of the < reasury of their coun
ty, upon the draft of the Commission¬
ers ot Roads a. d Revenue or the
Ordinary, provided the provisions of
this act shall not apply to any county
which has u board of equalization
under special act.
Sec. 2. Be it further enacted, That
it shall be th, duty of said Board of
Equalization to meet at the office of
the lleceivei of Tax Returns, at the
oouuty site, on the first Monday in
May of each yeaf, and from day to
day ami from time to time, as the
duties of their offices may require*
provided that the Commissioners ap¬
pointed under this act shall complete
their work inside of thirty days each
year.
Sec. 8. Be it further enacted,
That it shall be the duty of said
Board of Equalization to receive all
returns of real and personal property
made to tlm Receiver of tux returns of
their county, and whenever any per¬
son or pemun-, or body corporate,
whose duty it is to make returns to
saiil receiver of anv kind of property
subject to taxation by the laws of this
Bia'e, have failed or shall fail to re¬
turn the whole or any part thereof at
the true cash market value, and said
Board of Equalization shall proceed
to assess the property of every such
defaulting person or persons, or body
corporate, at such au amount as io in
tneir judgment just and equitable, on
the best and most reliable information
to be obtained by said Board. And
for this purpose said Board shall on
tbeir own motion or the application
• of any person have power to issue, in

all witnesses, and compel the produc¬

Sec. 5. Bo it further enacted
That the Receiver of Tax Returns of
the counties of this State shall be

names of every person he may know
; who has failed or refused to make
returns as required by law.

Sec. (>. Be it further
That the receivers of taxes shall not

of a taxpayer until the same has been
acceptsd and approved by said Board
of Equalization
Sec. 7. Be it further enacted,
That any taxpayer who may be dis¬
satisfied with his assessment, or whose
return has been refnsed by the Re¬
ceiver of tax Returns, shall have the
privilege of appearing before the
Board of Equalization and being heard
and the said Board shall receive the
return if the same be correct, or shall
at once proceed to alter, amend or
correct the assessment complained of
as the ease may be, so as to make it
conform the requirements of the law.
Sec. 8. Be it further enacted,
That should a vacancy occur in said
Board Equalization by death removal
resignation or refusal to qualify, said
vancancy or vancancies may be filled
by the appointing power provided in
Section 1.
Sec. 9. Be it further enacted,
That three of said Board of Equaliza¬
tion shall constitute a quorum for
the discharge of the duties of said
Board.
Section 10 repeals conflicting laws.
