Said property is conveyed sub
ject to Restrictive Covenants of re

any and all restrictions, covenants,
easements, right-of-ways and build
ing setback lines as shown on the
above-referenced pleat of record in
said Clerk's Office.
This being the same property as

Said property will be sold as the
property of Willie Webb, Rose-
monde Webb and Farah Edourard
for the purposes of paying the
aforementioned debt and all ex
penses of sale, including attorney’s
fees, (notice having been given as
provided by law) and the proceeds
of said sale will be applied to the
payment of said indebtedness, ac
crued interest, expenses of the sale
and other sums secured by said
deed including attorney's fees with
the remainder, if any, being applied
as provided by law.

or restrictive covenants, ease
ments, rights of way or encumbran
ces, all valid zoning ordinances,
matters which would be disclosed
by an accurate survey of the prop
erty, any and all outstanding ad val

matters of record superior to the

possible financial assistance to
Georgia Transmission Corporation
(Georgia Transmission) for the con
struction of the proposed Smarr
Warehouse and Training Center
115 kV Transmission Line to be
built by Georgia Transmission in
Monroe County, Georgia. Georgia
Transmission is requesting the US
DA Rural Development to provide
financial assistance for the pro
posed project.

SUPPLEMENTARY INFORMA
TION: The study area for the pro
posed warehouse is immediately
south of the existing Smarr training
facility on Rumble Road in Smarr,
Georgia. This portion of the project
involves the clearing of approxi
mately 27.9 acres of land to con
struct a warehouse, paved concrete
slab, transformer storage area, and
covered storage area. The proposal
also involves the construction of the
Smarr Training Center 115 kV non-
energized transmission line that will
connect to the existing Smarr train
ing facility substation. The line will
be approximately 400 feet in length
and will require the clearing of trees
within an existing 75 feet right-of-
way (ROW). Alternatives consid
ered by the USDA Rural Develop
ment and Georgia Transmission in
cluded: three (3) “siting” or location
alternatives. These three (3) alter
natives are discussed in Section
4.0 of the Smarr Warehouse Envi
ronmental Report (ER). The ER,
which describes the proposed proj
ect in detail and discusses its an

ticipated environmental impacts,
has been prepared by Georgia
Transmission. The USDA Rural De
velopment has accepted the ER as
its EA for the proposed project. The
EA is available for public review at

SUMMARY OF PROPOSED
CONSTITUTIONAL
AMENDMENTS
Pursuant to requirements of the
Georgia Constitution, Attorney
General Thurbert E. Baker, Secre
tary of State Karen C. Handel, and
Legislative Counsel Sewell R.
Brumby hereby provide the sum
maries of the proposed constitu
tional amendments that will appear
on the November 4, 2008, general
election ballot for consideration by
the people of Georgia:

To encourage the preservation of
Georgia's forests through a conser
vation use property tax reduction
program.

vide that the General Assembly by
general law shall encourage the
preservation, conservation, and
protection of the state's forests
through the special assessment
and taxation of certain forest lands
and assistance grants to local gov
ernment?"
This proposal directs the General
Assembly to provide for a new
method of ad valorem tax assess
ment of forest land conservation
use property. Such property will in
clude only tracts of forest land
which exceed 200 acres except
where the General Assembly has
provided by general law for excep
tions to the 200 acre limit under
certain circumstances. Subject to
certain qualifications, an owner of
such property will be able to enter
into a covenant to restrict the use of
the land to current use; and the
land will then be taxed according to
a formula based on current use, an
nual productivity, and real property
sales data. A breach of the cove
nant will result in a government re
capturing the tax savings and may
result in other appropriate penal
ties.
The General Assembly is direct
ed to appropriate funds to local
government to partially offset any
loss of local revenue.
The General Assembly has
enacted a law to implement this
constitutional amendment. This
law will become effective only if the
constitutional amendment is ratified
by the voters. This law is 2008 HB
1211; Act No. 464, found at Ga.
Laws 2008, p. 297.

This proposal affirms that the
General Assembly may authorize
counties, municipalities, and hous
ing authorities to carry out com
munity redevelopment.
The proposal also revises the
Constitution's provisions relative to
redevelopment powers and tax allo
cation bonds. As revised by the
proposed amendment, the current
provisions for community redevel
opment, after providing for such

powers, will contain revised provi
sions relative to tax allocation
bonds. In general, tax allocation
bonds are government borrowings
which are repaid specifically from
future growth in the property tax di
gest of an area under redevelop
ment.
Under the proposal a general law
will be able to authorize the use of
county, municipal, and school tax
funds, or any combination thereof,
to fund redevelopment purposes
and programs, including repayment
of tax allocation bonds. The gener
al law may provide for such use of
tax funds without regard to whether
the local government approved
such use before January 1, 2009.
No county, municipal, or school tax
funds may be used for such pur
poses and programs without appro
val by the applicable local govern
ing body.
With respect to school taxes on
ly, such taxes may be used for re
development purposes and pro
grams only if: (1) they have been
pledged for repayment of tax allo
cation bonds which have been judi
cially validated (approved by a
court for issuance); or (2) such use
is authorized by general law after
January 1,2009.

This proposal authorizes the Gen
eral Assembly by general law to
provide for the creation and regula
tion of infrastructure development
districts. The purpose of such dis
tricts will be for the creation, provi
sion, and expansion of such infra
structure services and facilities as
may be provided for by general law.
Counties and municipalities af
fected by the creation of infrastruc
ture development districts will have
the authority to approve creation of
such districts. The general law pro
viding for the creation of the dis
tricts will provide for the establish
ment of an administrative or gov
erning body for the districts. Such
administrative or governing bodies
will be able to impose and collect
fees and assessments within each
district and to incur debt according
to powers and limits set by statute.
The General Assembly has
enacted a law to provide for the
creation and regulation of infra
structure development districts.
This law will become effective only
if the constitutional amendment is
ratified by the voters. This law is
