Also together with Grantor's
rights, title and interest in and to all
improvements, easements, appur
tenances and fixtures, which are
part of said property.
Said Security Deed secures per
formance of the terms and provi
sions of a certain Promissory Note
dated February 11, 2004, made by
Borrower in favor of Lender, in the
original principal amount
$1,500,000.00 (as may have been
previously or subsequently modi
fied or amended, collectively here
inafter the “Note”), with interest due
thereon as set forth therein.
Default(s) have occurred under
the terms and provisions of the Se
curity Deed and in the payment of
the debt evidenced by the Note and
secured by the Security Deed. As
a result of such default(s), the total
balance of said debt as evidenced
by the Note has been and is hereby
declared due and the Security
Deed foreclosable according to its
terms and applicable law.
The debt remaining in default,
the Property will be sold to the
highest bidder for cash as the prop
erty of Grantor, the proceeds to be
applied to the payment of said in
debtedness, attorney's fees (notice
of intention to collect attorney's fees
having been given), and the lawful
expenses of said sale, all as provid
ed in the Note and the Security
Deed and all other related docu
ments evidencing indebtedness
owed to Lender. Said sale to be
subject to any and all unpaid taxes
and assessments (including taxes
which are a lien, but not yet due
and payable), any matters which
would be disclosed by an accurate
survey or by an inspection of the
Property, any zoning ordinances,
all outstanding bills for public utilit
ies which constitute liens upon the
Property, any governmental rights
of redemption, and all restrictions,
easements, liens, security deeds,
security interests, claims and en
cumbrances of record, if any, that
are prior to the Security Deed and
to which the Security Deed is sub
ject.

On the 7th day of August, 2007,
H. K. Land, Inc. executed a Securi
ty Deed to Piedmont Community
Bank to secure a Note of even date
for Seventy-Eight Thousand Fifty-
Four and No/100 Dollars
($78,054.00). Said Security Deed
was recorded in Deed Book 1233,
Page 292, in the Office of the Clerk
of the Superior Court of Monroe
County, Georgia.
By virtue of the Power of Sale
contained in the said Security
Deed, there will be sold by the un
dersigned at public outcry to the
highest bidder for cash, before the
Courthouse door in Forsyth, Mon
roe County, Georgia, within the le
gal hours of sale on the first Tues
day in January, 2009, the same be
ing January 6, 2009, the following
described properly:
All that tract or parcel of land ly
ing and being in Land Lots 129 and
160 of the 6th Land District of Mon
roe County, Georgia, and being
more particularly known and desig
nated as Lots 44 and 45 of River-
walk, Phase Three, according to a
survey prepared by Larry G. Sibley,
Georgia Registered Land Surveyor,
dated April 5, 2006, a copy of which
appears of record in Plat Book 28,
Pages 189-192, Clerk's Office of
Monroe County Superior Court to
which reference is made for a more
complete and accurate description.
The entire debt, principal and in
terest, secured by said Security
Deed and Note has been and is
hereby declared due and payable
because of nonpayment thereof.
The remaining debt being in de
fault, this sale will be made for the
purpose of paying the same and all
expenses of this sale.
Said property will be sold as the
property of H. K. Land, Inc. and
subject to outstanding ad valorem
taxes and/or easements and/or re
strictive covenants appearing of re
cord, if any.
The undersigned will execute a
deed to the purchaser at said sale
