COMPLAINT FOR FORFEITURE
Comes Now, the State of Georgia
and files this Complaint pursuant to
O.C.G.A. 16-13-49 and shows the
Court the following:

The property sought to be forfeited
is described as follows:
One 1999 Jeep Grand Cherokee
automobile, VIN:
1J4GW58S5XC517703
2:
Said property is presently located
at the Forsyth Police Department,
in Monroe County, Georgia and is
subject to the jurisdiction of this
Court. Notice of seizure of said
property was received by the Dis
trict Attorney's Office within Twenty
(20) days as provided by statute.
3:
Said properly was seized on De
cember 2, 2008 during a routine
traffic stop. Officer Kimberly Barnett
suspected that the driver may be
impaired because of the manner of
his driving. During the course of the
stop Officer Barnett smelled the
odor of marijuana. During the stop
the passenger, Drew Causey, ac
knowledged that they had smoked
a “blunt”. A subsequent vehicle
search was done and fire arms
were found in a hidden compart
ment. It was determined that the
driver Rocco Klaus was the driver
and was a convicted felon. During
the course of the search a bottle of
methadone was found in a box hid
den under the console. While being
transported to the jail the passen
ger made a comment that “the mar
ijuana ain't mine.” Law enforcement
did not locate marijuana during the
traffic stop. Thinking that they had
missed something, Officer Barnett
had a trained drug dog to walk
around the vehicle while it was im
pounded. The dog gave a positive
alert. A search warrant was then
obtained and a more detailed
search was performed. Found in
the vehicle was marijuana, Oxyco
done and 64 methadone pills. Sev
en Thousand, One Hundred and
Twenty Five Dollars in Unites
States Currency was also located.
The money was later returned to
the rightful owner. The jeep was
seized as it had hidden compart
ments, some of which were used to
conceal drugs. Oxycodone, mari
juana and methadone was hidden
inside of the gear shifter. The gear
shifter had to be removed to obtain
these drugs.

the provisions of O.C.G.A. 16-13-

erty directly/indirectly used to facili
tate a violation of the Georgia Con
trolled Substances Act. As the said
1999 Jeep Grand Cherokee had
hidden compartments capable of
concealing narcotics and in fact
marijuana, and oxycodone and
methadone were found in these
hidden compartments.
WHEREFORE, THE STATE OF
GEORGIA PRAYS:
1) That all owners and interest
holders listed above be personally
served with a copy of the Complaint
and Summons;
2) That the Court enter a judgment
in favor of the State of Georgia de
claring said property forfeited to the
State of Georgia;
3) That the Court order any claimant
who fails to establish that a sub
stantial portion of the claimant's in
terest is exempt from forfeiture, pay
to the State of Georgia the actual
costs incurred in the investigation
and prosecution of this action in
