Pursuant to OCGA 16-13-
49(n), all parties claiming an inter
est in tne following described
property are hereby notified that
said property has been lawfully
seized and is subject to forfeiture
by virtue of the facts and viola
tions set out below.
Date of seizure: April 12, 2011
Place of seizure: Monroe County,

1997 Honda Accord 2-dr. red

2) Colt 1911 Mdl. Defender
.45ACP cal. Pistol Serial
#DR38062
3) S&W Mdl. 640 .357 magnum
caliber revolver. Serial
#CNK2960.
4) $1824.12 U.S. Currency.
Conduct giving rise to seizure and
forfeiture:
On April 12, 2011 at approximate
ly 3:42 p.m. MCSO patrol Ser
geant Ricky Davis made a traffic
stop of the above listed Honda
Accord bearing Ohio tag
EZS4034, operated by Timothy L.
Walters, for violation of the Geor
gia window tint law. Timothy Wal
ters appeared overly nervous
made statements leading Sgt. Da
vis to believe Mr. Walters had ille
gal drugs and/or other contraband
in the Honda. Clarissa Potter was
a front seat passenger in the Hon
da, which belonged to Mr. Wal
ters.
Sgt. Davis asked for and received
verbal consent to search Mr. Wal
ters's Honda. Sgt. Davis search
the Honda after MCSO Ptlmn.
Sam Leggett arrived at the scene.
Mr. Walters directed Sgt. Davis to
the two listed handguns which
were in the glove compartment
and console. Ptlmn. Leggett
found green marijuana ana a
glass marijuana smoking pipe on
the front seat. Ptlmn. Leggett also
found an Oxycontin prescription
vial two different types of pifls, a
Marlboro cigarette pack contain
ing four marijuana cigarettes from
the driver’s side door picket. Sgt.
David found one ana one-half
ounces of marijuana in a plastic
box that had been fixed with mag
nets and was affixed inside the
engine compartment. This box al
so contained two vials of marijua
na seed. Sgt. Davis also found
loose green marijuana inside a
speaker box in the vehicles trunk.
Ptlmn. Leggett and Ptlmn. Wil
liam Jackson recovered a metal
box from the person of Clarissa
Potter that contained seven Roxy-
codone pills. Clarissa Potter stat
ed to them that as they were be
ing stopped Mr. Walters threw the
metal box to her and told her to
hide it in her pants.
A total of $1824.12 was seized
from two different locations in the
Honda: $632 from beneath a rear
floor mat and $1192.12 from the
person of Timothy L. Walters.
The seized items were used
and/or intended for use, directly
or indirectly, to facilitate violations
of the Georgia Controlled Sub
stance Act, and/or represent pro
ceeds realized or derived from
such violations, and/or were ac
quired and/or maintained by pro
ceeds realized or derived from
such violations and/or funds com
mingled with such proceeds
and/or represent “Things of value”
found in close proximity to con
trolled substances and/or other
property subject to forfeiture pur
suant to OCGA §16-13-49. There
fore the seized property is contra
band as defined by OCGA §16-
13-49(n) (4).
All parties claiming an interest
in said property are further ad
vised that they may file a claim
within thirty (30) days of the sec
ond publication of this Notice of
Seizure by sending a claim to the
seizing law enforcement agency
and to the District Attorney for
Certified Mail, return receipt re
quested, the address set out be
low. Georgia law provides that
such Claims are submitted sub
ject to prosecution for perjury, and
that they must comply with OCGA
§16-13-49(n) (4).

notice is hereby given that the
Mayor and Council of the City of
Forsyth, at 7:00 PM on the 5th
day of July, 2011, or as soon
thereafter as the matter may b
reached, at City Hall Council
Chambers, will conduct a public
hearing and consider the applica
tion of George Willis, Jr. for a var
iance in an R-3 Zoning District
(Residential, Detachea Single
Family, Moderate-Density District)
for the construction of not more
than three two-family dwellings
(duplexes) with adequate set
backs and separation between
units, and other related purposes,
on Lots 32, 33, 34 and 35 of

in the City of Forsyth.
The property as to which the
variance application relates is
designated as Parcels 5, 6, 7 and
8 on Monroe County Tax Map
F11, and located on Willis-Wilder

erty at the date of application for

ing designation of the property will
