ABATEMENT OF PUBLIC
NUISANCE
To: Willie Hardy, Jr. and Mary
Lois Hardy, 108 Sharp Street,
Forsyth, GA 31029, and to all to
whom it may concern:
Please take notice that the
Building Official of the City of For
syth, upon reasonable belief that
tne building and property desig
nated as Monroe County Tax Map
F27, Parcel 19B in the City of For
syth, and located 108 Sharp
Street, is unsafe, caused an in
spection to be made thereof,
which inspection finds that the
building is unsafe, and a report of
the conditions and defects in the
building has been presented to
the Forsyth City Council and
brought before Council at the reg
ular and open public meeting of
September 20, 2011, for consid
eration. After consideration of the
report and the preliminary evi
dence presented to the Council,
the City Council determined on
September 20 that reasonable
cause exists to proceed with an
abatement procedure with regard
to the property designated as Tax
Map F27, Parcel 19B at 108
Sharp Street in Forsyth.
A hearing will be held at a
regular and open meeting of
the Council of the City of For
syth on October 18, 2011, at
7:00 PM or as soon thereafter
as the matter may be reached,
at City Hall Council Chambers
at City Hall Annex, to determine
whether the building and prop
erty designated as Monroe
County Tax Map F27, Parcel
19B at 108 Sharp Street in For
syth, is an unsafe structure,
and, if so, what order should be
made by the Council to specify
such acts or things to be done
to the building to protect the
health, safety and general wel
fare of the citizens of Forsyth
and persons who may live in or
inhabit the building and proper
ty-
These procedures are as set
out in City Code Sections 7-151
through 7-171.
The deed and tax records
show that the property is in the re
cord name of Willie Hardy, Jr. and
Mary Lois Hardy, at 108 Sharp
Street, Forsyth, GA 31029, and
they or their representatives
should attend the nearing and
present any evidence that they
may have in mitigation or explan
ation, may cross examine any wit
nesses called by the Enforcement
Officer or the City, and may be
represented by counsel, although
that is not required.
The Forsyth City Council deter
mined that a reasonable cause to
proceed exists based upon its
preliminary finding that the prop
erty designated as Monroe Coun
ty Tax Map F27, Parcel 19B at
108 Sharp Street in Forsyth is an
unsafe property, since the house
is dilapidated, decayed, unsafe
and unfit for human habitation,
having been partially burned in a
fire, so that portions of the struc
ture are missing and falling and
the house is in total ruin and the
facilities do not protect the safety
and general welfare of human be
ings and constitutes a nuisance
and is unsafe and dangerous to
the health and safety and general
welfare of the citizens of Forsyth,
and is an “unsafe building” under
the provisions of Section 7-151 of
the City Code.
On October 18, 2011, the For
syth City Council will hear evi
dence and determine if the prop
erty is unsafe and, if so, what
remedy may be imposed under
the City Code.

Notice is hereby given that the
Mayor and Council of the City of
Forsyth, at 7:00 PM on the 18th
day of October, 2011, or as soon
thereafter as the matter may be
reached, at City Hall Council
Chambers, will conduct a public
hearing and consider the applica
tion of A & S Business Property,
LLC for a variance for the con
struction of a commercial building
on the property of the applicant
designated as Monroe County
Tax Map F25 Parcel 17, at 275
North Lee Street in Forsyth.
The current zoning of the prop
erty at the date of application for
the variance is Commercial (High
way Business District) and within
the North Lee Street overlay corri
dor. The zoning shall remain un
changed. The variance sought re
lates to the building setback re
quirements on the rear, Trade-
winds Drive, and North Lee Street
boarders of the property.
The public hearing will be con
ducted in accordance with the
procedures as set out in the Zon
ing Ordinance of the City of For
syth.
