NOTICE OF FORSYTH CITY
COUNCIL HEARING FOR
ABATEMENT OF PUBLIC
NUISANCE
To: Wallace Rutland, 893
Highway 341 South, Room 6,
Barnesville, GA 30204
Please take notice that the Building
Official of the City of Forsyth, upon
reasonable belief that the property
designated as a vacant lot on
Milledge Circle (Monroe County Tax
Map F34, Parcel 14) in the City of
Forsyth, was unsafe, has caused an
inspection to be made thereof,
which inspection found that the
property is unsafe, and a report of
the conditions and defects in the
property was presented to the
Forsyth City Council at the regular
and open public meeting of October
16, 2012, for consideration. After
consideration of the report and the
preliminary evidence presented to
the Council, the City Council
determined that reasonable cause
exists to proceed with an abatement
procedure with regard to the
property designated as a vacant lot
fronting on Milledge Circle in
Forsyth (Tax Map F34, Parcel 14).
A hearing will be held at a regular
and open meeting of the Council of
the City of Forsyth on December 4,
2012, at 7:00 PM, or as soon
thereafter as the matter may be
reached, at City Hall Council
Chambers at City Hall Annex, to
determine whether the property
designated as a vacant lot fronting
on Milledge Circle (Tax Map F34,
Parcel 14) in Forsyth, is unsafe
property, and, if so, what order
should be made by the Council to
specify such acts or things to be
done to the property to protect the
health, safety and general welfare of
the citizens of Forsyth and persons
who may live in or inhabit the
property.
These procedures are as set out in
City Code Sections 7-151 through
7-171.
The deed and tax records show that
the property is in the record name of
Mattie and Lonnie Head Estate in
care of Wallace Rutland, and a
representative of the owner should
attend the hearing on December 4,
2012, and present any evidence in
mitigation or explanation, may cross
examine any witnesses called by
the Enforcement Officer or the City,
and may be represented by counsel,
although that is not required.
The Forsyth City Council
determined that a reasonable cause
to proceed exists based upon its
preliminary finding that the property
fronting on Milledge Circle (Tax Map
F34, Parcel 14) is an unsafe
property, and unsanitary and unfit
for human habitation and the
general welfare of human beings
who may inhabit or use the
premises. The property is
overgrown, littered, and is becoming
a depository of trash and debris, in
violation of numerous City Codes.
On December 4, 2012, the Forsyth
City Council will hear evidence and
determine if the property is unsafe
and, if so, what remedy may be
imposed under the City Code.
Be governed accordingly, this 16th
day of October, 2012.
