The above-referenced
Property will be sold subject to the

or other matters of record to which
the Security Deed is junior in
priority; and all, if any, matters
affecting said Property which would
be disclosed by an accurate survey
and inspection of said Property.
Said Property will be sold as the
property of Butts County Holdings,
LLC or Herberton Rose Hill
Development, LLLP, and the
proceeds will be applied to the
payment of the described
indebtedness and all expenses of
this sale. Any remaining proceeds
will be applied pursuant to the State
of Georgia.
The above-referenced
Property will be sold on an "as is,
where is” basis without recourse
against Bank and without
representation or warranty of any
kind or nature whatsoever by Bank
with respect thereto.
