situated thereon and all rights, titles
and interests appurtenant thereto.
The indebtedness as shown in the
Note and secured by the Security
Deed has been and is hereby
declared due because of, among
other possible events of default, the
failure to make payments
thereunder when due. The
indebtedness remaining in default,
the sale will be made pursuant to
the Power of Sale provided in the
Security Deed for the purpose of
applying the proceeds thereof to the
payment of the indebtedness
secured by the Security Deed,
accrued interest, expenses of the
sale, and all other payments
provided for under the Security
Deed, including attorneys’ fees as
provided in the Note and Security
Deed, notice of intention to collect
attorneys’ fees having been given as
provided by law, and the remainder,
if any, shall be applied as provided
by law.
To the best of undersigned's
knowledge and belief, the parties in
possession of the Property are
Grantor and/or tenants of Grantor or
other persons in possession with
the consent or acquiescence of
Grantor. All notices required under
the Note, Security Deed, and
Georgia law having been made as
of this date. Said Property will be
sold on an “as is, where is” basis
without recourse against Lender
and without representation or
warranty of any kind or nature
whatsoever by Lender with respect
thereto. Said Property will be
subject to any matters which might
be disclosed by an accurate survey
and inspection of the property. Said
Property will be sold subject to any
and all unpaid taxes or
assessments relating to the
Property, and all liens,
encumbrances, easements and
other matters of record to which the
Security Deed is junior and inferior
in terms of priority, including senior
encumbrances that will not be
extinguished by the foreclosure sale

The Grand Jury chosen and sworn
at the November Term, 2012, of the
Monroe County Superior Court
submits the following presentments.
We wish to commend Judge William
A. Fears for the clarity and
thoroughness of his charge to our
body and for the dignity and
efficiency with which court
proceedings are conducted.
We wish to express our appreciation
to the District Attorney, Richard
Milam, and his staff for the
competent and courteous manner in
which they have handled all matters
brought before us. Also, we wish to
thank our Bailiff, Mr. Chester Grant,
for his courteous help.
We wish to commend the Clerk of
Superior Court, Lynn Ham, and her
staff for their assistance to this
Grand Jury.
We wish to commend Sheriff John
Cary Bittick, the investigators and
deputies of the Monroe County
Sheriff’s Office for their very
effective service and outstanding
protection to the people of Monroe
County.
We wish to commend Chief Keith
Corley and the officers of the
Forsyth Police Department for their
very effective service and protection
to the people of the City of Forsyth.
We also wish to commend all
Officers who were proficient and
professional in the explanations of
the cases that were presented to
this Grand Jury.
The Grand Jury heard from various
citizens of Monroe County who were
willing to testify before the Grand
Jury concerning several cases and
we appreciate their willingness to
appear.
On November 14, 2012, the Monroe
County Jail was inspected by the
Jail Inspection committee. We would
like to make the following
recommendations: 1) More
utilization of inmates for repairs and
maintenance. 2) Continued
improvements by painting and
repairs already started. 3) Support
Capt. Thompson’s need for more
staff; fill two open positions and
grant six additional positions.
We would like to compliment Capt.
Thompson’s efforts in improving
inmate Education. Also we would
like to compliment Capt. Thompson
and his staff for keeping a safe
environment for the employees and
inmates.
We wish to commend A. Frank
Deloach, our Foreperson and
Serina Rene Jenkins, our Clerk, for
the work they performed during our
deliberations.
We recommend that these
presentments be published in the
Monroe Reporter, the official organ
of Monroe County, and the usual fee
be paid for publication.

COUNCIL HEARING FOR
ABATEMENT OF PUBLIC
NUISANCE
To: Diversified Capital
Management, Inc., PO Box 1037,
Forsyth, GA 31029
Please take notice that the Building
Official of the City of Forsyth, upon
reasonable belief that the building
and property designated as 66
Jones Street (Monroe County Tax
Map F27, Parcel 51) in the City of
Forsyth, was unsafe, has caused an
inspection to be made thereof,
which inspection found that the
building is unsafe, and a report of
the conditions and defects in the
building was presented to the
Forsyth City Council at the regular
and open public meeting of October
16, 2012, for consideration. After
consideration of the report and the
preliminary evidence presented to
the Council, the City Council
determined that reasonable cause
exists to proceed with an abatement
procedure with regard to the
property designated as 66 Jones
Street, in Forsyth (Tax Map F27,
Parcel 51). The tax records of
Monroe County show that
Diversified Capital Management,
Inc. is the owner of the property.
A hearing will be held at a regular
and open meeting of the Council of
the City of Forsyth on December 4,
2012, at 7:00 PM, or as soon
thereafter as the matter may be
reached, at City Hall Council
Chambers at City Hall Annex, to
determine whether the building and
property designated as 66 Jones
Street (Tax Map F27, Parcel 51) in
Forsyth, is an unsafe structure, and,
if so, what order should be made by
the Council to specify such acts or
things to be done to the building to
protect the health, safety and
general welfare of the citizens of
Forsyth and persons who may live
in or inhabit the building and
property.
These procedures are as set out in
City Code Sections 7-151 through
7-171.
The deed and tax records show that
the property is in the record name of
Diversified Capital Management,
Inc., and a representative of the
owner should attend the hearing on
December 4, 2012, and present any
evidence in mitigation or
explanation, may cross examine any
witnesses called by the
Enforcement Officer or the City, and
may be represented by counsel,
although that is not required.
The Forsyth City Council
determined that a reasonable cause
to proceed exists based upon its
preliminary finding that the property
at 66 Jones Street (Tax Map F27,
Parcel 51) is an unsafe property,
since the house is dilapidated,
decayed, and unsanitary and unfit
for human habitation and the
general welfare of human beings
who live in or may live in the
premises. The building has been
deemed an “unsafe building” under
the provisions of Section 7-151 of
the City Code.
On December 4, 2012, the Forsyth
City Council will hear evidence and
determine if the property is unsafe
and, if so, what remedy may be
imposed under the City Code.
Be governed accordingly, this 16th

determine whether the building and

Circle (Tax Map F17, Parcel 100) in
Forsyth, is an unsafe structure, and,
if so, what order should be made by
the Council to specify such acts or
things to be done to the building to
protect the health, safety and
general welfare of the citizens of
Forsyth and persons who may live
in or inhabit the building and
property.
These procedures are as set out in
City Code Sections 7-151 through
7-171.
The deed and tax records show that
the property is in the record name of
Robert Lee Pittman, and Robert
Lee Pittman or a representative of
the owner should attend the hearing
on December 4, 2012, and present
any evidence in mitigation or
explanation, may cross examine any
witnesses called by the
Enforcement Officer or the City, and
may be represented by counsel,
although that is not required.
The Forsyth City Council
determined that a reasonable cause
to proceed exists based upon its
preliminary finding that the property
at 281 Pinkney Circle (Tax Map F17,
Parcel 100) is an unsafe property,
since the house is dilapidated,
decayed, and unsanitary and unfit
for human habitation and the
general welfare of human beings
who live in or may live in the
premises. The building has been
deemed an “unsafe building” under
the provisions of Section 7-151 of
the City Code.

Official of the City of Forsyth, upon
reasonable belief that the building
and property designated as 288 Old
Waterworks Road (Monroe County
Tax Map F40, Parcel 2) in the City of
Forsyth, was unsafe, has caused an
inspection to be made thereof,
which inspection found that the
building is unsafe, and a report of
the conditions and defects in the
building was presented to the
Forsyth City Council at the regular
and open public meeting of October
16, 2012, for consideration. After
consideration of the report and the
preliminary evidence presented to
the Council, the City Council
determined that reasonable cause
exists to proceed with an abatement
procedure with regard to the
property designated as 288 Old
Waterworks Road, in Forsyth (Tax
Map F40, Parcel 2). The tax records

premises safe, so as to render it a
nuisance and to be unsafe and
dangerous to the health, safety and
welfare of human beings who live in
or may live in the premises. The
building has been deemed an
“unsafe building” under the
provisions of Section 7-151 of the
City Code.
On December 4, 2012, the Forsyth
City Council will hear evidence and
determine if the property is unsafe
