COMPLAINT FOR
FORFEITURE
COMES NOW, the STATE OF
GEORGIA, by and through
Richard Milam, District
Attorney of the Towaliga
Judicial Circuit, pursuant to the
provisions of O.C.G.A. §16-13-
49 and O.C.G.A. §9-16-1, et.
seq., and shows this Court the
following:
1.
The property sought to be
forfeited is described in the
heading of this Complaint as
Defendant in rem, and is referred
to as “the property”.
2.
The property is presently in
the custody of Monroe County
Sheriff’s Office, is or will be
located in Monroe County,
Georgia, during the pendency
of this action, and venue and
jurisdiction are proper with this
Court.
3.
On or about April 22, 2016,
Deputies John Thompson and
Jacob Robins, both of the
Monroe County Sheriffs Office,
were on duty and observed a
white Ford Explorer failing to
maintain its lane of travel on
Georgia Highway 83 North in
Monroe County, Georgia. The
vehicle then quickly turned
onto Gilmore Road where the
deputies initiated a traffic stop
on the vehicle. The Ford Explorer
was displaying a Georgia
license plate of OA W3838.
Both deputies then approached
the Ford Explorer and the
driver, identified as Dealdran
Chambliss, was notified as to
the reason for the traffic stop.
While speaking with the Mr.
Chambliss, Deputy Robins
noticed a bag of suspected
marijuana sitting in the cup
holder of the center console.
Mr. Chambliss was then asked
to step to the rear of the vehicle
and was questioned further.
Mr. Chambliss told the law
enforcement officers that there
was more marijuana under the
back seat of the Ford Explorer.
Mr. Chambliss was then placed
under arrest and a search of
the vehicle located seven more
bags of suspected marijuana.
All suspected marijuana was
seized, placed into evidence,
and later tested with the test
indicating a positive result for
marijuana, with a weight of five
ounces. The vehicle was towed
and placed in the impound
lot of the Monroe County
Sheriff’s Office. The VIN for the
Ford Explorer is IFMDU34XI
SUB4806. These events took
place in Monroe County, Georgia
on Georgia Highway 83 North
and Gilmore Road.

The names and addresses
of all persons believed to be
owners or interest holders of this
property are as follows:

The property is contraband and
subject to forfeiture to the State
pursuant to the provisions of
O.C.G.A. §16-13-49, in that
the property was directly or
indirectly used or intended
for use to facilitate a violation
of O.C.G.A. § 16-13-30, or is
proceeds derived or realized
from a violation of O.C.G.A. §16-
13-30.

The property is contraband
and subject to forfeiture to the
State pursuant to the provisions
of O.C.G.A. § 16-13-49, in
that the property was found in
close proximity to a controlled
substance, namely marijuana,
or to other property which
is subject to forfeiture under
O.C.G.A. §16-13-49.
7.
On April 22, 2016, Dealdran
Ormond Chambliss was arrested
and charged with Failure to
Maintain Lane, a violation ofO.
CG.A. §40-6-48 and Possession
of Marijuana with the Intent to
Distribute, a violation of O.C.G.A.
§ 16-13-300).
WHEREFORE, the STATE OF
GEORGIA prays:
1. That all purported owners and
interest holders listed herein be
personally served with a copy of
the Complaint and Summons;
2. That all purported owners
and interest holders who are
unknown, who reside out of
state, who depart the state,
who cannot after due diligence
be found within the state, or
who conceal himself/herself so
as to avoid service, be served
by publication by publishing a
notice of proceedings once per
week for two successive weeks
in the newspaper in which the
Sheriff s advertisements are
published;
3. That a hearing be held within
sixty (60) days after service of
the Complaint;
4. That the Court enter judgment
in favor of the State declaring
the property contraband and
forfeited to the State;
5. That the Court retain
jurisdiction to direct the proper
distribution of the property in
accordance with O.C.G.A. §9-
16-19; and
6. That the State of Georgia
be afforded such other relief
and remedies available under
law and the State further prays
for due process to enforce the
forfeiture.
