COUNTY LINE TIMELINE
• June 3,2005 The Governor notifies both counties he will select a
surveyor to settle the dispute but encourages the counties to try to
resolve the dispute.
• July 25,2005 Bibb and Monroe county commissioners begin a
round of meetings to try to resolve the dispute, with Monroe County
agreeing to let Bass Pro Shops stay in Bibb County.
• Oct. 6,2005 Commissioners reach a stalemate and ask the secre
tary of state if they can establish part of the county line in the Bass Pro
Shops parking lot and let the surveyor determine the rest.
• March 9,2006 The attorney general rules commissioners cannot
settle part of the county line dispute — it’s all or nothing.
• September 2006 Gov. Perdue asks commission chairs Harold
Carlisle and Charlie Bishop to meet to reach a compromise. Carlisle
and Bishop reach a compromise to keep the county line where both
counties currently recognize it on their tax maps. Macon developer
Roy Fickling says he will put a 400,000 square-foot retail space in
Monroe County across from Bass Pro Shops if they can work out a
county line agreement. The retail space could bring as much as $1.6
million in sales tax money to the county.
• November 2006 A Monroe County grand jury concurs with Carl
isle’s opinion, and urges commissioners to approve the compromise.
Bibb County unanimously approves the compromise, but Monroe
County is split. Commissioners Mike Bilderback, Larry Evans and Jim
Ham oppose the compromise. Any vote establishing the county line
must be unanimous.
• Aug. 15,2007 Monroe County commissioners vote unanimously
to propose that the county line be established where it was originally
drawn. Bibb County commission chairman Charlie Bishop rejects it.
• Sept. 4,2007 Monroe commissioners vote unanimously to pro
pose that each county appoint a surveyor, and that those surveyors
will then appoint a neutral surveyor to delineate the county line.
• Sept. 5,2007 Gov. Perdue summons Monroe County commis
sioners to Atlanta to discuss the county line dispute.
• July 7,2008 SurveyorTerry Scarborough announces he’ll begin
work to survey the Bibb-Monroe county line on Aug. 1.
• March 27,2009 Scarborough submits his survey, which establish
es the line hundreds of yards south of where it is currently recognized,
to secretary of state Karen Handel.
• January 2010 Secretary of state Karen Handel resigns to run for
governor. Gov. Sonny Perdue prepares to appoint state Rep. Jim
Cole of Forsyth but Cole opts to take the job as Mercer athletic direc
tor instead. Perdue appoints Rep. Brian Kemp as secretary of state.
• Feb. 28-March 1,2010 Appointed by Handel to make a recom
mendation on the county line dispute, administrative law judge John
Sherrill hears three days of testimony on the Scarborough survey.
• April 29,2010 Sherrill recommends Kemp accept Scarborough’s
survey.
• June 1,2011 Kemp hosts a hearing on the dispute and urges
Monroe and Bibb counties to reach an agreement. If they don’t, he
pledges to make a decision on the survey.
• Aug. 23,2011 Kemp announces that he is rejecting the Scarbor
ough survey because he can’t be sure it’s the original line.
• Dec. 30,2011 Monroe County sues Kemp in Fulton County Supe
rior Court saying he made errors in rejecting the Scarborough survey.
• Sept. 21,2012 Fulton County judge Kelly Lee dismisses Monroe
County’s suit, but leaves the door open for Monroe to sue again by
ruling that Monroe County does have grounds to sue Kemp. Monroe
files a new lawsuit against Kemp on different grounds.
• Jan. 9,2013 At a hearing on Monroe County’s lawsuit, Fulton
County judge Kelly Lee announces that she will issue a writ of manda
mus ordering Kemp to accept the Scarborough survey, saying that he
failed to follow the law in rejecting the survey.
• Jan. 10,2013 Bibb County says it was blindsided by the ruling
and files an emergency appeal asking to become part of the Monroe
County vs. Brian Kemp lawsuit.
• Sept. 10,2013 The counties argue before the Georgia Supreme
Court over Judge Lee’s order that Kemp set the line.
• March 10,2014The Georgia Supreme Court rules that secretary of
state Brian Kemp has a duty to set the Monroe-Bibb county line, but
Judge Lee overstepped her authority in telling him where to put it.
• July 25,2014 Judge Lee orders Kemp not to accept any more evi
dence in the county line dispute since he closed the record.
• Aug. 14,2014 Backed by attorney general Sam Olens, secretary
of state Kemp appeals to the Georgia Supreme Court a July 25 order
from Judge Lee that he not accept any more evidence in the dispute.
• July 13,2015 The Supreme Court agrees to hear Kemp’s appeal of
Judge Lee’s order that he keep the record closed on the dispute.
