said she refused to let Jones
inside because he was drunk
Talmadge said Jones eventu
ally broke three locks on the
door, splitting her wooden
door to enter her home. The
prosecutor, Towaliga Circuit
assistant district attorney
Leslie Tilson, then played a
more than 10-minute-long
9-1-1 call in which Talmadge
screams repeatedly for help
as Jones attacks her. Tal
madge said Jones punched
her in the cheek and tried to
twist her neck in an effort to
break it. Talmadge said she
struggled with Jones for near
ly 20 minutes and was on the
verge of losing consciousness
when police arrived.
“I knew he was going to kill
me,” Talmadge said. “He told
me that nothing was going
to separate me from him but
death.”
During cross-examination
by Jones’ attorney Rusty
Knox, Talmadge then
revealed that she had seen
Jones at a neighbors home
earlier the same night when
they both had gone to buy
crack cocaine at the same
time. Talmadge also admit
ted that the two began argu
ing after she knocked Jones’
crack out of his hand.
Two Forsyth Police officers,
Sgt. Willie Barkley and Cpl.
Wade Kendrick, also testified
for the prosecution, say
ing they saw evidence of a
struggle throughout Tal-
madge’s home. Both officers
said when they arrived, Jones
was on top of Talmadge, who
was face down on the floor,
and had his hands around
her neck
The other prosecution
witness, Dr. David Brian Kay,
an ER physician at Monroe
County Hospital, testified
that Talmadge suffered an
acute neck and lower back
strain. However, Kay said he
did not see any bruising or
swelling around the neck to
indicate strangulation.
Two more Forsyth Police
officers, Kianda Pritchett and
Greg Jefcoats, testified on
behalf of the defense. Pritch
ett testified that Talmadge
told her she had a serious
injury to the side of her
head, but Pritchett said she
found no wound to support
that claim. Jefcoats said he
interviewed Talmadge in the
MCH ER and said that she
momentarily struggled to
breathe but then regained her
composure. Another defense
witness, Gregory Winslow,
an MCH nurse, said he
never witnessed Talmadge,
who smelled of alcohol
upon arrival to MCH, lose
consciousness. Winslow said
he didn’t see any significant
wounds on Talmadge and
said he discharged her once
her CT scan results came
back normal.
The defense then saved its
most important witness for
last when Knox called expert
forensic pathologist Dr. Kris
Lee Sperry to the stand.
Sperry, formerly the GBI’s
chief medical examiner, said
he reviewed Talmadge’s re
cords and found no evidence
of strangulation. Sperry said
Talmadge did not have the
customary cuts or bruising
on her neck and noted that
her neck CT scan appeared
normal. Sperry said only in
movies can persons fracture
their neck by twisting it and
said there was no evidence
that Jones tried to break
Talmadge’s neck
In his closing argument,
Knox conceded that Jones
attacked Talmadge and
urged the jury to find his
client guilty of a lesser charge,
simple assault. Knox argued
that there was no evidence
of aggravated assault because
there was no indication
that Talmadge had been
strangled. Knox also noted
video evidence that showed
Talmadge walking on her
own accord out of her home
following the incident to go
with EMTs to the hospital.
Knox then pleaded with ju
rors not to base their verdict
on sympathy for Talmadge
but instead to follow the
evidence.
In her close, Tilson said
the 9-1-1 tape was proof that
Talmadge endured a horrific
attack Tilson said she never
argued that Talmadge actu
ally suffered significant injury
but instead stated that Jones’
actions could have caused
serious injury or even death.
Tilson then lauded the ac
tions of Forsyth officers, who
prevented things from being
even worse for Talmadge.
“Billy wasn’t going to stop,”
Tilson said. “They (officers)
forced him to stop.”
Tilson then turned her
attention to the jury: “This
is your opportunity to force
Billy to stop.”
After about an hour of
deliberation, Jones was found
guilty of aggravated assault
