VARIANCE
The Mayor and Council of the City of
Forsyth will consider and the public
may be heard as to an ordinance pro
viding for the alteration and amend
ment of a Zoning District and the
Zoning Map of the City of Forsyth by
variance, at City Council Chambers
at City Hall at 23 E. Main Street in
Forsyth at 6:00 PM on the 7th day of
November, 2022, or as soon thereafter
as the matter may be reached, and the
property subject of the application for
a zoning variance is one acre, more or
less (Monroe County Parcel F27 092)

The request for a variance is to allow a
10-foot setback from the rear (south)

NOTICE OF DRAFT PART 70 OPER
ATING PERMIT MODIFICATION
To All Interested Parties:
The Georgia Environmental Protec
tion Division announces its intent to
modify Part 70 Air Quality Operating
Permit No. 4911-207-0030-V-08-0 is
sued to Smarr Energy Facility by the
issuance of Permit Amendment No.
4911-207-0030-V-08-1. The facil
ity is located at 1077 Rumble Road,
Smarr, Georgia. The main purpose of
this permit amendment is to is to re
new the Acid Rain Permit, which will
neither increase nor decrease pollut
ant emissions. The Georgia Environ
mental Protection Division (EPD) has
prepared this Title V Operating Permit
Amendment in accordance with Title
V of the Clean Air Act. This permit
amendment will be enforceable by the
Georgia EPD, the U.S. Environmental
Protection Agency, and other persons
as otherwise authorized by law.
The draft permit, explanatory narra
tive, and permit application will be
available for review on our Internet
site, https://epd.georgia.gov/draft-title-
v-permitsamendments.
These documents, and all informa
tion used to develop the draft permit
amendment are available for review
at the Georgia Environmental Protec
tion Division, Air Protection Branch,
4244 International Parkway, Suite
104, Atlanta, Georgia 30354. Due to
the COVID-19 pandemic, all visits to

Operating Permit Modification. Per
sons wishing to comment on the draft
Part 70 Operating Permit Modification
are required to submit their comments,
in writing, to EPD at the above Atlanta
Air Protection Branch address or via
email [preferred] to epdcomments@
dnr.ga.gov (emails must contain the fa
cility name and “air permit” in the sub
ject line). Comments must be received
by the EPD no later than 30 days after
the date on which this notice is pub
lished in the newspaper. (Should the
comment period end on a weekend or
holiday, comments will be accepted up
until the next working day.) The Di
vision, in making its final decision to
issue the Part 70 permit, will consider
all comments received on or prior to
that date.
Any requests for a public hearing must
be made within the 30-day public com
ment period. A request for a hearing
should be in writing and should speci
fy, in as much detail as possible, the air
quality related issues that constitute the
basis for the request. Where possible,
the individual making the request
should also identify the portion(s) of
the Georgia Rules for Air Quality Con
trol and/or the Federal Rules that the
individual making the request is con
cerned may not have been adequately
incorporated into the draft permit. If a
public hearing on the draft Title V Op
erating Permit is to be held, the date,
time, and location of the hearing will
be provided by a subsequent separate

such hearing, any
one may present data, make a state
ment or comment, or offer a viewpoint
or argument either orally or in writing
concerning the draft Title V permit.
Any information received during a
public hearing will be considered by
the Division along with all other infor
mation received during the comment
period when making its final decision
to issue the Title V permit amendment.
During the current COVID-19 pan
demic, the Division will only conduct
public hearings in “virtual” format us
ing Zoom meeting applications.
Following this 30-day public com
ment period, the EPD will consider
all comments, make any necessary
changes, and issue a proposed permit
amendment to U.S. EPA. The pro
posed permit amendment will then
undergo a 45-day review by U.S. EPA
in accordance with 40 CFR 70.8. Infor
mation pertaining to U.S. EPA’s review
period can be found on their website at
https://www.epa.gov/caa-permitting/
georgia-proposed-title-v-permits.
After the EPA review period has ex
pired, the EPD will issue a final Part
70 Operating Permit Amendment in
corporating any changes required by
U.S. EPA. Copies of the final Title V
Operating Permit, comments received,
EPD’s responses to comments, and any
other relevant information will then
be made available for public review at
our offices by appointment only during
the COVID-19 pandemic. A summary
of comments and any changes made
to the final permit will be found in an
addendum to the narrative. A copy
of this narrative and the final Title V
permit will be added to the informa
tion already available at the Internet
address given above.

Because of a default under the terms
of the Security Deed executed by MI
CHAEL DYLAN OGLES to Mortgage
Electronic Registration Systems, Inc.,
as nominee for Platinum Mortgage,
Inc. dated May 15, 2018, and recorded
in Deed Book 1860, Page 3, Monroe
County Records, said Security Deed
having been last sold, assigned, trans
ferred and conveyed to NATIONSTAR
MORTGAGE LLC, securing a Note
in the original principal amount of
$103,098.00, the holder thereof pursu
ant to said Deed and Note thereby se
cured has declared the entire amount
of said indebtedness due and payable
and, pursuant to the power of sale con
tained in said Deed, will on the first
TUESDAY, DECEMBER 6, 2022, dur
ing the legal hours of sale, before the
Courthouse door in said County, sell
at public outcry to the highest bidder
for cash, the property described in said
Deed, to-wit:

OF MONROE COUNTY, GEORGIA,
CONTAINING 3.54 ACRES, AND BE
ING KNOWN AND DESIGNATED
AS LOT 27, OLD INDIAN SPRINGS
FARMS, PHASE II, ACCORDING TO
THAT CERTAIN PLAT OF SURVEY
ENTITLED “PRELIMINARY PLAT
FOR OLD INDIAN SPRINGS FARM
PHASE II”, PREPARED BY THOMP
SON & FREEMAN, SURVEYORS,
DATED FEBRUARY 24, 2002, AND
RECORDED IN PLAT BOOK 25, PAGE
164, CLERK’S OFFICE, MONROE SU
PERIOR COURT, WHICH PLAT IS BY
THIS REFERENCE INCORPORATED
HEREIN AND MADE A PART OF THIS
DESCRIPTION.
Said property is conveyed subject to
the Old Indian Springs Farms subdivi
sion covenants Phase Two dated Sep
tember 25,2002, and recorded in Deed
Book 814, Pages 187-191, aforesaid
records, and to that certain declaration
of covenants (as to Road Maintenance)
Lots 26, 27 & 28, Old Indian Springs
Farm, Phase II, dated November 3,
2003, and recorded in Deed Book 924,
Pages 78-79, aforesaid records.
Said property is known as 500 INDIAN
WINTER DR, FORSYTH, GA 31029,
together with all fixtures and personal
property attached to and constituting a
part of said property, if any.
Said property will be sold subject to
any outstanding ad valorem taxes (in
cluding taxes which are a lien, whether
or not now due and payable), the right
of redemption of any taxing authority,
any matters which might be disclosed
by an accurate survey and inspection
of the property, any assessments, liens,
encumbrances, zoning ordinances, re
strictions, covenants, and matters of
record superior to the Security Deed
first set out above.
The proceeds of said sale will be ap
plied to the payment of said indebt
edness and all expenses of said sale as
provided in said Deed, and the balance,
if any, will be distributed as provided
by law.
The sale will be conducted subject (1)
to confirmation that the sale is not
prohibited under the U.S. Bankruptcy
Code and (2) to final confirmation and
audit of the status of the loan with the
secured creditor.
The property is or may be in the pos
session of MICHAEL DYLAN OGLES,
successor in interest or tenant(s).
