judge l-'alligant rendered a decision in
l he Superior Court yesterday afternoon
overruling and denying the motion for a
r e dial in the case of W. S. Mell, con
v , ie i in that tribunal, of the murder of
janif ? Buzbee and seniets?vd to expiate the
vrime on the scaffold.
In rendering the decision Judge Fain
eant visited with the severest measures
of judicial condemnation the crime of
which Mell has been convicted and dis
missed with a word the voluminous affi
davits recently filed in court, upon which
Is based the application for anew trial
upon (he ground’of newly-discovered evi
dence.
The decision rendered by the court oven,
ruling (lie motion and denying anew trial
Is as follows:
"I'nder the evidence in this ease ami
ih contentions of the parties, it was em
inently proper to charge Section 73 of the
{ riminal Code along with the other prin
ciples of the law of justifiable homicide,
having the application to the jury, ac
cording to the evidence as they behoved
it to be.
"The state did not consider it neeer/sary
io rebut the ground of motion based on
newly-discovered evidence save by the
overwhelming evidence adduced otj the
trial. The annulling of this ground is fully
sustained by the principles of law recog
nized and reiterated in O'Neill against
the state.
This was a use Jess, causeless, 'defense
lees and remorseless murder, with<ut a re
dlining feature. The motion for anew
trial is overruled on every ground.”
Judge Falliganl overruled also the mo
tion for anew trial in the case of James
iloirllrte tried, convicted and sentenced
to he hanged for the murder of Moses
Williams. Aside from the interest in the
case of Moultrie, tho decision/ gains an
added interest for the legal fraternity
from the fact that it is upon a point
which has recently been the/ subject of
much discussion and of more than one
decision in the Supreme Cotirt.
It relates to the propriety of the judge
charging two sections of the criminal
code, relating to the law of justifiable
homicide, in connection w/th each other.
The case cited by Judge Faliigant in the
decision and relied upon by him to up
hold its correctness, has been urged by
counsel for the defendant in support of
the exactly opposite contention. In this
de Ision Judge Falligan” says:
"The. real ground of motion is the al
leged error of the court in charging sec
tion seventy-three of the criminal code,
and the language Vised in presenting
same.
"The very able opinion of Justice Lit
tle, in Powell agains i the state, declares
It proper to change the various sections
relating to justifiabl e homicide 'under the
contentions raised,’ leaving the applica
tion to the jury. The jury could and
would have applied the same according
to the evidence, as they believed it to
be It would not be proper for the judge
to assume, under the contentions raised,
that the homicide occurred under either
of the theories contended for. That is a
question exclusively for the jury.
“In view of t'ae that Juke Moul
trie gave to Lavinia Nathans, the first
witness upon the scene of the homicide,
in the presence of the dead, as a reason
for the killing , 'I don’t meddle anybody,
and he had no business in here fighting;'
that, in spite of the appeal of Stella Will
iams not 1 1> s'aoot, he tired at the back of
his retreating victim three times, inflict
ing two mortal wounds; and of the preced
ing scuffling! of which there was evidence,
i; was proper in my judgment to charge
section 73.
The jury accepted the contention of the
date that Moultrie was the real aggressor.
The verdict is fully sustained by the evi
dence, orel the motion for anew trial is
refused.” N
Both i/ases, that of Moultrie as weli as
that of Mell. will be carried- at once by
writ cit error, to the Supreme Court.
-Mcssr.v. Twiggs and Oliver, wito represent
Moultrie, and Mr. R. L. folding, who
teprevents Mell, are confident that they
will be able, in the higher tribunal of jus
tice, to secure new trials for their clients.

It is pretty tvell understool that with
the retirement of Vice President S. R.
Knott of the Plant System, Mr. Thomas
K Scott, now general manager of the
Georgia Railroad, will succeed to the
IMant System’s vice presidency.
Although no official announcement of
the appointment has been made, there
does not 6eem to be much doubt that Mr.
Scotf l*i the man. He is a railroad man
of long experience, and as the active head
of the Georgia Railroad, he has a thorough
knowledge of the operating and traffic de-
Pu t merit*.
Mr. Knott’s resignation is in effect next
Sunday. He will leave at once to assume
•<is new duties as vice president of the
' hicago and Alton Railroad, in which he
will have direct charge of the traffic busi
ness.
