DUTTON MAY ANSWER FOR IT.

Conductor Started It.
Atlanta. June s.—The only sensational
development in the wreck which occurred
in the Southern Railroad yards here yes
terday in which three people were killed
and many others injured, is the statement
made by Engineer T. J. Pullman of the
switch engine, which did the damage, lie
asserts most positively that the yard con
ductor. G. B. Dutton, now under arrest
and held for investigation in connection
with the wreck, started the switch en
gine and ran into the passenger train.
The case against Dutton was not heard
in the recorder's court to-day, but will
come up to-morrow, being continued on
request of counsel for the defendant.
Dutton still stoutly denies the
charge, but at least two witnesses,
Jt is said, will testify before the recorder
that he did start the engine and caused
the wreck.
Death has failed so far to claim any
more of those who were in yesterday's
frightful wreck, and attending phygician*
row given as their opinion that every i
one of the injured will recover.
All of the wounded, sa> the surgeons,
are doing very well to-day, and unless
something unforseen occurs, all will ulti
mately regain their health and strength.
As soon as possible yesterday afternoon
the wounded were carried to either the
Grady Hospital or to the homes of friends
and relatives in the city.

ter obtained under the laws of South
Carolina, the North Augusta EUectrlc and
Improvement Company was organized to
day as follows: Jaimes U. Jackson, Au
gusta, president; R. Jjaneaster Williams,
of Richmond, vice president; Alfred S.
Elliott, of Wilmington, Del., treasurer;
Henry Bum of Charleston, general coun
sel; Walter M. Jackson, Augusta, general
manager; Eouis T. Taliaferro, Augusta,
secretary; J. William MiddendOTf, Balti
more; John Blair McAfTee, Philadelphia,
Ernest Groeebeck, and M. J. Verdery, of
New York, with foregoing officer*, consti
tute Board of Directors.
The contract for building the railroad
from Augusta to Aiken, and the electric
power house, was awarded to John Blair
McAfTee of Philadelphia. All the bonds
ef the company hare been subscribed for
and all the required capital has been se
cured. The company also closed an option
on the Danforth tract of 1,600 acres Just
beyond North Augusta, which secures all
desired land between Augusta and Clear
water. S. C. The company is capitalized
at $1,600,006. Anyone familiar with the
personnel of the Seaboard Air Line wifi
observe a olose kinship in this organiza
tion.
TECH STUDENTS MOVE OUT.

for twenty days' board at the Tech, dor
mitory. when they thought it should only
be $9. fifty students quietly packed their
toes yesterday afternoon and went to
houses in Atlanta to board.
The action of the student* ctome some
what as a surprise to the faculty, as it
was expected that the boys would ante
up the tit. Now only about seventeen
students are living at the dormitory, and
it is said that some of these may leave.
The reason for the students leaving Is
on account of the notice posted by Capt.
Lyman Hall, the president, several days
ago. which stated that the dormitory
funds were a little low, and ae he was
personally responsible for any shortage
that might accrue, it would be necessarv
to get the boys to deposit *l2 for the
twenty days In June. The notice also
stated that if there was any money left
over, It would be refunded to the boys
at ttie expiration of the twenty days.

Lawton of Savannah, Col. W. E. Wooten
of Albany, and Judge Advocate General
George M. Napier of Mon roe, will meet
at the eapltol Friday to begin the revis
ion of the military laws of the state.
The board was appointed several weeks
ago by Gov. Candler to revise the mili
tary laws, which are out of dute. and
very conflicting. The board will proba
bly be In session for some time. Mem
bers of the board wrote to every officer
to know If they desired any new lawn.
Numerous replies have been received,
•md It is thought by the time the board
meets nearly every officer In the state
wiH have responded to the letters. Mem
ber* of the board will receive *4 per day

twenty-four hours, the Jury returned a
verdict of guilty of murder In the first
degree, in the case of the state vs.
James Reaves, colored, lor the killing of

mored that negroes of the Pond town dis
trict have purchased and have concealed
fifty Winchester rifles with which to res
cue Reaves. The authorities, though, np
preherd no .longer. The local military
company Is under orders to hold itself at
e moment's notice to suppress any- up
rising.

Atlanta, June s.—Allegations and aver
ments of so sensational a nature, as to
cause even the attorneys Interested ir
the case to raise their eyebrows in sur
prise were the features of the hearing of
the case of C. J. Simmons against the
Atlanta Home Insurance Company this
morning. The hearing occurred in the
office of Judge John S. Candler. Mr. Sim
mons asks for an injunction to prevent
the Atlanta Home Insurance Company
from reducing Its capital stock from: $500,-
000 to $200,000 as it intends doing at a meet
ing of its stockholders called for June 6.
The principal allegation was of Mr.
Simmons, who stated in his petition that
the same spirit that dominates and con
trols the Atlanta Home Insurance Com
pany also controls and dominates the
Trust Company of Georgia, the East At
lanta Railway Land Company and the At
lanta Railway and Power Company. Mr.
Simmons alleged that all three of. these
companies were practically insolvent.
Another feature of the case was an
averment by the Atlanta Home Insurance
Company In Its answer in which it de
clared that the stock In the Atlanta
Home Insurance Company now held by
Mr. Simmons hOB been acquired by him
only a few days ago and had been pur
chased for the purpose of injuring the
Atlanta Home Insurance Company. An
Interesting account of an attempt to sell
the same stock to Capt. R. J. Lowry,
president of the Atlanta Home, Is given.
No little Interest was excited by the
admission of the Atlanta Home Insurance
Company' that in 1899 its income was about
$300,000, while In 1900 la was less than SICO,-
000. The company also admitted that In
1899 It had expended about $163,000 and In
1900 It had expended about $198,000.
WERE EATEN BY SHARKS.
Little Doubt Now of Fate of Missing
t Negro Fishermen.
Charleston, S. C., June s.—The fate of
the fifteen fishermen of the mosquito fleet
of this port who have been missing for
days seems to be sealed. The smack Vic
toria came Into port this morning bring
ing an enormous shark which had been
caught near the scene of the disaster to
the fishing boats. When the monster was
cut open the arm of a negro man was
found In Its stomach. The Inference to be
drawn from this fact is obvious.
Las, week twelve boats of the mosquito
fleet were caught in a sudden storm off
the Eastern Patches, a famous fishing
ground, thirty miles off shore. All of the
boats were wrecked or more or less In
jured, and three of them are still missing.
There were flften men on these three. The
catch of the Victoria Indicates that a
shocking fate was met by the unfortunate
fishermen.

Columbia, S. C., June s.—Last night
Noah Garner, While walking on the street
witli Mrs. James Blackwell, was confront
ed by the husband of the woman and
shot through the body, probably fatally.
Blackwell has disappeared.
Mrs. Blackwell came here as a widow,
and was often in the company of Gar
ner, who represented himself as a single
man. Blackwell, it seems, has been fol
lowing them and appeared very unex
pectedly on the scene last night. Garner
Is said to have a. wife and children in
Greenville, where the Blackwells have
also lived.
Garner was employed here in the Co
lumbia Duck Mills.
SUPREME COURT APPEALED TO.
Charleston People Do Not Want to
Drink Suit Water.
Columbia. S. C., June 4.—The question
of whether Goose Creek, Charleston
county, contains Balt or fresh water, has
been raised in the Supreme Court, and it
is an Important one to those Interested
tn the scheme for supplying Charleston
with water.
Some days ago It was announced that
instead of getting water from the Edisto
river it was to be gotten frgm Goose
creek at very much less expense—some
thing like $1,800,000. The opponents of this
plan have sent lawyer* to Columbia to
ask the Supreme Court to prevent the
contract toeing executed on the ground
that the waters of this creek are salt.

Grant is shown to toe the first man to
hold what may be termed $1,900,000 of At

Annual regatta of Savannah Yacht Club
will take place at the Club House at
Thunderbolt to-day (June 6, 1961). The
steamers Clifton and Alpha will leave
the city at 9 a. m. from the wharf foot
Whitaker street. Any member wishing to
go from the city on the steamers may do
so. Both steamers will follow the races,
leaving the dub House immediately after
the yachts start in the races. Music and
refreshments will be furnished as usual
on the steamers. Steamers will return to
Club House after the races. The band will
be transferred, to the Club House, where
dancing will be enjoyed.
Captains of yachts will report to Sail
ing Committee, Mr. Albert Wylly, Chair
man, at the Club House not later than 11
o'clock a. m., to receive their Instructions
and printed rules.
The first-class yachts will be started
at 11:30 punctually, and the other classes

Atlanta. June s.—Two sensational
moves In the CatgP Creek wreck suit* oc
curred in 'the Uhited States Court room
this morning—both made by Hon. Hoke
Smith. Immediately after court convened.
Mr. Smith arose, and asked Judge New
man to call another one of the cases. The
judge in reply to the request, stated that
there would not be sufficient tine at the
present session of the court to hear an
other one of the suit*, and that he there
fore could not do what the attorney de
sired. Mr. Smith thereupon Immediately
asked that all the case* toe referred to an
auditor.
Col. P. H. Brewster, counsel for the
Southern Railroad, instantly got up and
asked the court to allow him time to
consider this motion, and either consent
or object to it, as in his judgment seemed
best after reflection. This request the
court acceded to and the Southern Rail
way'* counsel is now going over the mo
tion with a view to deciding whether or
not they wont the ease* to go before an
auditor.
A SUICIDE AT RARNENVILLE.

Barnesvllle, Ga., June B.—D. W. Oliver,
a well-known cltisen living near the city,
killed himself this afternoon at 8 o'clock
by cutting hit throat with a knife. Tho
oause of this rash act was due to a tit
of temporary Insanity caused hy despond
ency over financial troubles. The deceased
was about 40 years old.
