Atlanta, Nov. 26.—The House to-day
refused to purchase 600 copies of Van
Epps and Akins’ digest of the Georgia
Supreme Court reports for the use of
county officers and Judges of the Su
perior Courts of the state. The action
of the House against the resolution,
which was introduced by Mr. Slaton
of Fulton, was almost unanimous. It
was first amended so as to provide for
only 400 sets at $lB a set, instead of
$25 as at first provided. The matter
was discussed at some length, but the
opposition, basing its fight on the
ground that the condition of the state
treasury would not warrant any such
purchase, won the day.
The Soldiers’ Home bill was next taken
up. but consideration of it was not con
cluded when the House adjournment
arrived. The bill provides for the ap
propriation of $19,500 insurance money
to the rebuilding of the home, and $20,-
000 for maintainance and equipment of
the home during the coming year.
MaJ. W. T. Gary of Richmond made
a strong speech In favor of the meas
ure and tried to have it disposed of
before adjournment. The motion to ad
journ, however, was carried, and the
bill will come up as unfinished busi
ness to-morrow.
The House adopted a resolution pro
viding for two sessions a day here
after. These sessions will be held from
9:30 to 1 o'clock and from 3 to 5 in the
afternoon.
A resolution to make the Atlanta de
pot bill the special order for next Tues
day morning was referred to the Com
mittee on Rules.

The Senate adopted a resolution
making the bill providing for constitu
tional amendments Introduced by the
joint committee, the continuous special
order beginnnig to-morrow morning,
Immediately after the reading of the
journal.
The Senate killed the resolution pro
viding for adjournment from Wednes
day afternoon to Monday morning and
declaring the intervening days dies
non.
In view of the fact that the resolu
tion was defeated, the Senate adopted
a resolution refusing all leaves of ab
sence for Friday and Saturday, except
for providential cause.
Senators Swift, Smith and Johnson
were appointed as ihe Senate members
of the committee to investigate the Sol
diers’ Home. Senator Smtht said there
was no home to investigate, and de
clared that the gentlemen in charge of
the home were above reproach.
The bill by Senator Hamrick, provid
ing for the election of county school
commissioners by the people, was pass
ed by a vote of 29 to 7, in spite of
considerable opposition that was man
ifested in the debate.
The Senate insisted on its amend
ment to the Wright dispensary bill,
providing that the measure should not
interfere in any way with existing lo
cal liquor laws. This was the amend
metn that the House refused to agree
to. Senators Ellis. Holder and John
son were appointed a < onference com
mittee on the part of the Senate, and
a committee from the House will be
named to-morrow.
Senators Ellis and Chappell introduc
ed a bill to-day to encourag - immigra
tion to Georgia by the appointment of
a commissioner of immigration.
TRAVELING MAN GOES TO JAII,.

Americus, Ga., Nov. 26.—E. L. Heys
forrperly a well-known traveling sales
man for the Whitely Grocery Company
of Americus, to-day surrendered him
self to Sheriff Bell and will serve a
term of twelve months imprisonment
for embezzlement. At previous terms
of the court the Whitely Company
prosecuted Heys for embezzlement and
upon conviction the defendant was sen
tenced for a misdemeanor upon recom
mendation of the Jury and required to
pay a fine of SI,OOO or serve a year in
prison.
Heys appealed the case to the Su
preme Court, which tribunal, in a re
cent decision, sustained the sentence of
the court below. In the meantime
Heys had raised half the amount of
the fine, but failing to secure the re
mainder he surrendered himself to the
sheriff and is now in jail preparatory
to being sent to the chaingang. Heys
is widely known throughout Southwest
ern Georgia and his unfortunate pre
dicament arouses much sympathy for
himself and family.
A CARNIVAL COMPANY BARRED.

Americus. Ga., Nov. 26.—The Cincin
nati Carnival Company is playing in
hard luck in this section, apparently.
The company was shut out of Amerl
c.us recently on account of a strenuous
tight made by certain citizens, and this
week it was billed at Cordele. To-day
a committee of Cordele citizens and
lawyers came to Americus. seeking at
’the hands of Judge Littlejohn an in
junction against the company for ob
structing the streets of that city with
tented attractions. Judge Littlejohn
granted Che injunction as desired.
Statesboro New* Note*.
Statesboro, Ga., Nov. 26.—Rev. J. M.
T.ovett, presiding elder of the Dublin
district. South Georgia Conference, held
his last quarterly conference here last
night. The station is behind with pas
tors' and elders' salaries, but will pay
out. Resolutions of gratitude to the
pastor and elder for good service dur
ing the year were passed by the con
ference. The stewards were elected and
the hope is expressed that both the
pastor. Rev. Whltly Langston, und El
der Lovett will return another year.
Heavy engines of the Central Rail
way broke down both of the turn
tables of the Central and Savannah and
Statesboro railways last night.

FARMERS FIGHT FATAL DUEL.
Frank L. Miller Killed by John n.
McGhee at Cave Springs—Hot
Temper Lead* to Murder.
Rome, Ga., Nov. 26. —John B. Mc-
Ghee shot and killed Frank L. Miller,
near Cave Springs, this afternoon,
about sundown. Miller was shot once
in the back and again under the left
arm, the last shot passing through the
body, and causing death m a few min
utes. Miller was out hunting on Mc-
Ghee’s place and Mrs. McGhee told her
husband that Mr. Miller had shot at
her children. McGhee had started to
Cave Springs for a warrant, when he
mte Miller coming out of tna field into
the road. He accused Miller of shoot
ing at the children. Miller denied tills,
and few hot words passed.
Suddenly McGhee drew a pistol and
as Miller wheeled fired, the bullet
passing into the back. There was a
sharp scuflie and again McGhee lired,
the weapon being pressed against Mil
ler’s left side. The unfortunate man
fell and soon expired. The killing was
witnessed by Miller’s small son, who
sat in a buggy, and two or three oth
ers. McGhee left at once. Bloodhounds
were only able to track him a short
distance. He is 40 years of age, and
is said to be a man of violent temper
when angered.
Miller was 52 years of age, married
and had seven children. He was high
ly esteemed. Both men were farmers
in good circumstances.

Scarlet Fever Situation Better—Mr.
Stubbs’ Candidacy.
Dublin, Ga., Nov. 26.— Owing to an
Improvement in the scarlet fever sit
uation in the city, the Board of Health
yesterday decided that the public
schools of the city could be resumed
with perfect safety. Immediately fol
lowing the meeting of the Board of
Health, the Board of Education held
a meeting and decided to re-open the
schools next Monday. There is now
only one case of scarlet fever In the
city.
On Friday the Board of Education
will meet for the purpose of electing
an assistant principal to fill the vacan
cy caused by the recent resignation of
Prof. W. R. Lanier. So far thirty
seven applicants have made known the
fact that they desired the position.
The statement which appeared in the
public prints a few days ago front
Atlanta, to the effect that Hon. I. t|.
Stubbs, representative in the Legisla
ture from Laurens county, would run
against Hon. O. B. Stevens for the
office of commissioner of agriculture,
attracted much attention here. Mr.
Stubbs, so far a known, has taken no
one In this cgunty into his confidence.
Absolutely nothing is known here as to
his intentions In regard to making the
race.

Emory College, Oxford, Ga., Nov. 26.
—The Juniors defeated the Freshmen
this afternoon by the score of 22 to 0.
Repeated plunging through the Fresh
men tackles and several brilliant runs
around the ends netted the gains for
the Juniors. The defeated team was
simply outclassed
Dr. Dowman and Prof. Bradley are
both in attendance on the North Geor
gia Conference. The college is in charge
of Dr. Bonnell, during their absence.
The scarlet fever scare has complete
ly subsided and most of the boys who
were exposed to the disease and were
sent home have returned to college.
Every one Is congratulating the facul
ty on the energetic measures which
they took to prevent the spread of the
disease.
OCOSEE’S BAD YOUNG MEX.
Xo Cause for Killing of Mrs. Powell
Hus Been Shown.
Columbia, S. C„ Nov. 26.—From fur
ther reports received, the killing of
Mrs. Rachel Powell, reported last
night, was by a gang of young men re
siding In the wildest part or Oconee
county, 150 miles from here. Six men
have been -arrested, including four
brothers named Hudson. Wesley Pow
ell, husband of the murdered woman,
recognized them when they attacked
the house.
The cause of the attack has not ap
peared. Mrs. Powell was fired upon as
she showed herself in her door and was
killed instantly. No assault was made
upon her husband. The woman was
over 50 years of age.

Atlanta. Nov. 26.—Hugh Thompson,
an employe at the Exposition Cotton
Mills, had his left arm and leg torn
completely off by machinery to-day and
his right leg was almost severed from
his body.
The accident was caused by his being
caught and dragged into a tangle of
pulleys and belts.
