SPEER UPSETS STATE LAWS.

for Failure to Tarn Over Property
to United State* Marshal.
Macon, Ga., Dec. T.—Federal and
•late courts came into sharp conflict
to-day over a receivership. Judge Speer
of the former had demanded that Re
ceiver T. J. Carling, appointed by
Judge Felton of the State Court,
should turn over all property in his
hands as such receiver to the Fnited
States marshal. Limit of time for so
doing was fixed at 10 o’clock to-day.
Mr. Carlings attorney came into court
and asked to be heard on a petition
of revision and review. He was in
stantly asked if Mr. Carling had obey
ed the court s mandate. The reply was
that he had not. Judge Speer imme
diately ordered Mr. Carling’s arrest
for contempt, and further directed that
he be taken and confined in the Jail
at Savannah. Mr. Carling's attorneys
were thunderstruik. They abandoned
further argument and went into con
su.ration in view of the Intimated im
mediate execution of the order. Be
fore they had concluded Judge Speer
announced that the execution would be
delayed ten days. In order that Mr.
Carlings attorneys might have a
chance to go before the United States
Circuit Court of Appeals in New Or
leans .
Mr. Carling is one of the most prom
inent business men in Georgia, and has
national prominence as a Mason and
Knight of Pythias. This is the third
time in ten days that Judge Speer has
overset state laws.
THE WAYCROSS CAMPAIGN.

In the city election is good now for
a clean race. One of the candidates
for Mayor said to-day that, while he
was in the race to win, he expected to
conduct his campaign in such a way
that there would be no need of friends
becoming estranged. The election will
be held on Dec. 13. This is to he a
w hite primary, the first ever held here.
The administration ticket Is headed
by Hon. Arthur M. Knight, who has
been Mayor the past eleven years, with
the exception of one year.
Mr. George R. Tollmans is the can
didate selected by' the Citizens Club.
He is president of the Bank of Way
cross, and has been a resident of Way
cross about sixteen years. The friends
of the two gentlemen are hard at
work in their interests.
In 1884 Dr. F. C. Folks wws Mayor:
1885. Hon. John C. McDonald; 1888,
Hon. L. A. Wilson.lßß7, W. J. Smith;
1888. F. C. Folks; 1889. Dr. A. W. Cars
well; 1890, Dr. A W. Carswell, re
elected. His death occurred in Feb
ruary of that year and George R. You
mans was chosen to fill out the unex
plred term. Owing to a contest he did
not take his seat till Aug. 12 of that
year. In 1891 Hon. A. M. Knight was
elected, and has Been each succeeding
year up to the present with the excep
tion Of 1884.
The total white registered vote Is
*55. The Citizens Club claims a mem
bership of upward of 250. and the
other side a very long list as well.
BERRIEN'S COINTV LINE.

Tlfton, Ga.. Dec. 7.—When Coffee
*nd Irwin counties called in State
Surveyor Wardroper to decide upon
the line between them, Berrien did not
fell herself vitally interested, and
when Mr. Wardroper decided that the
line of Irwin ran to original lot 264
(and that the meaning of the act stop
ping it at 268 was palpably an error,
as proved by the oldest citizens), Ber
rien felt secure in her original line.
But after deciding that the old Cof
fee road, the line in dispute, was lo
cated east of the Wlllacoochee, Mr.
Wardroper then wanted the line be
tween Berrien and Coffee to follow the
Wlllacoochee to the line of Irwin.
This was contrary to the aot defining
the line between the two counties, and
Berrien protested. By agreement, Mr.
Wardroper was not to file the map of
his survey until the Commissioners of
Berrien and Coffee could get together
and endeavor to agree upon a line. By
agreement, they were to meet at Lax
on the first Tuesday in November, and
there Commission Downing went to
represent Berrien, and found no one
to meet him. On his return, he found
a letter from the Commissioners of
Coffee changing the meeting place to
Wlllacoochee.
Before another meeting could be ar
ranged, Mr. Wardroper filed a map of
his survey with the Secretary of State,
and notified the authorities of Ber
rien. This map not only takes the
river as a county line north of the
• ’offee road, but leaves It two lots be
low the line of Irwin, runs two lots
west and then two north, taking from
Berrien county a total of eleven whole
lots and three fractions, giving seven
and the fractions to Coffee, and four
whole lots to Irwin.
The map does not agree with a sin
gle decision made by Mr. Wardroper
during his survey, so far as Berrien
is concerned, and takes from the coun
ty a valuable piece of territory, which
it does not propose to lose without an
effort.
Berrien's only recouroe is to file a
protest before the Secretary of State,
and this will be done wtthin the thir
ty days allowed by law.

the commissary of the James Lumber
Company SI Williams shot Charlie
Pleasant twice, one of the balls enter
ing the calf of his leg:, the other strik
ing him In the knee of the other leg.
Other parties disarmed Sl,whereupon he
tied, going through the residence of
Capt. James, making good his escape.
The shooting was wholly without prov
ocation. Charlie Pleasant asked 81 for
the payment of a debt of 25 cents,
which SI owed him. This lead to a
scuffle, which was all considered in
fun, when 31 pulled his gun with the
above result All parties are negroes.
A CONVICTION AT TALLAHASSEE.

was convicted of murder In the second
degree In the Circuit Court. Jones
lest July shot and killed Joe Hatcher
on the Georgia Pine Railway. They
had a difficulty about Jones' wife.
The grand Jury has found thirteen
true bills.

caught tire yesterday morning and
several pianos belonging to an Atlanta
firm were damaged.
