Mrs. Vashti E. Schofield of Macon
has entered suit against her daughter
in-law, Mrs. Tibbie R. Schofield, ad
ministratrix o£ the estate of her hus
band, alleging that her son, Floyd O.
Schofield, husband of Mrs. Tibbie
Schofield, now deceased, and who was
former administrator for the estate of
his mother, misappropriated funds be
longing to her, allowing them to go
into his own accounts. The suit in
volves a number of shares of railroad
stocks and bank securities.
SHORTER COMMENCEMENT.
The commencement exercises at
Shorter College this year promise to
be the most attractive in many years.
The exercises begin June 5, with the
baccalaureate sermon by Rev. R. J-
Willingham, D. D. Dr. C. O. Jones
of Atlanta has been selected to deliver
the address before the Alumnae Asso
ciation during commencement week.
ANOTHER CHAINGANG CASE.
Milton Harris, a negro, who was sen
tenced in the Recorder's Court at Ma
con March 2S to one hundred and
twenty days in the chaingang or pay
a fine of $75, has appealed the case to
the superior court alleging that he is
illegally detained. The petition claims
there is no ordinance in the city code
authorizing a suspect to be sentanced
to the chaingang.
MAY HAVE BEEN MIRDETt.
The remains of W. E. Reveile, who
was found dead with a pistol ball in
his forehead eight miles south of Eaw
son Sunday morning, were sent to
Sylvester, and at the request of the
coroner’s jury of Terrell county, Dr.
T. J. Bridges of Sylvester, opened the
head of the dead man and took the
bullet from the brain. It was found to
be a 32-caliber ball, corresponding to
Revelle's pistol, but the ball entered
the skull sidewise, and the skin of the
forehead was neither burned nor
smoked, and it is the opinion of Dr.
Bridges that the pistol was several feet
from Reveile when fired.

WAS TOO INVESTIGATIVE.

Cook, colored, 12 years of age, looked
into the barrel of an old and discard
ed pistol this forenoon and this after
noon the undertaker had him in
charge. The boy was shot in the
right side, death occurring within less
than an hour after the ball had passed
into his body.
GARCIA FACTORY BIRNED.
The big Garcia factory at Port Tatn
pa City was totally destroyed Tuesday
afternoon by fire. The loss is estimat
ed at $50,000. The building and con
tents were partially insured. It is
not known how the fire originated, but
if Is presurhed that it caught from a
lighted cigar which had been thrown
in a trash pile in one side of the
building.
BODIES NOT FOUND.
Pensacola Journal: Although vigi
lant watch was kept by all persons
along the bay front during yesterday,
no trace was found of the bodies of
the two men who were supposed to
have been drowned early yesterday
morning by the capsizing of a skiff in
the bay. The man Miller, who was
with the two men, one of them boat
swain of the steamer Roddam and the
other a lighterman, is certain that
both were drowned, as they were in
a very intoxicated condition. It is the
general opinion that the bodies of the
two men will rise in a few days, and
that the tide will carry them ashore.
7 YEARS IN PRISON FOR
MURDER HE DID NOT DO.
Tardy Justice Came to Ncuro by a
Death Bed Confession.
Columbia, 9. C., March 31.—Ander
son, Nix, a negro who has served seven
years of a life sentence in the peni
tentiary for a crime he never com
mitted, has just been released as the
result of a death-bed confession by the
leal culprit. It is one of the few in
stances where justice was duped by
those who allowed an innocent man to
bear the hard fruits of another’s deed.
The story of the confession whereby
Nix is relieved of all connection with
the murder of Jennings Green, another
negro, committed more than seven
years ago, in Barnwell, reveals the
conscience of five or six white men
and a negro who have been aware
that Nix was not the murderer of
Green. For seven years they preserved
a strict silence, and it was not until
now that the truth of the affair has
come to light. The circumstances
were told by Duncan Owens, former
ly the town marshal of Barnwell, when
he realized that he was going out of
the world with a wrong undone. His
story was this: A negro excursion
train had come to town and a difficul
ty arose on the public square of Barn
well. When the shooting began the
town marshal hurried toward the spot.
As he reached the scene he met Jen
nings Green, the murdered man. As
he ran past Marshal Owens the lat
ter fired and the negro fell, dying al
most instantly. Owens kept quiet as
to what he had done, as did the other
witnesses of the deed. Nix had been
seen running from the spot, turning
and firing as he fled. He was sus
pected of having fired the shot that
killed Green; was arrested, tried and
sentenced to life Imprisonment in the
penitentiary, barely escaping the gal
lows.
All this was revealed by the town
marshal to a negro who had been his
deputy, and to whom alone was con
fided the confession. Since that time,
three years ago, the secret has been
kept by the negro and by those
who, while not present at the
confession, were aware of the cir
cumstances of Green’s death. Lately
the facts have leaked out and came
to the ear of the Governor, who was
prompt to exercise the pardoning
power. Nix is out of the penitentiary,
a free man, after having resigned him
self to the fate of never leaving its
"alls again in life. In view, however,
of Nix having been seen to Are into
the mass of negroes on the square at
the time of the affray, there is yet
an element of justice in his seven-
J'ears’ imprisonment. It is only that
he was punished for the wrong crime,
hnd insomuch his hard experience
has been also an unusual one.

WANTS REDUCTION
IN ROYALTY.
Beaufort's Appeal to the South Car
olina Phosphate Comniissiou.
Beaufort, S. C., March 31. —The Board
of Trade held a meeting at the Com
mercial Club rooms last night, and
measures were taken to present an
other proposition to the State Phos
phate Commission in regard to the
Central Mining Company, located on
Ladies Island. The company claims
that if the royalty of 25 cents on every
ton is not reduced it will have to go
out of business.
The royalty last year amounted to
SB,OOO, and the company recently asked
to have it. reduced to 60 per cent.,
which would mean a loss to the state
of $4,800 on the basis of last year's out
put. The company pays each year
$70,000 for wages and supplies, a great
deal of which is spent in Beaufort, be
sides the royalty and S7OO ih taxes.
The plant cost $106,000. Thus it is
considered Injurious to the town and
county to compel the abandonment of
the property, with the accompanying
loss of the revenue it brings to the
state for the sake of the difference of
$4,800 In royalties. An early confer
ence with the commissioners it is ex
pected will result in a favorable con
sideration of the reduction.

31. —Every preparation has now been
completed for the second annual de
bate between Emory College and Trin
ity College of Durham, N. C., which
will take place' in the college audi
torium here April 2.
The question which will be debated
is, “Resolved, That it would be for
the best interests of the people of the
United States to substitute a .tariff
for revenue only for the present high
protective tariff.’’ Emory’s representa
tives, Roberts S. Parker of Atlanta
and Harry S. Strozier of Mcßae will
champion the negative side of the ques
tion, while the Trinity men, L. P.
Howard of Alabama and J. P. Friz
zelle of North Carolina will have the
affirmative side to uphold.
The judges will be Hon. Clark How
ell of Atlanta, President Henry N.
Snyder of Wofford College, South Car
olina, and Chancellor Walter B. Hill
of the University of Georgia.
Bartow'* Municipal Flection.
Bartow, Fla., March 31.—Hon. C. E.
Bayley, Mayor, has called a mass meet
ing of the voters of Bartow, for April
19, to nominate a candidate for Mayor,
to be voted for at the city election, in
May. The most prominent name men
tioned so far is that of C. H. Walker.
He is at present a member of the City
Council, and is chairman of the Young
Men’s Democratic Club of Polk county.

ESCAPED CONVICTS NEARLY DIED.

Fleming and Keeper Conyers of Way
cross were here yesterday afternoon,
the keeper having in charge two long
term convicts, Lige Gary and Lee
Smith, who escaped from Way cross*
camps. The convicts went toward the.’
Okeffenokee swamp and were caught
by a young man named Williams, who
found them in the swamp nearly
frozen and starved. He recognized
them and telegraphed the officers from
Fargo. One other negro, Henry
Smith, escaped at the same time and-

nigs to-day stated that he would write
the governors and boards of trade of
the Southern States to send delegates
to a convention to be held at Tampa
during the spring festival, which be
gins May 2, for the purpose of discuss

how best to develop them.
