WINDING UP THE SALE
OF THE B. & B.
The Property to Be Tnrneil Over
to the A. A B. in a Pew Day*.
Brunswick, Ga., Aug. 11. —In the Su
perior Court yesterday the only mat
ter handled was that confirming the
6ale of the Brunswick and Birming
ham Railroad, its franchise. etc.,
■which took place Tuesday.
There was considerable argument by
the attorneys, and the matter occu
pied the entire day in the court Ob
jections were made to the confirma
tion of the sale, as to the distribu
tion of funds, and it was late in the
afternoon before the sale was finally
confirmed.
The decree of the court was rather
a lengthy legal document, which Is
not of much interest to outside read
ers. A bond was required of the pur
chaser, etc., and the last section of the
decree says:
"It is ordered and decreed that the
purchaser, or his successor or as
signs, be required to furnish bond in
the sum of S3O, conditioned for the
payment of such costs and claims as
the court may adjudge to be properly
payable out of the funds Judgment
upon which bond may be entitled as
in cases of appeal,”
A decree in the equitable petition
was also issued by the court, fixing
the amount to be paid attending the
sale of the road. This order in full
is as follows:
The funds are to be distributed as
follows: Payment of expenses of sale,
$308.20; compensation of commissioner,
$300; costs of suit; compensation of
receiver for services. $1,200; receivers
services and counsel fees. $2,691.60;
Knickerbocker Trust Company for its
services, etc., $10,745; payment of re
ceiver’s certificates amounting to $6,-
000. with interest at 6 per cent, per
annum interest. $60,675.15.
The further distribution of the bal
ance of the proceeds of sale is reserv
ed for the future order and direction
of the court.
With the confirmation the sale of
the road is practically brought to an
end and the property will be turned
over to the Atlantic and Birmingham
within a few davs. Of course there
is still considerable litigation pending
against the Brunswick and Birming
ham and it will all be settled prob
ably at the next term of the Superior
Court.

seriously hurt, while en route to Ben
nettpville, where they expected to play
ball this afternoon.
The players were riding on top of
Ihe caboose of an accommodation train
on the Atlantic Coast Line. When,
between the stations of Robbins and
Lumber, the caboose jumped the track
and turned over.
William McLean of £heraw, was the
most seriously hurt. His ankle and
thigh were broken, lower bowels torn,
and a severe contusion over the eye.
J. Whit. Wilcox of Darlington had
his leg dislocated at the hip.
Fred Stem of Darlington, shoulder
dislocated and face bruised.
H. E. Rowe of Hickory, N. C., a
medical student, administered mor
phine to relieve the sufferings of the
injured, while they were being carried
to Bennettsville for medical treatment.
