HENRY CATO SENTENCED TO
DEATH BY JUDOE HAMMOND,

Yesterday morning when Judge Hammond
ascended tbe bench ol DeKalb superior court,
the juiy in the Henry Cato case was in the
box. It waa at once evident to tbe crowd that
a verdict bad been reached and public anxiety
waa on Up toe to know wbat that verdict
would be. It bad been hinted upon the out
side that the verdict had been reached, and
that it would be guilty with a recommenda
tion to imprisonment (or life,
Judge Hammond asked the jury If it had
agreed upon a verdict. The foreman, Mr.
Frank I,. Guess, replied in the afllrmativc.
Solicitor-General Hill received the vardict
and published it aa follows:
“We, tbe jury, find the prisoner guilty, aa
charged In the indictment.'’
Henry Cato, the prisoner, was sitting In
tbe rear of his counsel, and accompanied by
his devoted wife. He <-y e d tbe jury with a
curious sort of look. The sounding of the
verdict scented to m >ke no impression upon
him. He really seemed not In realise that
the finding meant the forfeiture of bis life.
When hia attorney aaid to him, "Henry.what
do you say now?" ho replied:
"Well, Mister Candler, 1 wants you ter
saraherar' dis case.”
His idea was that the entire matter waa to
no certain purpose and that a higher court
would reverse tne whole maler.
It drew an immense crowd to Decatur, and
the above facts wtM given to Tbs Cobstitu-
tion reporter by gentlemen sUU living who
were present at the hanging.
Tbe second case was the execuUon of a
negro by the name of Henry Jackson, a slave
of Wm. Jackson. He caught a young white
girl on tbe road from Atlanta to Di
attempted to outrage her.

Tbe third case waa that of a negro named
Jim. He belonged to a notorious negro trader
named William Graham, who lived at Stone
Mountain. Graham was a hard dealer and a
most onerous master. He was a blind man
and had a|"fldus achates'' in the person of a
negro boy named 8teve. Jim, the criminal,
was one of Graham's slaves but ban boug >t
bis own time He got behind in bis pay
ments and was ordered home. He feared
the wrath uf bis master. He therefore,
walked from Atlanta to Stone
mountain after dark, opened n window

He was tried, convicted and bung. This was
in 1858 and the last itsnging known to tbe

When Mr. Crittenden, of Randolph, yesterday
urged Iho house to pass some mrasurc to more sat

for the state Mr. Favne, of Catoo-a. prepared a sub
atltute which wan yesterday agreed to In lieu of the

majority.

tality. The tendency among the negroes of
tbe county waa toward violence and the as
sumption In themselves of tbe function! of
tbe law. Hence the finding of the jury met
with general approval.
Jude Hammond, this being the first in
stance aince his accession to Uie bench when
a sentence of death became necessary, apoke

stand this, but your people ought to be thor
oughly impressed with Ibis idea of tbe law.
A man cannot cut or ahoot bis fellow-man, or
take away human life In any form, unleaa he
lias a good reason to do so—unless nine one
is trying to take hia lift, and when this Idea
comes to be fully understood by tbe colored
peojfle we will have fewer of tbsae offenses.

them mod by cursing or abusing them, or
when he makes an aasuslt upon them with

Such la not the law and In all such
cases, If tha Jury does its duty and death is
tbe extreme peualty, the result will be that
they will be oonvicted as you have been. I
have said this much that these colored peoplo
here, who have attended and witnessed this
trial, may be induced hereafter to be more
careful in their couduct and not draw and uae,
flippantly and recklessly, deadly weapons
againat othrr persons.

Judge Hammond delivered the sentence in
touts that showed fau feeling and sympathy.

Tears coursed down his rugged cheeks. His
wife endeavored in vain to comfort him. The
awful fact that tbe dev of his death bad been

of bis friends called and expressed their sym

and her tears were mingled with his over tbe

Colonel M. A. Candler, tbe counsel for the
prisoner, thinks he will take the case lo tbe
supreme court, lie has not yet scanned tbe
