Saturrdftjr State Treasurer Speer informed a Con
stitution reporter of a most Important decision
thathohad reached in reipect of the future pay*
ment of <he principal aud interest of the larger
portion of the outstanding bonds of the state of
Georgia. Nearly all the bonds of the stato havo
been issued under acts of the general
assembly in which
pressly stipulated that tho principal and interest of
said bonds should be made payable in tho city of
New York, that being tho financial center of the
country and tho market in which the great bulk of
tho bonds wera expected to bo and were actually
sold. The holders of the bonds have taken them
with this express stipulation dearly engraven upon
their face and with the expectation of always
finding the funds ready in New York
to make good this specific promise of the state.
FORMER CUSTOM,
it seems baa been for tho state treasurers to either
go in person with tho funds to New York, or send
them to somo such personally appointed fiscal
agent as tho Park or Chemical bank, and there re*
celve tho bonds and coupons, and pay the princi
pal of and Interest upon the same. But Utterly,
and especially sinco tho advent of Governor
McDaniel, Treasurer Speer has had doubts about
the legality and policy of this assumption of author
ity. IIo finally determined to submit tho matter to

thoroughly considered all tho law bearing upon the
conduct of the state treasurer, his liability and dis
cretion, and tho statutes affecting in any $wi*
the liquidation of the Interest and principal of the
public debt There is a law requiring state sur
plus funds to be deposited in certain designated
banks in named cities of Georgia, but there could
nowhere be found any shadow of authority for tho
treasurer making a deposit ot stato funds in any
bank in New York or elsewhere outsido
stato of Georgia. This presented
most perplexing dilemma and tho
question ot a suitable remedy was thereupon taken
under consideration.
AM ENABLING ACT.
Since the absence of any law authorizing tho do-
posit of funds in New York to moet tho demands
made presentable there by law and by tho wording
of tbe bonds placed tho entire risk and rosponslbll-
ty of such deposit upon tho treasurer, it was sug
gested by Governor McDaniel that
lhe legislature should be asked to pass
an enabling act to meet tho necessities ot tho case.
Accordingly a bill was prepared authorizing the
treasurer, with tho approved of tbo governor, to
designate some suitable and solvent bank in tho
city of Now York as a depository of state moneys,
upon certain conditions to bo imposed upon tbo
bank accepting tho office and trust. This
bill waa introduced into tho gcncrnl
assembly, but it was doomed to untimely
death at the bauds of the eminent economists and
solonsof that body. It failed to become a law and
tho legislature adjou
any provision for these

woman called on Policeman Street to go to
her bouse, stating there was a disturbance

who bad been concealed, crept up behind tbe

Columbus, October 8.—On Friday night tbe

Smith Austin was the victim, and his throat
was cut from car to ear. A negro named Jim
Pope waa arrested for the, crime, snd after a
preliminary hearing was committed to jail.
Homo time later another negro named Hill
Jones was arrested on a charge of stealing and
put In Jail. It seem- that for some days past
the two negroes have been quarreling, and
yesterday they made a full confession of the
killing of the hackntau. They say that two
white men hired them to do the deed. Jim
X’ope says they gave them $50 and a silver

Alcusta, October 8.—A report was rcccivod
In Augusta to-day of a desperate affray in Co
lumbia county, about flftcen miles from this
city, Saturday. A crowd of negroes gathered
on the OrlAln place, enjoying a dance, when a
negro unknown to the party appeared on the
seme, and soon raised a row. During the
light which ensued, the stranger struc k an
other negro In the head with a pick-ax' kill
ing him instantly. Other negroes then rush-
ed on tlio stranger and backed blm in a fear

county since the war, tbe other being that of
Miae White and two negroes, who were bang
