Iu Spartanburg, the case against Tom Aber
nathy. for killing his fkther, resulted in a ver
dict of not guilty. The seventh of last Janu
ary, Wilson Abernathy and his two sons, Tom
and Rufus aged rvepecivetly twenty-one and
twelve, were in town. The father and Tom
were somewhat intoxicated. Oa reaching
their home, about four udlei from town,
Kuftis went Into the house and took a
seat by the fire, it being a cold day. The
father followed and kicked him out of the way.
The mother, who was in bed with a very
young infant, remonstrated and begged him
ltd to hurt the little boy, as ho was cold and
unwell. Ho thru drew a chair aud went to
the bed nml tlmatrucd to kill her, using very
strnrg language. Jo*t then Tom came »u and
remonstrated with his father, and begged him
to Jet hi* mother alone. Tho father asked if
he was taking the matter up, aud the son re
plied that he was not, hut he du! not wiih him
to abuse his mother. The father then mvlo
for the sou and they clinched, and the eon cut
the fkther four or five times. The father raado
the attack with his knife. He lived until tho
next day, when he died. The killing was
dearly iu eelf-defcnse. The jury was out ouly
a few minutes.

was killed accidentally In the scufllj with his

RESCUED SEAMEN.
New York, March 2ft.—-Bark Scott’s Boy
which arrived today from Lisbon, brought
Captain Williams aud the second mate of the
schooner Marcus A. Davis, from Fernandloo,
to Philadelphia, waterlogged and abandoned.
1 he first mate Steward and two seamen had
died from exposure the night previous to tho
rescue of the captain and second mate, March
24. The £ca waa very heavy and the rescue
was difficult and dangerous. The survivors
were almost exhausted. They were
not able to walk and had to
l*e hoisted on board of the bark. They had
been lashed for 13 hours on tho top of the af-
terbonso, without food or water. Their cloth
ing was torn to rags. Captain Williams said
bis vessel had a hard heavy southwest and
northwest gale, in which she became leaky
and drifted off* shore. On March 22d aho cap
sized during a squall and filled. The fore and
D>ain mast were cut away, and in falling car
ried away tho muzen mast. Tho vssiel then
righted.

houso occupied by Matthew Masslck, at Lud-

The main witness against Cochran was a young
man named Martin, who was captured in the still,
and is now servieg a four months' sentence. At
the hearing last evening Martin swore that Ceoh-
ran had told the men interested Iu the still that if
they went ahead with the work he would stand
between them and the law. lie also testified to
having seen Cochran at the still upon several dif
ferent occasions. Four or fivo other witnessea
w ere examined, but the chief characteristic of
their testimony was the facility with which thoy
forgot all the clmrinstances of their connection
with the distillery. Their memories were *0 con
veniently forgetful that Commissioner Haight de
termined to give them an opportunity to collect
their thoughts, and the further hearing of tho case
was postponed until 9 o'clock Monday morning.

ing clay, yesterday, from a grinding machine in
the fire brick manufactory of Anness Jt Lyle, the
