has successfully eluded a subpena. This
witness Is James C. Smith, brother of
Mrs. Htnnford White, widow of the
man killed by Thaw.
Smith la In Paris, where he has t>een

Is no way by which he can be com-
ltolled to return, and his testimony will

Three Alienists Arrivs.
Three alienists for the defense have
arrived from Pittsburg. They are: l>r.

ent of the Pennsylvania state hospital
for the insane; Dr. C. F. Bingham, for
twelve years the Thaw famtly'e physi
cian. and Henry A. Hutchinson, super
intendent of the hospital for the Insane

the connection of Clifford W. Hart-
ridge with the trial of Harry Thaw, In
New York, Pavannah people are par
ticularly Interested In the rase. Mr.
Ilarirblgc In a former resident of Sa
vannah. He ban brothers, sisters and

weeks ngn he was here on a visit to
his brother, Hon. Walter C. Hartrldge.

The w itness was hot cross-examined.
The third witness, Mayer Cohen, waa
also questioned by Mr. Garvan. He
told of seeing Thaw on the roof gar
den the night of the tragedy. There
apiteared to be a man with Thaw,
if. Tell what Thaw did after you
saw him. A. He. walked forward,
was just saying to a friend of mine.
"There'H your friend." when I heard
three shots. Thaw had turned around
and his bock was toward us. I saw
him hold up the revolver und the next
moment the flreman grabbed his arm
and took the weapon away.
