When Lawyer Dolphin Delmaa en
tered court today he hod a maaa of
authorities to ohow that the affidavit
may be mode by Evelyn Neshit against
Harry Thaw tn "Abo" Hummel's office
should not be admitted-, as evidence.
This affidavit which accuses Thaw of
beating her and otherwise attempting

manta against Stanford White, la con
ceded to be one of the most danger
ous bits of ovldonco agnlnst the slay,
er of the great architect.
The defense was prepared to fight
all day to keep the contents of that
affidavit off the records and away from
the Jury. With tha other lawyer*. Mr.
Delmaa had remained up nearly all
night In hla search of legal authorities
for precedents to sustain his conten
tlon.
Mr. I admits contends that the ev|.
denes Is not admissible In rebuttal and
should have been put In direct esaml-
natlon. In the second Instance ths
defense will contend that Hummel has
no right to vlolnte the confidence of a
client, although he be dead, In submit
ting the affidavit.
The complete control In which Dis
trict Attorney Jffume holds "Abe"
Hummel was Indicated today by Ule
promptness with which the former ten
derloin lawyer appeared for further eg-
amlnatlan.
Affidavit Exonerates Whits.
Hummel Is under conviction for a
felony for Ills connection with the
Dodge-Morse divorce case, and the dis
trict attorney can eend him to Jail at
his pleasure. It is asserted. The law
yer has told his friends that he would
rather be testifying In the Thaw case
than working In the brush factory at
Sing King
The affidavit which Jerome wanted
to present to the Jury makes the most
serious kind of charges against Thaw
and completely exonerates White
ever having mistreated her. This doc
ument was written six months subse
usnt In the lime when Evelyn Nesblt
.'haw swore on the stand that she con
fessed her shame to Thaw In Paris,
and made the accusations that WIUlu
had drugged her.

Hell Is as necessary to establish
spiritual kingdom In the heart of
man or around the throne of heaven
as punishment Is to 'establish a king
>ng men considered merely ae
an animal. What is the need of n Ha
vlor If you are not to ho aavod from
something? That something Is hell.
Now, the Savior and the thing aaved
from are co-equal In their nature and
duration, anil, remember, t’hrlst la God
incarnate. Preaching a Savior with
nothing of equal importance to be
saved from makrh preaching a business
simply. Don't ynu get your authority
from the same place for a heaven and
hell? Who can ere the sadness of this
earth and not believe It foreshadows.
figuratively speaking, the worm that
never dies and the (Ire that la not
quenrhrd? The only way to hnve
heaven on earth or In the heart ia by
heltevlng there Is a hell. Short aer

rajlty In high places are going tojnl
low- on the heels nf this no hell bual
ness. I«eave not hell and honor and
virtue drift Into morality almply. What
Is morality? It Is the clothes and
not the man. No man who has not had
the horrors of a possible eternal es
trangement from God hang, over him
has ever been made "to lie down In
green pastures or walk beside the still
water, or communed with the Eternal
as He I*. Preaching t'hrlat without a
hell Is like a fellow trying to carry
water In a bucket with the bottom
knocked out—Just about as much good

It Is unpopular lo preach hell! Well,
