Rev. C. B. Wilmer, J. D. Cleaton, E. Marvin Underwood* Dr. R. THE UNWRITTEN LA W 1 8 Ti ls ; tv. By C. B. WILMER 8 THERE an ''unw rjtten law?” There bound to be. or else there tvould be no morel sanction to the writ ten law. What la the written law? Only whnt legislatures agree upon. But I. what legislature, agree upon nec essarily right? Right! There we hit upon the .baial idea. If ft thing la right It la right no matter whnt legis latures any. If a thing is wrong. It te wrong, no matter what legislatures any. Huppoae the United States congress should pass a law to the effect thnt It was right for one man to hate and In jure another. Buppo.o the whole hu man race should, In "tfte parliament of man. the federation of the world.” ngree that twice two was live and that a lie was the truth, br should under take to repeal the attraction of gravi tation, or to change some of the char- arterlatlcg of electricity. Everybody see. at once, when tve are dealing with mathematical or physical truth, that the' "unwritten law" le not only exist ent but supreme. The same Is true of the morel law. It exists. It I* for man's moral and spiritual well-being what other laws are for his physical and mental being. The end and aim of all written law l». or ehould be. to iliac-over und enact the inherent right In all tilings. Text books on phyaica should write down for the Information and guidance of people the true op eration of nature's forces. What a man want, to know who Is trying to get Hie telephone In your house to working right is. not what the legis lature ut Georgia thinks about elec tricity. but what la true and would be true If there were no legislature In Georgia, or if the whole world ehould legislate the other way. The whole bu.lnesa of the legislature of Georgia, or : of any other state, Is to And out the true relations of man to man, in civil society, and to enact-these Into stat utes. In the etrlct sense of the worda, as the late Judge Bleckley waa fond of pointing out. no one can "make laws" at all; we can only put on the atatuto book tvhat we think the law la; but we may be, and often are, mistaken. The moral obligation to obey the laws of the state—and there Is auclt an obligation—la Itself an unwritten law. Suppose there were no auch obliga tion, could the state create It? Tlib state has to assume tills obligation and appeal to ami enforce It. But the law of moral obligation exists before the in*’prayer aiul aernion. No man may rightly be called oil to disobey the law of right. Men may cavil over this as much os they like.. They may seek to sidetrack the matter by ask ing who Js to be the Judge of what Is right, and all that. Tho truth re mains that while one may be mistaken. In any particular cose, as to what la right, we can not be mistaken in the principle of the supremacy' of tho un written law of right. Rellglouely ex pressed, this Is “Render unto Caesar th* things which are Caesar’s, but unto God those things which are God's.” Obey tho state within Its rightful Ju risdiction; but do not sell your soul, do not throw away your manhood for the sake ot a statute which one sot of meh has printed In a book and which the next gathering may wipe out. I am qulto willing to bo held responsible for these principles, but not for what you may think Is a legitimate and logicst application of them. More over. I will give what I think—Just what I think—the application Is In the matter referred to. Here. then, la n law upon the statute books which says that a tnan who kills another under certain circumstances commits murder. The law enumerates certain things which Justify killing another and pre vent that killing front being murder; self-defense, for example. . It does not Include within this list one of the ex cuses which waa urged In tho notorious Now York trial. A Jury Is Impaneled and takes oath to administer the writ ten law—not tho unwritten law. Now, the appeal la ignfle to a supposed Vun- wrltten law,” vl*., that a man haa both the right and the duty of shooting down tho man who Invades the sanctity of his home. Ought the Jury In such case, in the name of the "unwritten law.” to acquit the prisoner? I have admitted that there Is n higher law titan the written, from which the written Itself derives Its binding moral fqrce. Whnt Is the true analysis of the case under consideration? In the flrst place, the jurors have taken an oath to enforce the law as It Is on the statute books. >t Is plain, then, that the higher law de mands that they'must preserve their oaths Inviolate. No sophistry can get around this. It is the business of an honest man who really believes that there Is' a higher law wblch makes tha law of the state wrong, frankly to tell the Judge, before he gets on the jury, that he Is not going to enforce the law oa the Judge gives it to him. If he does not do this, he I* not only a rebel against the authority of the state, but he Is a perjured liar to boot. Of such it can only be said: "His honor rooted In dishonor stool, And faith unfaithful kept him falsely true.” SATURDAY. AI'fGL 13. 1397. April Showers Says the Old Adage, Bring May Flowers. Box 266 Bwoooooooooooouooooooooooooooooooooooopooooxxxioooooooopiuresinnn mum It Is quite possible. In Itself, that tho law ot the state may be wrong: but that Is not the point hero. If a man thinks It is wrong lie can not, as an honest man, swear that he will obey It That is the flrst and most elementary application of tho higher or unwritten law—a kindergarten lesson In truth fulness. Another consequence follows from tho supposition that the law of the etato Is wrong In this particular—that ts, In not allowing a certain plea ot defense as valid. That consequence Is just as obvious and Irrefutable as the other, and It la thla: It the law ot tho state Is wrong, It ought to be made right. If It Is right, according to the Eternal Law of Right, for a man to take the matter of punishment Into his own hands and to visit death upon the offender, then let the statutes of the state so declare. It Is the business of th* state to enact the unwritten law, so far as that comes within the proper domain of the stats. Let the law state that under such and such circum stances a man shall have the right and duty to kill another, but let no man be permitted to wrest Justice from the state. . No state can. wttltout committing suicide, permit an individual to take the law Into his own hands. The ap- G al which la made tq our fcellngi on halt of some particular offender, Is the appeal which hoi been made all along the line of progress and tried to block It. The growth of civilisation has been along the line of substituting public justice for private revenge. The present state of things Is intolerable. The law should be enforced or changed. Any other road leads to anarchy. MONDAY, APRIL IS MATINEE AND NIGHT MYRON B. RICE OFFERS The much-talked-of Fanciful Fairyesque, THE GINGERBREAD MAN Book and Lyrics by Frederic Ranken Music by A.
