CITY AFTER CASE Say Judge Broyles’ Ruling Would Stop All Work. Declaring that two of ita employees havo been arrested and fined In the recorder's court on charges of working without license and not having stood the plumbers’ exam ination, and that its other employees aro refusing, to work for fear of arrest, the Farrell Heating and Plumbing Company Thursday secured from Judge Pendleton an Injunction restraining the city of Atlanta ??f'c ear his ui uie utu ua oaiuruaj. ua; 10. The plaintiff charges that Its two em ployees were arrested on May 14, the charges being based on a city ordinance which says that no person shall work at tho plumbing business unless be has quail tied as a master plumber, baa taken out a license and has stood the examination be fore the board of plumber examiners. It Is charged that Recorder BroyIes.*ln flulng the defendants, has misinterpreted the ordi nance, and that It la sufficient for the man ager or operator of a plumbing establish ment to have qualified aa a master plumber and to hare taken out license. The plaintiff charges further that If the law la Interpreted literally It wt%dd be construed as a violation of law for an untrained teamster to haul lead pipe to the •cene of repairing, or for a helper to shov el coal under a small furnace unless he had taken out license and had stood the examination. The plaintiff further charges that Its business has been dninnged to the extent of 1600, for which Judgment Is asked. The petition was filed through Attorneys JAS. Vose, all of Evanston, were present. 6 FIREMEN BURNED BY BACK DRAUGHT New York. May 18.—Six firemen were badly burned about the hand* and face and two are in the hospital as the result of a fire which destroyed the Standard Oil tank barge at the White Star line today. C„ May 16.—In general aesslon. court hero yesterday. Judge Gage sent three witnesses In a gamb ling case to Jail on a charge of per jury. One of the witnesses has since been balled out, but the- others are still in custody. Grand Juryman Relcher was excused from the grand Jury, and the Judge dismissed him. Other Jurymen pre ferred charges of gambling against him. The action of the Jury In asking for Belcher's release from duty creat ed something of a sensation. ROOSEVELT AGAIN AT BOISE, IDAHO Attorneys Have Lively Tilt Over the President’s Connection. Boise, Idaho, May 16.—While Sena tor Borah was questioning William McGuffle, a talesman, yesterday after noon, he asked the Juror If he would give credence to Orchard's testimony. Clarence 8. Harrow, of the defense, objected to the question. "We did not aik as to the effect of Orchard's testi mony," said Harrow and Richardson together. "If Roosevelt Is to be brought here to testify, we might have some thing mors to say," went on Richard son. Judge Woods directed counsel to pro ceed with the case, but Darrow took format exception to the remarks of Borah. "I will eliminate Roosevelt If you will," replied Borah. ATTEMPT TO MURDER WOULD BE THE LIMIT According to a view of tho case taken by Solicitor Hill, of the auperlor court, Fred Bush cannot be Indicted for mur der on the charge of sending an In fernal machine to ’ the home of Mrs. Julia McCarthy. The act of 1897, which makes It a capital offense for a person to place dynamite or other explosive In or under a house for the purpoee of blowing It up, gave rise to the question whether Buah might not he indicted for mur der under that act. Solicitor Hill stated the act in question refers only to the placing of dynamite under a dwelling house with the Intention of destroying It, and does not apply to yne who sends an Internal machine another. "In that case,” spld the solicitor, the attempt proves successful and the party Is killed by the explosion of the machine, the party sending It may be Indicted and punished for murder; but It the machine falls to kill, then It Is nothing more than assault with intent to murder."
