der cane that has been tried by the
United States court In this district for

gun yesterday, when Thomas Battle
was arraigned and plead not guilty on
the charge of murdering D. M. Berry.
In the trial yesterday Battle was rap.
resented by John R. Cooper, and tht
government by the assistant district st

The principal business of the session
was the^ securing of the Jury, and the
arguing ’of ths motion that the csss be
continued because the witnesses for
the defense had not been summoned,
and the arguing of a demurrer. Both
Attorney Cooper's motions for a con
tinuance and his dsmurrer wort over
ruled.
Attorney Cooper stated that most of
the witnesses would be used to show
the good charsctsr Of the defendant,
but that flvs or sis will be used for the
purpose of Impeaching, If possible, ths
testimony of H. J. Hunt, the principal
witness for the United States.

lo the arrest of V. H. May-Held, the
white driver of Emory- Wlnshlp’a auto,
and a negro named Tyson, lining given
a summons to appear In court, both
charged with that speeding.
Mayfleld was arrested at the garage
and ridden to the city barracks In the
"hurry up" wagon. The officer handed
a summons over to the negro, who has
been before ths recorder ones before,
charred with violating the speed limit.

The two literary societies of Mercer,

selected two representatives *to contest
for ths medal, which Is swarded by
Colonel Hardeman, of Commsrcs, Ga.
Ths four debaters In yesterday's exer
cises were: W. R. Summer, of Sum
mer. Ga; Ralph Bailey, of Savannah,
Ga; W. J. Mllllcan, of Carrollton, Ga.,

Mrs. Msttis Ard Dead.

Macon, Ga.. Juno 4.—After an Illness
of mors than six weska, Mrs Mattie
Ard. aged 31 years, died at her home
on Jackson street yesterday. Mrs. Ard
was the wife of R. A. Ard snd Is sur
vived by one small child, Reuben. She
was a devoted member of the Second
Street Methodist church, and was well
known In Macon.

mencement exercises of Gordon Instl
tute have been highly successful. The
year Just drawing to a close has been
one of great achievement for the school,
and President B. F, Plckette and his
able corps of teachers have labored
faithfully, ss the merit of the exercises
which mmSt the close of the scholastic
year Indicate.
The flrat of the series of entertain
ments for the week occurred Friday
night and was an unbounded success.
It was the piano recital given by Mieses
Annie Kate Smith, Nell Adams and
Minnie Tyler.

department gave a delightful entertain
menL presenting "Cinderella" to t
large and enthusiastic audience. The
main feature of Sunday’s program was
the sermons by Bishop Candler, morn
ing snd evening- The sermon In the
morning was heard by a lurge congre
gation. Bishop Candler Is much liked
by the people of Barnesvlllo.
Monday morning the contest In origi
nal speaking was held.
Monday night was rendered the sen
lor play, being a dramatisation of one
of Tennyson's Idylls to the King, Elaine
and Guinevere. The event was one of
ths mott delightful social events of the
week and was a great success.

but was abandoned.

on an average of 35 per month Increase
over last year. Indications are that
greater work will be accomplished dur
ing the next two terms, as Superin
tendent Robeson will be serving his
second term, and will have everything

William H. Barnes, formerly of At
lanta, and prominent many years ago In
Georgia Odd Fellowship, wilt be the
guest Tuesday night of Atlanta Odd
Fellows, and will deliver an address In
the I. O. O. F. hall, at Broad and Ala
bama streets.
Mr. Barnes Is now a resident of Cali
fornia anti Is grand scribe of the Cali
fornia encampment. He Is a veteran
editor of secret order Journals and one
of the best-known Odd Fellows In the
country. Mr. Barnes was grand master
of Georgia In 1882, and In 1885 he went
from Atlanta to the sovereign grand
lodge, which convened In Baltimore.
