stockholder In the Georgia Redemption
and Loan Company. Saturday filed In
superior court an amendment to his
suit against the company, asking that
M. M. Turner, the secretary and treas
urer of the concern, be made a party
defendant and that he be enjoined from
disposing of any property In his posses
sion until the further order of the court.
In response to the petition, Judge
Pendleton laeued an order summoning
tha defendant to appear In court on
December 14 to show cause why thb
petition should not be granted and
temporarily enjoined him from disturb
ing In any manner the sfatus of any
session.
The original petition of Mr. Marbut
end other stockholders wee filed
Bgalntt the Georgia Redemption and
Loan Company. Eugene R. Black was
appointed temporary receiver, and later
John McClelland was permanently ap
pointed to take charre of the company's
effects. ' i •
In hie second petition Mr. Marbut
alleges that when Receiver Black de
manded the aeeete of the company he
received nothing hut some offtco fur
niture. He now seeks to hold Mr. Tur
ner, the secretary and treasurer, per
sonally responslbla for tha Indebted
ness of the company.
Mr. Marbut alleges that he .owned
live shares of stock In the company.
He chargee that for every payment
made on his contract and the contract
ot others, 60 cents was to be paid Into
the reserve fund, 60 cents to the re
demption fund and 26 cents to the ex
pense fund of the company. He alleges
that none of thla money was ever paid
Into tha company, hut that the secre
tary and treasurer appropriated It to
hla own use.

lanta, has been appointed superintend-
ent of the Knoxville division of the
Southern, the appointment to take ef
fect on December 1.
In order to nil the vacancy by Mr.
Deuel's promotion, O. A. Brndley, now
trainmaster on tho Atlanta and Hlrm-
Ingham division, has been appointed
superintendent of terminals.
These two promotions were neces
sitated by the other promotions recent,
ly by the death of Manager J. N. Heals
a few days ago.
Both officials who are the latest to
receive promotion* are well known In
Atlanta and have excellent records
with the Southern. They have ad
vanced steadily since being In the
Southern’s employ and the latest re
ward Is a well deserved one.
