SHERIFF FACES
A LIQUOR PROBLEM
A complicated legal question regard
ing the new prohlbtlon law has arisen
In Brooks county.
A saloon man In that county, on the
flrat of December, mortgaged his stock
of liquors and bar fixtures. He did not
pay off tha mortgage, and there waa
a foreclosure.
The sheriff was Instructed to sell
the liquors and fixtures to satisfy the
claim. The sheriff waa troubled, and
he has written Attorney General Hart
for an opinion. Judge Hart haa sub
mitted an unofficial Opinion that the
sheriff can not sell the Intoxicants be
cause the new act specifically forbids
an officer of the state to sell, make or
give away Intoxicants.
Curiously enough, the only similar
caae known of In the state arose some
years ago. In Morgan county, when
Judge Hart was on the superior court
bench. Judge Hart held then, the
county being under local option, that
the sale could not legally take place.
The aupreme court, however, reversed
him on the ground that the law did not
deny one the right to recover property
for a loan by legal process.
This new question, however, Is dif
ferent In that the law now prohibits
even an officer of the state or county
from selling liquor.
Receiver la Named.
An Involuntary petition In bank
ruptcy ha* been filed In the United
States court against G. G. Reid doing
business at lftft to 175 Peters street by
creditor* and J. R. Ransom was ap
pointed receiver on Friday. The pe
tition alleges the defendant has on
hand a stock of dry goods, shoes and
notions valued at J20.000. The petition
grew out of a petition filed In the su
perior court on December SO by the re
ceiver for the Neal bank, seeking to
foreclose a mortgase held by the bank
on the goods. Other creditors then
came In with Involuntary bankruptcy
proceedings. The defendant admits
the allegations In tho petition and I*
willing to be adjudged a bankrupt.
