Why He Went to Newnan.
!t. Your petitioner further ahowa that when
the train carrying petitioner, hie aaid wife
and defendant. Mra. Kate Silvey .Speer,
reached the city of Oaineaviile. in the atate
of Georgia, they were joined by defendant,
W. A. Speer, and hi* attorney-at-law. The
two defendants immediately thereafter had a
conference in the absence of your petitioner
and hia wife, after which the aaid defendant!
fraudulently induced thia petitioner not to
ret off the train when it reached Atlanta
with hia aaid wife and the defendant*, but
lo continue hi* journey to Newnan. G*„ and
that a* aoon aa the excitement incident to hi*
marriage and elopemant had auhaided, which
would be in a day or two, petitioner could
then return to Atlanta and resume his rela
tions with hia aaid wife. v
A. Petitioner further say* that procuring
him to separate from hia wife in the city of
Atlanta and journey on to Newnan, Ga., was
the result of n deliberate conspiracy entered

ing her to the train at the hour of midnight,

defendant* of petitioner*a wife was done
without hia knowledge, consent or procure
went, and in violation of wour petitioner’
right* in the premises.
Unable to Bee His Wife.
7. Yobr petitioner further say* that during
said absence from the city of Atlanta of said
defendants with his aaid wife, and since their
return to the city of Atlanta, your petitioner
ha* been denied the right of seeing or via
iting hia said wife; that defendnnts have kept
his aaid wife from him, and have continu
ou«ly harbored his* aaid wife aince the 20th
dar of September, 1008, up to thia time
All of said acta and doings are palpable in
vasion of petitioner's rights in the premise*.
8. Petitioner shows that the defendant*
uitrived and intended to injure your peti-
i <tiei*. and to deprive him of the comfort,
empathy, aid and aaaistance of the aaid Mil-

ml heretofore, to-wit: On or about the 29th

until the commencement of thia action, have

said amount, and therefore plaintiff brings
thia action.
Wherefore, petitioner prays that process
may issue, directed to tha defendants, William
A. Speer and Mra. Kate Silvey Speer, requir
ing them to be and appear at the next su
perior court, to be held in and for aaid coun
ty. to answer your petitioner's complaint.

These threats, the petition states,
constituted Intimidation end bo
wrought up the plaintiff that she con-
sented to the ifia triage.
The petition say* the marriage wan
accomplished by "force, menace, du
ress and fraud.”
Fraud it Charged.
It Is alleged that fraud wan practiced
on the court of ordinary; that the elder
Thomas told the ordinary he was the
guardian of Mins Speer, and that the
ordinary, being in doubt, had him sign
the following statement:
"I hereby consent for my ward, Minn
Silvey A. Speer, to wed Russell J.
Thomas. This September 22, 1908."

marriage licenne was secured, without
which the marriage would have been
Impossible.
It Is charged thnt fraud was also
piactlced on the minister performing
the ceremony, Rev. H. A. Atkinson, In
that ho was told bv the eld*'** Tho?n*»-
that the parents of Miss Speer had
consented to the marriage.
It Is charged thut In further pursu
ance of the alleged conspiracy, Mr.
Thomas and Miss Speer hurried off on
the train; that the couple was inter
ceded at Charlotte and that "the plain-
till' has never lived with the defendant
as a wife."
On these grounds a total divorce is
asked.
The plaintiff is represented by Rosser
& Brandon, by Arnold & Arnold and
by W. S. Thomson.

near month*, but fairly good bnying of Oc
tober in evidence. Some commission houses
were again buying on a scale down, but oth
ers seemed to have plenty of the staple for

From the reading of the government’s crop
estimate to the close the market was decid
edly active. Prices were firm and oil good

hivh prices. The advance of Wabaeh is dim
to the expectation that announcement will
soon be made of a traffic deal with the Erie.
Harriman influence is back of the movement.
The Alton is advancing on statements from
the inaiders that the earnings were breaking '
records and thst the dividencLJj soon to be
increased. As the Union PacTnc owns 100.-
OOO shares of Alton preferrtcl the Harriman i
influence ie favoring that movement alto. .
Houthern Pacific’! advance is due to the plan
fplacing the preferred stock in conjunction 1
with an increase of dividends. Owing to the
settlement, London was unsteady in the esrlv
trading. Contangoes on American shares
were 4 per cent, which is slightly lower than
the rate of two weeks age. In the late trad
ing the foreign market improved with South
ern Pacific in leadership. Hudson Bay was
a local feature there, advancing 74 point.
On the curb market Goldfield Consolidated.
LaRose and Cobalt Central were the strong
