who lives In the same neighborhood.
Mr. Loftls Is temporarily restrained
from allowing hla goats to run at large
and 1b ordered to show cause before
Judge Pendleton on December 19 why
the order should not be made perma-
nent.
Mr. Bradley' alleges that he has
planted many trees, shrubs, {lowers and
vegetables about his residence for hla
convenience, comfort and for the pur.
pose of beautifying his place, says
Mr. Loftls' goats have overrun hla
premises and already destroyed many
of his plants and flowers, that Mr.
Loftls has been notified of the damage
but has refused and failed to keep his
goats In an Incloaure and from dam

Trying For Tax.
Comptroller General William
Wright Saturday Issued executions
against the Central of Georgia railroad
and placed them In tho hands of Sheriff
Nelms with Instructions to levy upon
sufficient amount of property to cover
the back taxes which It Is claimed the
road Is due upon 15,000 shares of West
ern Railway of Alabama stock.
The amount, which It la claimed the
railroad owes the state, Chatham coun
ty and the city of Savannah U 1*09,017
apportioned aa follows: The state, $80,.
>89; Chatham county. 879,729; city of
Savannah, 8189,009.
The tax alleged to be due by the
Central covers a period of nine years
from 1890 to 1905. When tho exeem
tlons were originally issued by Comp'
trailer General Wright the road ae
cured a temporary Injunction, which
was dismissed at the llnal hearing by
Judge Newman, of the United Slates
district court, several day* ago. It
expected that the railroad will carry
the case to the supreme court of the
United States.

NARROW ESCAPE
FROM DEATH IN FIRE
DECATUR, Ala., Dsc. 1£—Fire of an
unknown origin at 11 o’clock Friday
night totally destroyed the store and
residence of C. C. Hall & Son In New
Decatur. Only a few pieces of furni
ture was saved. The family escaped
In their night clothes. The total loss la
about 81.604; total Insurance 88,000.
The mandate In the case of John
Scott and othera, plaintiffs In error,
agalnet the United States government,
defendant In error, haa been received
by the clerk of the United Statea cir
cuit court. The opinion rendered by the
United State* circuit court of appeal*
at New Orleans affirms the Judgment
of the circuit court and the case Is re
manded to the circuit court with In
structions to exercise Its discretion In
modifying any sentence which haa been
Imposed upon plaintiff In error.
The plaintiffs were convicted on April
12, 1905, of conspiracy to defraud the
government In the matter of taxes on
distilled liquors. John Scott was sen
tenced to fifteen months In the Federal
prison and to pay a fine of 21.000 and
the cost of prosecution. The case wax
appealed, with the result mentioned
above.

With Customers Two

Holiday shopping Is on with a rush
In the retail district of Atlanta. Sat
urday found thousands crowding the
sidewalks In Whitehall and every store
In the district was fairly overflowing
with eager shoppers. Merchants are
highly gratified with the early crowds
and predict the season will be the most
satisfactory In years from every view
point.
The dry goods and department stores
Were particularly popular with the holi
day crowds, and next In order of pop
ularity cams the Jewelry stores, cloth
ing houses, novelty and book shops.
Christmas presents of every variety
were eagerly purchased and everyone
found the buying comfortable and con
venient.
The feature of the holiday trading
from the shoppers' standpoint Is the
remarkably attractive character of the
Christmas goods in all the stores.

they will take Barbee from the sheriff
