and Indian Spring:s railway, operated
between FlovlUa and Indian Springs
and owned by H. P. Elder, R. V. Smith,
of Flovllla, and J. R. L. Smith, of Ua-
eon; W. F, and J. P. Smith, of Flovllla,
has been taken over by the Middle
Georgia Interurban railway. L. IV.
Robert, of Atlanta, is president, and W.
F. Smith, of Flovllla, Is general mana
ger. of the Interurban railway, which
It la proposed to build from Griffin thru
Jockaon to Social Circle. A consider
able part of the line has been built In
Jackaon, where tho company has a
franchise for an electric trolley system.
Upon the completion of tha Une from
Jackaon to Indian Springs, a large Bos
ton concern. It Is given out. will flnance
the road from Griffin to Social Circle.

John C. Koch, adjunct professor of
civil engineering at tho University of
Georgia, will. In the next two or three
days, present a written report In detail
showing the results of surveys he has

which. It Is claimed by some, are owned
by the state of Georgia and which tho
Georgia -Railway and Power Company
claims belong to .that corporation by
purchase.
Tills report will add another chapter
to the controversy over whether or not
tho state has a-legal-right to Interfere
with the construction of an - electric
power plant at Tallulah Falls by the
lower company and may have a bear-
ng on whether or not the state railroad
commission-reopens the hearing on the
application of tho power company to
Issue ,57,000,000 of stocks and bonds. In
the application of the Tallulah Falls
Preservation association for a reopen
ing of this hearing It Is set forth as one
reason for asking It that the ownership
of the property at Tallulah -Falls Is In
question and that Interests of the stato
are at stake.
Professor Koch recently spent four
daye at Tallulah Falls making surveys.
He did this work'at the request of Gov
ernor Hoke Smith shortly -before he re-
tired from tho gubernatorial office. On
Monday Professor Koch appeared be-
foro Governor John M. Slaton with a
roll of blue prints and maps and made
a verbal statement of the work he hnd
done. Ae this was tho llrst time the
matter had been brought officially to
the attention of Governor Slaton, he re
quested Professor Koch to put his re
port In writing and make- it complete as
to detail, filing the blue prints end maps
with the report. Professor Koch prom
ised to prepare the report immediately.
As questions of law are Involved, Gov
ernor Slaton will transmit Professor
Koch's report to Thomas 8. Felder, at
torney general, and/ request a legal
opinion from him as to what rights It
shows the state to possess In the Tal
lulah Falls properties.

The next session of the railroad com
mission will be held on Wednesday.

for consideration. Inasmuch as Proles,

the hands of the governor by that time.
It Is expected that the commission will
defer a ruling on any phasO of the pow
er company’s application until after the
findings of the engineer are made avail
able for the commission's consideration.

The Georgia Railway and Power
Company depends upon an act of the
legislature of 1905 (page 1355) to es
tablish its contention that Tallulah
Falls belongs to private parties. For
this set shows that the statu of Geor
gia, on the theory that private parties
own the falls property, appointed a
committee to negotiate for Us purchase,
but nothing ever came of It. The
archives put the state on record by the
senate, house and governor,, as admit
ting that Tallulah Falls Is privately
