the Salem (Maas.) Advecato we toko great

morning, tbo following extracts:
That tho convention which framed the
constitution possessed legititrmto power is
beyond a doubt. Its members were chosen
by the people of the Territory, uodor a cull
iesued by the properly-constituted authority.
They represented t’lio population of the
Territory, so far as it is possible for any
representative body to indicate the semie
incnls of those by whom they were elected.
The duty of framing a constitution was del
egated to them, and with that duty the right
to complete such u State organization as
would enable Congress to admit Kansusinto
the Union. Neither law nor universal
precedent required that they ebould submit
their work to the people except in each a
form as they, the renreeentativee of tho
pooplc, might deem proper and expedient.
T hat every republican sentiment called upon
them to do so wo trust no man will deny.—
Bat the charge that they did notdo so by no
moans invalidates their action, lu review
ing the cousre pursued by the sevoral Ter.

Union it will be fonud that in many cases
the adoption of u cons-'tutioQ by a conven
tion has been considered sulucicut. The
submission of the constitution to the people
Is by no means universal. And bad the
progress of Kansas from a Territorial to a
State organisation been peaceful and uniat*
peded, as democrats would have had it, no
question would have arisen apon this point.
However contemptible may be auy subter
fuge by which a single question of State
policy ie selected for a popular verdiot, and
however short-sighted may be any attempt
to recognise the existence of uny institution
by restraieing all action upon it, there is no
caitso in all this for revolution, and none for
the rejeotiou by Congress of an application
uf Kansas to become a State.
And why ? Because in its admission info
the Union, according to tbo free and liberal
policy of the democrat's party, is to be
found the ouly remedy for its troubles.—
Kansas once an independent State, and tho
question of eluvery comes directly before
the people, as a matter of economy and
politics, even if that question is submitted
to them on tho udoptioe of constitution
There is no constitution strong enough to
carry it there should the people refuse to
accept it ss an institution. There is no act
capable of continuing its existence should it
bo found to he useless and as a burden.—
The whole matter must, alter all, bo sub
mitted t > tho people; and I'to only question
now is, how best to get oyer all intermediate
difficulties, and approaeb'at once to the finul
retticnent.
It cannot be a question between the three
at Topeka and tho convention at Lecomptou.
The former has had no claim for even a
al’tjht recognition. The latter, with all its
detects, enjoys the advantage of legitimate
birth, and can be made the means of an
amicable adjustment, if the popular voice
can only be heard above the din of sectional
and factions combatants. Northern fanatics
may cry ont that the adoption of the Lo-
cunnton constitution fastens slavery upon
tbe Territory, whatever may be the voto of
ti.c people upon this qaestion t hut a single
glance at tho schcdulo of that, constitution
,nd into tho future exietenee of Kansas as a
State, with all the rights- -and immunities,

If the Lcoompton convention bad the potter
to submit their work directly to Congress in
their capacity as representatives of tbu peo
ple, we see no reason wiry any circumstances
created by a clamorous opposition should de
stroy that power. If constitutions have been
brought before Congress in a similar way be
fore, there is no reason why it should not be
done now—more especially inasmuch as by
such a proceeding tho popular voice is nit
stifled. We would defend no wrong, but we
would look for the most speedy relief. And
we think the admission of' Kansas ns a State
into the Union would afford that relief with"
out any violation of the truo meaning and in
tent of that act which established her tori ito-
rial existence and secured republican rights
to her people.
Safety of Hon. Mr. Sandidge.
lion. Reuben Davis, of Mississippi, who
reached Washington on Wednesday, states
that there is no truth in tho report that Hon.
John M. Sandidge, of Louisiana, was among
the number lost by the burning of tho LI-
fated steamer Rainbow. Mr. I>. wns a
fellow-traveller with Mr. Sandidge Com
Tusnumbia to Huntsville, Alabama, ot which
piece the latter stopped for tho purpose of
paying a visit to his father. It was Ifif
intention of Mr. Sandidge to have taken
pas age on hoard the Raiahow, but, as she
was not at her wharf when lie arrived at
Memphis, lie left about two hours previous
to her arrival, to another boat.
