lt ii probable that the Kansaa legislature,
called by acting Got. Stanton, is non in ses-
•ion, and will taka measures to unnul the
proceedings of tbs constitutional convention
and to obotrnct or prevent the oonetitu-
tional election, which was assigned for ibo
21st. This will serve tho more to compli
cate the subject, as'the legislature can have
no legal existence until tbe first of January.
Its acts will not be recognised by the exe
cutive government or by Congress as legal.
What new difficulties are thus to be produ-
oed, cannot be forscen.
Congress, upon wbioh body the Bubject
devolves, must meet tbe question os a prac
tical one, acting apon the polioy recommend
ed by the President, which is to quell the
agitation in Congress and the oountry, and
eonfiine it to tho limits of Kansas. To no,
Copt tbe Lecompton Constitution, in
whatever form it may arise, is deemed by
tiyrPrraidcnt and Cabinet, and perhaps a
majority of the Democratic Senators and
Beprcsentatives, as the readiest and surost
way or reaching the objeot in view. It 1b
known also that Southern mombers are very
mnoh disappointed in their expectation that
Kaneai would become a slave State, and at
tributing this failure to a departure by Fed
eral ofEners of the Territory from tho prin.

any concession or compromise on the sub.
^*They are, however, so far committed to
the support of the legally constituted Le-
ooapton Convention, that they will sustaio
tjmir Constitution, even if it came without
slavery; but further than this, as I am ad
vised, they will not go. Tbe resolutions
heretofore adopted by some of tbe southern
State Legislatures, and thoso about to be
adopted by the legislature of South Caroli
na, will, verfcrobably, govern the action of
the majority of southern members. Practi
cally, the aoceptance of the Lecompton Coca
stitutlon would seem to be the onlv mode of
solving that difficulty within the hounds of
the Demoeratioparty. But that Constitu
tion may not before Congress at all, or
it asy come under circumstances so embar
rassing, that it cannot command a majority
of cither House.
Hopes aro therefore entertained that some
mode may be devised of anticipating and
Avoiding all difficulties, with the concurrence
of tbe Democratic members. A recurrence
to the Toombs net of 1856 may afford such
means. It it understood that Mr. Douglas
will Introduce this bill, tbe history and char
acter of which will be remembered, and will
commend It to publio attention. This act,
framed by Senator Toombs, of Georgia, was
to enable Kansas to form a Constitution and
State government preparatory to admission
into the Union. It pareod the Senate, pend
ing the Presidential canvass, with the voto of
every Senator who had sustained the Kansas
Nebraska act, and wss rejected in the House
bythevotoof every Btkexuepublican.
This act, as it passed, did not provide lor
the submission of ths Constitution to tho
people | and Mr. Douglas, in accordanco
with the special reeommendtUon of tho
President in his late message, will intro-
dneo this provision in tho words of the
Minnesota enabling set. The practical
benefit of inch an act would bo the imme
diate adjustment of the Kansas difficulties,
as rt exists in Congress, in tho country,
and in Kansas itself. It would embarrass
no Democratic members, for it would re
quire none to recede from any position ho
had ever takoo.
Gov. Walker is now hers, and his rcla.
tioos towards the Executive will probably
soon be determined.
The U. S. sbip-of-war Saratoga, could
notiavebeen under ordera, as has been
stated, to intercept Gen. Walker and bis
filiibustere. Walker passed under her gum,
end hie papers were approved, and probably
hie objects also, by the cominandingofficer.

Heavy Huint—llceiruclion of Property.—It
has boon years, says the Chattanooga Ad-
vertuer, ol the loth inst. since this section
of country has been visited .with as heavy
rains as we have been having for the lost
week. It commenced mining last Friday
night, and has continued with hardly an
hour's interval to the present time. The
river is in booming tido, and farmers are
apprehensive with fear that it may break
its banks and canto a genoral swamp of un-
gatbered corn, late sown wheat and proper
ty gonorally. Tho baok.water is so high
in the streams as to cause much destruction
and loss to such as own property thereon. If
the rains should continue a day longer, the
Imvoc will ho unmanageable, and nt tho
time of writing, it is still pouring.
Accident on theJ Georgia Railroad.—The
down pasienger train on the (icorgia Rail
road did not arrivo until a late hour last
night, boingdetaiued, as we learn, by the
collision of two freight trains about seven
teen miles from the city. The leading freight
train was going up a heavy grade in tho
road, when ono of tho couplings parted, and
tho cars run hack into tho train which was
following, breaking up the rear cars and
damaging tbe engino considerable. So one
