The fourth section ot the third article of the
present Stale Constitution says that—
•• Each House shall lie the judge ol the elec
tion returns and qualification* Ol i's numbers,
and shall hare power tn punish them tof disor

This section of the Constitution gives the ex
clusive Jurisdiction to “each Hyjrv, to dec ole
the qualiflcatfflis of its member*, and Iront the.ir

The Legislature cannot, under the LVustiiu-
lioo, refer the question ot citgi'-'i tty of Its uiem
bers to the courts. The Constitution makes it
the dutr ot each House to determine, and whe
ther their decision lx right or wrong, it cannot
be disturbed. The expulsion of negro members
tro.ni each House ot the Georgia • Legislature
seems to be a cause ot great complaint in certain
quarters; and we regret to see some good Iriends
urging the Legislature la refer the question to
the courts. The question of eligibility to any
other office in the State is subject to be Inquired
into by the courts; but the eligibility ot mem
bers ot the Legislature is not, and »« hope m>
further action will be taken on this subjecL
