Negro Eligibility.
The action ot the House tu-tlay, referring the
question ot eligibility of negroes to hold iifllr.e
in Georgia amounts to nothing.
The eligibility of negroes to seats in either
braoob of the Legislature is not and cannot he n
question for the Courts. The right ot a negro
to hold any other office is by the Constitution
properly a question tor the Courts to determine.
Therelore, there is no torce In the passage ot
the resolution ot the House on the question, but
simply a farce on the public.
We hope the House will reconsider their ac
tion on the negro question to-morrow inoniing.
Finn at tiib Asylum.—The Milleilgevllh;
Federal Union' says that on Thursday last the
building for the colored insane was set on fire
by one of the inmates—a colored lentale. She
found her way to the attic and kindled afire
and the roof was soon In a blaze. It was, fortu
nately, discovered as soon as it made its appear-
ante through the roof, and by the calm and
prompt action ot a number of the officers of the
institution, was soon extinguished. The dam
age was slight (about twelve feet of the roof be
ing burned,) and has been repaired.
A curious autograph of Torquato Tasso was
recently sold In Purls, which reads as follows;
** I, the undersigned, declare to have received
from Mr. Abraham Leri, the sum ot 30 livres,
for which be took in pawn my father's sword
six shirts, four sheets, and two table-cloths.

Judge Fabxbr, of Winchester, Virginia, is
reported to he looking for Senator Sumner. The
latter, the other day, oo tbo strength o; a carpet
bagger's memorial, denounced the Judge as
" most atrocious." It 1b said that the Senator
will have a chance to Justity or retract bis
charge t gainst a very woithy gentleman, or to
name a Wend.
Fbu Passes to the Prbss Convention.—
All leading railroads South have telegraphed to
Southern members ot tbe press here that they
will give tree passes to all Western editors who
desire to visit their brethren at Mobile at the
Press Convention to be held about tbe middle ol
February.

claim. Passed.

Mr. Holcombe—Tbat a seat on the floor be

SPECIAL ORDER OF BUSINESS.
Mr. Wellborn's resolution—Tout a committee
bi three to be composed ol Hon. J. E. Brown
J. R. Parrott, and A. H Stephens, be authorized
to proceed to Washington City, sud to represent
to the Congress ol the United States, the true
•tale of affairs In Georgia, and to ascertain what
■olutfon of our unfortunate difficulties can be
hid which will be satisfactory to that body, and
compatible witli our duty as sworn Senators and
Representatives.
Mr. Wellborn asked permission to withdraw
his preamble aud resolutions.
The President decided that the resolution
oouldnot be withdrawn alter the action on it,
ua1e*t by consent of the Senate.
There was an appeal from this decision.
The President stated that rather than the ap
peal being pressed, be preferred tbo Senate
should decide. Shall permission be given-Mr.
Wellborn to withdraw his resolution f Permis
sion granted to withdraw.

Ilotiee refused to reter the question of the
eligibility of. negroes tu office to the Judiciary
as moved by Mr Scott ou yesterday.
Mr. Flournoy opposed the sffiflltilte o[ Mr
Price. He was utterly opposed to any action
on the part ot the State of Georgia, which would
recognize the rigid of Congress to legislate and
controll matters exclusively belonging to the
States. The principle was dangerott- - as lending
to centralization and consolidation of all power
eventually in the general government. He
thought II improper and wrong to refer the ques
tion ol negroes holding office to the courts 0|
this State- . The Constitution referred tho decis
ion of this question to each house of the Gener
al Assembly, and he did not think the court
ought to be embarrassed, with it, but the House
ought to meet tu duty squarely.
Mr. Barnurn, ot Stewart, called the previous
question, which was sustained.
Mr. Price’s substitute was divided by decision
of the Spenker, tho tirst portion containing the
preamble and first resolution, was first put, am!
yeas and nays called—ayes, 31; nays (it).
Mr. Scott gave notice lltat no would move to
