Berryville and then turning to the right took up the road to Martinaburg Vir ginia. An hour or two before mnaet the command reached the wooded bill a little wc.it '.h of the village of Darkaville, but before going Into camp the regiments were drawn up in line to hear read a number of very important general orden. One was from General Lee, aimilar to the one Issued to the whole army at Chambersburg on the 27th, Informing the men "that we were about to enter the ene my???s country, calling upon every soldier to abstain from all damage or destruction of private property, urging the officers especial ly to see this order obeyed, that private rights were respected and reminding ttiem that we were not waging war against peaceable cltl sans, defenseless women and children, but against soldiers well equipped with arms in their bands," etc. Another order read here was for the execu tiou of John lltlry, which was to take place the next evening. After the line was dis missed and we bad eaten our rough camp anpper, I laid down forest, but got to think ing about John Riley, and, although very tired, it was several hoars before I cu.uld get tosleep. John Riley was an Irishman, aud all that is known of the man fa found in the reporta of a "general court martial convened at the estop of Major General K. If. Ander son.??? ami reads as follows: HaAiNUAKvaaa Aasiv Noumea* Vikoisia, Juno 14,1803. General Orders, No. 71. Andetson's division, by virtue of general ordera Ns. 44, headqtitriera department of northern Virginia, at which were arraigned and tried the following named irisonen. e e ??? ??? ??? s 8. Private John Itltey, Company B, Eigh teenth Virginia rrgtment. Charge: Desertion. Specification: In this that the said John Riley, a private of Compauy E, Eighteenth ??? ??1t - Virginia regiment, having entered said com n r as a substitute on or about December 802, did, between datk on Saturday night. The deolsion of the court was kept a pro found secret, and when the division started south in February, 1803, the prisoners con fined in the guard houses were taken along, and all through that campaign in the swainiu of eastern North Carolina and around Hu troll, Riley, with the other prisoners, tramped hundreds of mllea, oftentimes tnarobiug all night loosely guarded, along narrow roses lrltb dense svamnt and dark foieits lining ihs route on bo'th aides aud overlapping branches shutting off every ray of light; yet with a hundred op-ortuoliles to uope he never attempted to do so. No one hett ever learned anything of hia previrus history, as he was very reticent and always oppearstl sullen and morose. 1 fell pity for this mis- iralde, unfortunate man, a foreign,r, far from hia native land, aumut s-.raiigris and coudemued to death, with uo one near in whom he o.iuld confide nor a alnglo Iriend to receive hia last tuttaaage, lu tho uiurnlng 1 talked with the adjutant stud teamed that nothing could b?? dona to (lay or delay the axecuuon; that when he uffered to let Riley ride In the ambulance that day, lie replied: "1 have already walkad many hundred milts, and think lean hold out oue day more;" aud when tits Uay???a rationa were laaued to the prlaonen Riley declined to take ht-, a>y- ng, "I am net nun,,,''" 1 *** tblnkl ?? 1 ** 1 ttved ahythlng to nt?? They were at this time marching along a broad turnpike f< rty or Ally ftei Wide, aud Riley waa abuut the middle of the road. Kttuwlug my eiraod or divin ing it th?? guana and other pr so tiers fell away a little ana give me aa autpie opportunity to converse with Riley. Walking along near him fur some ulsvatice in aileuue that lie mtghtnoiice my prseence aud that 1 might not appear abrupt, 1 spoke lit n low voice and eatd: "Mr. Riley, 1 fbel a great sympa thy for you tu your present uumrtuuate sit uation, and Pel animus to do somethin.: for you if Mere is anj thing 1 can do." With out raising his head or even looking at me he moved offafew feet towards the opposi e side of the road aud marched on to etleuce tor a hundred yards, an-1 then said slowly: ???Thera is nothing you can do for me." m. long aileoce followed and we marched on aide by side, with a apace of five or eix feet between us, as 1 kept the middle of ibt road while he had ntuvtd assay to the right. After ten minuxsaileuce leaked, "How old are yon, Mr. RiteyT ??? I then asked: "How long have yon been in Amer ica?''aud after a very long silence be an swered, 'Tnlrtyriour yean.??? I then asked him: ???When did you bear from your pa rents?" Bti'l moving away and marching neatly a half mile before he replied: "Not since 1 left Ireland at twelve yeara uf age " By this time he waa ou the edge of Ilia road aa far off aa he could get front me, end el though leaked h.iu several ot'-er questions and offered lo write to any of bis friends nr relatives if he wishid me to do so and waited long for hia answer to each question and proposition, yet he never replied to any more. We had now marched several miles together, my pr.sance and questions aeemed to annoy him. and aa I saw no prospect or chance to serve him in any way, I excused myself by saying to him: "1 hope 1 have not appeared intrusive, if raymo???iveehaer been misunderstood and you mistake my sympathy and my snalaty to serve yon fo' any idla cariosity respecting yonr put life ???nd history, 1 shall regrst my effort to help you." To this there waa no reply and 1 returned to my company. We crossed the 1???otomac and passed through Widlamaportabout three o'clock on Friday evening, and after going a | mile or two selected a large open field on the right (ifctlie road for the execution. Riley asked for the services of a prieat and a mes senger waa aent to seek one, bat returned un successful. The brigade was drawn op In double rooks, forming three sides of a "hol low square,??? the fourth side, down bill, be ing left open. In the center of this open side and in full view of evety man in the columns, whtcu faced inwards, a strong stake was driven into the ground and left about three feet high. A band of mnso entered (be square around the right flank, followed by four soldiers bearing on pikes an empty uiue coffin; close behind this walked John Rtley, with a chaplain at his aide, dressed in a long, flowing black robe, and then came the captain of Company E at the head of the twelve armed men, drawn by lot from his company to perform the execution. The baud struck up that mournful refrain. I have (Sited 'Death alien (kite. Evety danger have I known That a reckless life cut Ml. But her preeebce hath not down. For her briR.it emllo baunte ms still. The funeral cortege, starting at the right, marched close along in from of tint line all around the three sides of the square and then to the stoke, where Riley's hands were tied al his back and be was made to kneel, so the bandage slipped over the stake behind him, A cloth was placed across bis eyes and ne won asked if lie had anything (o say. His only reply woe: "Good-bye, hoys.??? Every thing being ready the captein waved his sword, a volley followed and John Rtley lay a mangled corpse. Ho was buried near the spot aud steeps in an unmarked ???grave. I doubt if hli name waa Riley. Twenty yeara aflcr this eieeution, while looking over acme musty records, tny attention waa called to Ibis singular indorsement, made upon .the Riley papers at General Lee's headquarters: The sentence of private John Riiey, Com pany E, Eighteenth Virginia legnuent, will le duly executed ten days after the publica tion of hia sentence to hia brigade In the iresence of the same, under the direction of- its brigade commander By command of Gxhxrai. General On the 27ia the division marched a little beyond Green Castle and camped in a large grove of oaks to the left of the rood, and the men began to burn fence rails and to carry a farmer's wheat shocks into camp for bedding, saying they bad obtained permission from their colonel. Several officers waited upon the colonel and protested against the destruc tion of private property os a violation ol Lee???s orders, but the colonel became angry aud said: ???He was surprised that officer) who bad seen auon wnoletale ruin of private ;roperty in Virginia should now lift their lands in holy hoiror at the burning of a taw yankeo fence rails and the using of a little wheat for so dlera' bedding.??? When some instances of this sort were reported to Gen eral Pickett as violations of Lee???s orders, his iply was: "We are not obliged to do every thing General Lee says," While tho pioneer corps tinder Lieutenant Morriaselt were leering up the railroad uear Ckainberjbitrg, a crowd of citisens gathered around the men and claimed that the road whs private property and a good many hard tilings were said about the confederates, and i he grumbling cominued until a preacher from the town came along, with a large pair of goggles over Ills nose, ami peering up and down the track awhile at the burning sills and twisted rails, stepped up to Morrifsott and aaiil: "1 bad no Idea this road needed repairing!" As tun division marched through Olinm- beiaburg in rear of Lee's army, a Isrga-slsed middle aged Dutob woman, wtih a long white apron on, bare-headed, ah-uv-a rolled up auove her elbows, with her arms akiuiho, stood upon the sidewalk and said: ???Mine Uo'l it???s tbo whole aarouth 1 see, tab if," A soldier replied: "Mostly, madaiue,??? and on wo went. , , Coming to a tail flag poleseventy or eighty feet high, with thes ura and stripis floating front 4he top, some soldleia began chopping on it, when a dozen boys, old men and women came up ami asserted; ???It was a real union flag, a Bel! and Everetl (lor, hut further on we could Hud a Lincoln Hag 1 So the po e waa li ft standing, and when wo turned the corner and reaebid the end of the next streot then) waaanother polenud flag precise ly like the flrat, but the boys liatl followed ue, keeping pare eloux (he sidewalk, aud other boys had j lined in, all of whom now elalnird this os a regular arersh tlag, pul up in honor of Bteckenridge and Lane, aud u was a piiy to out itdown.
