the Western market is slipping away.

superior court, for $14,433.89. Major

The petition alleges ilmt on April 8,

con (who had been selected to ap

tween them) and by him requested to
sign as surety a certain bond of J. S.
MoTigbe & Co,, required by the
United State ■ court for $100,000. Tlie
petitioner declined to sign the bond,
hut. at that time and afterwards the
said Bacon importuned petitioner,
representing that the signing of tlie
bond by petitioner was a mere mat
ter of form and, involving no risk.
The suld Bacon further assured peti
tioner personally that he would see to
it that petitioner would never have
to pay a nickel. Although tho poti
tiouer was disinclined to sign said
bond, lie finally did so after repeated
insistance and assurances of indem
nity against loss made by the said
Bacon.
