The state supreme court Wednes day took under advisement the case of a negro who contends that his death sentence for murder should he doemrea inoperative because the law under which he was indicted was repealed before his conviction. The case, discussed in legal circles as “the last of the hanging cases,” is that of Arthur Myers, Augusta ne gro, who was convicted of slaying a railroad detective in the Augusta yards of the Georgia railroad ; n the uarly part of 1924. Between tinie of his indictment and his trial, however, four years elapsed, due to his having escaped | from custody. During that time the ! hanging law, in force when Myers was indicted, w;.s repealed and the existing electrocution law substitut ed. Ben Pierce, of Augusta, repre senting Myers, contended that a re pealing clause in the electrocution law had eliminated the hanging law froo consideration, and that his | client should be set free.
