Macon, and on his return to Vii

True to his promise Mr. Nolan
passed over the groundu at -Allen’s
Invalid Home about one o’clock
1 esday afternoon, and dropped the
box to Mr. Yarbrough who was

Escaped in Decatur
Hill's last escape was from an
officer who was taking him from
Decatur, Ga., to the state farm. When
be vu Raptured here some time
iascr he was wanted by state and
Tutor county officers for forgery,
partitioned, he estimated his forg
eries at more than $50,000.
While he was being Held in city
barracks here, he “found religion,"
and. quoting scripture to police
Chief Ben T. Watkins, said "the
only way is the straight and nar
row path.’’ He said he wus “off
crookedness” and would henceforth
"live straight.”
lie prerented Chief Detective T.
E. Garrett with a ring with a large
crystal setting as a token of good
temporary injunction restraining
collection of the tax.
Several weeks ago a temporary
order was granted enjoining Comp
troller General Wiliam B. Harrison
and County Tax Collector W. B.
Richardson * from collecting the tax,
which was imposed by the 1929 legis
lature.
The F. W. Woolworth company,
J. C. Penney company, S. H. Kl’eas
company. Lane Drug Store, Inc.,
King Hardware company .and the
Southern Grocery Stores, Inc., who
were among the petitioners for the
injunction, contended a tax of $50
each store in a chain containing
•e than five stores was discrimi
natory.
Judge Pomeroy held that the state
has the right to make distinctions as
to taxes on certain lines of business,
if such distinctions are not unreas
onable and arbitarary. He conclud
ed his decision with a statement that
the "tax is a valid exercise of legis
lative discretion."
