of Georgia says he is of the opinion
that the constitutional amendment,
an adopted by Georgia voters last
November, requiring only the pay
ment of a poll tax to vote, “super
cedes and abrogates" any charter or
ordinance provisions of cities requir
ing payment of all taxes before be
ing eligible io vote.
The question was brought up by R.
H. Hutchinson, clerk and treasurer
of the city of Tifton. Yeomans said
that he had no authority to render
an cfficiai opinion except upon the
request of the pavernor or a state
department head, and then only with
respect to questions in which
state is interested. Accordingly, his
opinion, he said, was "merely the ex
pression of my personal and indivi
dual opinion."
Provisions of Law
He said the effect of the amend
ment adopted last November was to
“strike from the constitution the re
quirement that the voter, in order
to be entitled to register and vote,
shall have paid all taxes required of
him since adoption of the constitu
tion of 1877, and substitute the
quirement that he shall have paid all
poll taxes. It will thus he seen that
the only requirement of the
stitution as amended with reference
to the payment of taxes relates
poll taxes.” The amendment says
that after persons meet other quali-
f : cations the only taxpaying require
ment to vote "ar any election by
the people” shall be payment of poll
tax.
“In my opinion a municipal elec
tion is an election by the people, and

and they are to him. He protects
