TRIPLE-A AMENDMENTS
ARE NOW PART OF UW
President Roosevelt has signed the
complex agricultural adjustment act
amendments, which the New Deal
relies upon to bolster its farm pro
gram in an approaching supreme
court test case.
The amendment act also pitched
the AAA into regulation of another
basic commodity, potatoes—a diffi
cult task which it does not relish.
It extended for another crop year
the Bankhead and Kerr-Smith acts
for specific conttol of the size of the
cotton and tobacco crops.
New Deal lawyers hoped signa
ture of the amendments would lead
to early dismissal oC more than 500
temporary injunctions restraining
processing tax colections. Those in
junctions have reduced by about 75
per cent the collection of funds
which the goverrment is supposed to
use in making benefit payment to
farmers co-operating in crop con
trol programs.
The amendments sought to correct
legal weaknesses noted by the su
preme court in its NRA decision and
bv lower federal courts in some of
the pending AAA cases.
To meet ihe contention that the
criginal act made unconstitutional
delegations of power to Secretary of
Agriculture Henry A. Wallace speci
fic guide and standards would be
laid down for him to follow.

viously fixed by Wallace and the
benefit contracts made with farm
ers are specifically legalized by the
act in a further effort to bolster
their validity.
In event the processing taxes ulti
mately are found invalid by the su
preme court, the right of processors
to recover tax payments in sharply
restricted. Before any recovery can
be made, the act specifies, the pro
cessor must prove to the satisfaction
of the commisioner of internal reve
nue that he has not passed the tax
on to the consumer or deducted it
from amounts paid to producers.

1. All of the stockholders of said
corporation being present and all of
the debts of the corporation having
been paid, and there being no out
standing lien against the property
of the corporation and no outstand
ing indebtedness of any kind against
the corporation, and an offer hav
ing been made by an individual
purchaser for the property and
business of the corporation and this
offer being acceptable to all of the
stockholders, be it therefore resolved

Petition to Surrender Charter
Ammended Petition.
The amended and corrected peti-
an of the Super-Shoe Service, Inc.,
respectfully shows to the Court the
following facts in the above stated
petition for cancellation and
render of charter.
That said corporation was duly
chartered by the Superior Court of
Baldwin County, Georgia foi
period of twenty years on May 3,
1932, of record in the Office of the
Clerk of Baldwin Superior Court.
2. TTiat said corporation owes n
debts of any kind whatever and
there are no claims or liens of any
kind against said corporation or
property of said corporation.
3. That at a stockholders meet
ing held on August 30. 1935 a i
lution was unanimously adopted by
all of the stockholders of the corpo
ration. a copy of said resolution be
ing annexed hereto and marked
Treasurer of the corporation, is in
structed to petition the Superior
Court for authority to cancel and
surrender said charter, sell said
property and wind up the affairs of
the corporation, upon such terms
and conditions of sale as may be
agreed upon by the majority of the
stockholders, and after paying the
expenses of same to divide the pro
ceeds remaining among the stoc'
holders in accordance with their
interest therein.
