the last, and in the early part of the present
week, there was evidently a decline of 1-8 to

some holders, however, have refused opera
ting at this decline, and are holding for for
mer fates. The market was very “unsettled
yesterday, and closed heavily for every de
scription of short Cotton. The transactions
comprise 95 bales at 9 cents. 56 at 9 1-4, 168

AN ORDINANCE,
To carry into effect an act of the Legislature
of the Stale of Georgia, incorporating tiie j
Chattahoochee Rail Road and Banking
Company, and to authorize the issue ol ;
City Bonds.
“Whereas by the the third section of an
-Act, passed by the Legislature of the State
of Georgia, assented to on the 29th of De
-cember, 1836, entitled an act to alter and
amend an act, entitled “ an act to incoporate
the Chattahoochee Rail Road and Banking
Company,” passed the 21st of December,
1835, and to give said company banking priv
ileges; the Corporation of the City of Co
lumbus are authorized to order the opening
of books of subscription to the stock of said
company, at such time and places as they may
•deem expedient.
Sec. 1. Be it therefore ordained by the
Mayor and Aldermen of the City of Colum
bus, lhat in pursuance of, and by virtue ot
the authority granted them by the Act alore
isaid, books of subscription to t ic stock in the
Chattahoochee Rail Road and Banking Com
pany shall be opened on the first Monday in
March next at the following places, and re
main open for two days, under the superin
tendence of the following persons, or any three
-of them, to wit:
At the City Mall, in the City of Columbus,
under the superintendence of the Clerk of the
Superior Court, Hines Holt, Charles L. Bass,
Seaborn Jones, J. N. Bethune, William L.
Wynn, A. K. Aver, and Thos. Preston.
At the Court House in Hamilton, Harris
•county, under the superintendence of the
Clerk of the Superior Court, William C. Os

Sec. 2. Be it further Ordained, That;
the following is suggested to said Commis
sioners, as a form to be used in receiving sub-■
scriptions for stock in said company.
“ W e the undersigned do hereby subscribe
for such number of shares in the Chattahoo-j
chee Rail Road and Banking Company, as i
are set opposite our names; and hereby bind
ourselves to conform to the requirements of
the act of the Legislature incorporating said
Company, and of the ordinance of the city
council of Columbus in pursuance thereof.—
Witness our hands and seals.”
Sec. 3. And be it further Ordained, That
all persons who may subscribe for stock in
said Chattahoochee Rail Road and Banking
Company, and pay in money to said Com- 1
missioners the sum of twenty-five percent,
on his or their shares at the time of subscri-{
bing, shall have a preference for the whole ;
number of shares so paid for, unless more;
than the whole number of shares composing
the capital stock of said company, shall he
taken and pakl for; and no part of this ordi
nance shall he so construed as to authorize
the issue of City Bonds for any stock upon
which the twenty-five per cent, may have
been paid in money, or current Bank notes.
Sec. 4. Be it further ordained, That it
shall he the duty of the Commissioners ap
pointed in the city of Columbus, immediately
alter having received the returns of the com
missioners above named, to report to the Ci
ty Council the whole number of shares taken
and the amount ot money paid in and by
whom paid.
Sec. 5. Be it further ordained, That all
persons who may subscribe for stock in said
Chattahoochee Railroad and Banking Com
pany, and who may wish to avail themselves
ol the benefits of the act incorporating said
Company and of this Ordinance, and who
may not chose to pay in the twenty-five per
cent, in money or current Bank bills, at the
time of subscribing, shall, within thirty days,
from the time of subscribing for said stock;
make and execute a deed of mortgage to the ;
Mayor ami Aldermen of the City of Colum- j
bus and their successors in office, bv which;
deed of mortgage, such subscriber for stock I
in said company shall pledge real estate, which ;
upon a (air valuation, by the Commissioners
above named for each county, shall be worth
at least one half of the whole amount of stock
subscribed tor bv such mortgager.
Sec. (>. Be it further Ordained, That said
deeds of mortgage, after having been recor
ded according to law, and being accompanied
l>v the certificate of the commissioners afore
said, staling the value of the real estate mort-;
gaged, and the affidavit of the applicant lor |
stock, that it is unincumbered bv any other |
mortgage, deed of conveyance, fi. fa. or olh- j
er instrument, judgement or process,by which |
the validity of the title in the mortgager is or j
may be effected or impaired, existing in said j
county or elsewhere in ilieir knowledge, shall j
he filed a way under the direction of the City!
Council of Columbus, which deeds ol mort
gage, together with the whole stock in said
Company subscribed for by said mortgager,
shall he hHd by the city of to in
demnify her against the possibility and !
shall also He held and pledged by said city as ,
collateral security lor ihe payment ofthe bonds ;
to he issued as herein provided for.
Sec. 7. And he it further Ordained, That
any person or persons living in a county or|
place, other than those mentioned in the first
section of this Ordinance, who may wish to
avail themselves of the benefits of the act in
corporating said company, and of this Ordi
nance may subscribe for stock by application
to the City Council of Columbus, within thirty
days from the first Monday in March next,
and presenting a mortgage or mortgages upon
real estate, with the certificate of the Clerk of
the Superior Court, and the Justices of the
Peace ofthe district in which he may reside,
and in which the property proposed to lie
mortgaged may lie. as to its valuation and the
affidavit of the applicant, that said property is
unincumbered by any mortgage, judgement
or process which will affect the lien of said ci-
ty upon it.
Sec. 8. Be it further Ordained, That so soon
as the stock of said Chattahoochee Railroad
and Banking Company shall be taken up, or
so much thereof as is required by the charter
to authorize the commencement of the work j
contemplated, and the company organized, |
the city of Columbus, in her corporate capa-|
city, will issue city bonds to the amount of!
seven hundred and fifty thousand dollars, it I
being one fourth part of the capital stock of i
said company, or for so much only and no;
more than will be sufficient to make that sum..
when added to such sums as may be paid ;
| in, in cash, by subscribers for stock, which;
!bondssha II be loaned to said Chattahoochee
i Railroad and Banking Company, under the
j provisions aforesaid, for the purpose ot being
negotiated for cash in the United States or
elsewhere, upon such terms as said company
! may see proper to prescribe or accept: Pro
; vided that the said bonds shall not he payable
at a longer lime than 30 years, and that said
company may contract for ihe payment of
said bonds and the interest accruing thereon,
at such place or places as they may think con-
ducive to their interest.
Sec. 6. Be it further Ordained, That at
anv time hereafter should any defect devel
ope itself in the validity ofthe title ol any pro
perty mortgaged ny any stockholder in said
company to the city of Columbus, which will
in any way affect the lien of said city, on sain
property, hy virtue of the mortgage, made
in pursuance of this ordinance, the corporation
of said city reserves to itself the right of for
feiting to itself the slock subscribed for and
disposing thereof as they may think proper:
Provided the mortgager fails to strengthen
his securities to the satisfaction of the City
Council, upon twenty days notice gi\en in
writing to him, his heirs or leg.tl representa
tives.
Sec. 10. Be it further Ordained, That the
Honorable the Mayor of the city of Columbus
shall subscribe for two thousand Shares in the
stock of said Company, for the use and bene
fit of said city, which stock shall be represen
ted in the organization of said company ac
cording to the provisions of the charter, and
as the City Council may direct.
Sec. H. And be it further Ordained, That
the City Attorney is hereby required to draw
up the form of a ‘ mortgage deed, embracing
every essential and necessary provision in this
ordinance for the protection of the city from
the possibility of loss.

pation of the future. It is with painful emotions that
; the writer communicates the death of Cora Mominia,
three years, three months and twenty-two days,
and Thomas Miles,aged eight months and twelve days,
j children of Col. John Crowell, Jr. of Russel county,
Alabama, and formerly of Georgia. Tl>“ first died on
the 27th of January, and the other on U- 30th of the
same month ! two budding roses withered and de
stroyed by the same untimely frost! Listen, Parents,
heard ye not the Angels whisper”! YV.

said county, with the murder of Nicholas Lewis, about
two years since. Gregory is about five feet four inches
high, thick set. light hair, blue eves, florid complexion,
reserved and distant in his manner, has a scar, occa
! sioned by a gun-shot wound on bis heel. Ofthe above

highly concentrated stzte, and acts on the system by
giving a correct tone to the digestive powers, promot
ing the healthy secretions of the bodv, securing ihe na
tural action oi thv intestinal passage, and at the same
time cleansing and purifying the Blood, and giving it a
free and healthy circulation.
It is a complete substitute for mercury in all cases in
which that mineral is given in the old practice, and
being a vegetable preparation, is certainly far prefera
ble, inasmuch as it passes ofT leaving the system en
tirely free, whilst mercury fastens upon the bones and
solid, thereby rendering vast numbers feeble and de
bilitated for life.
The cathartic and tonic properties of the Y’egetable
Alterative Syrup arc, moreover, so happily combined
that, whilst the former is performing its duty in carry
ing away the vitiated humors from the various [tart-: o
the body, the latter keeps up the strength of the patient
even though it be continued for months, thus preserv
ing an important advantage over all other medicines of
that class. No alteration in diet is required, except to
abstain from salt meats, and no evil effects need be
feared on its account, by exposure to wet or cold.
From long exp-riencc, and the many cures which
it lias performed under our own ob ervation in Y7ir
ginia, Ohio anil Pennsylvania, where it is now being
used to n very great extent, we feci warranted in re
commending it to the afflicted of Georgia, Alabama,
Florida, and the South generally, as a most valuable
medicine.
Numerous certificates could be given, but we consi
der such things as only calculated to swell an adver
tisement without giving, in our tumble opinion, much
satisfaction to the public. This Syrup owes its celeb
rity to its own merits.
