An Important Judicial DrcUlon.
In 1870 the Legislature of Georgia
passed an Act authorizing the City Coun
cil of Rome to isaue bonds and borrow
money for the purpose of making cer
tain improvements, amongst which was
the construction of Waterworks.
The bonds were issued, and the Wa
ter-works established, not however nntil
a vote of the citizens had approved it, as
was reuuired by the Act.
The law provided for the payment of
the principal and interest of the bonds
by the levy of a lax.
In 1874, after the bonds had been nego
tiated, the City Council upon its own
motion, executed a mortgage upon the
Water-works, in favor of the Bondholders,
a portion of whom instituted proceedings
in July last to foreclose, for the payment
of their unpaid interest.
This proceedings was resisted by the
present Council, upon the ground:
Ist. That as the bonds had been issu
ed under an Act of the Legislature, and
with the approval of the citizens—the
same authority was necessary to author
ize a sale or the creation of a mortgage
lease upon them.
2nd. That as the Act provided for the
payment of the bonds, by the levy and
collection of a tax, the mortgagees must
resort to that means alone fur the pay
ment.
After argument upon these and other
questions involved in the case, before
Judge Underwood on last Saturduy, he
held that the City Council had no authori
ty to create such a lieu, and that the
mortgage was void. He also held that
the bondholders must resort to the remedy
prescribed by the statute; and therefore
refused to make the rule absolute, and
dismissed the proceedings.

volves important legal principles, and a

“I was somewhat curious to test
the buoyancy of these waters, and
shortly after arriving was floating
about on their surface. The sensa
tion of such extreme buoyancy is cer
tainly curious, and for an indifferent
swimmer I dare say pleasant. Icould
stand upright without motion. Ly
ing on my back I could keep both
feet entirely out of the water, with
my arms also extended upwards to
their full length. In breast swim
ming I could keep both legs above
water from the knee joints, merely
paddling with my hands; in fact, in
any position it was difficult to sink.
Swimming a distance was, however,
difficult and tedious, as when on my
breast the buoyancy of the water had
a tendenoy to throw the feet and legs
right up in the air, which naturally
forced the head forward and kept an
unpleasant strain on the neck. Div
ing was next to impossible, and the
slightest drop of water getting into
one’s eyes caused extreme pain. The
day was Hue and the lake as smooth
as glass, and I pothered about very
pleasantly for over an hour, floating
and paddling on its surface, when in
one of my experiments I swallowed a
mouthful of water. The most nau
seous medicine I ever tasted was nec
tar to it, added to which it possessed
a burning, acrid power that almost
took the skin off my mouth. 1 tried
no more tricks, and feel* convinced
that the strongest swimmer in the
world would be unable to live over
thirty minutes in rough weather iD

I swallowed would kill even a water
buffalo.”

The Los Angeles Republican says
tho San Francisco merchants pursue
a short-sighted policy in bringiug so
many attachment suits against the
debtor merchants of that city. The
hardship is feit all keener because ®f
several evil visitations to Los Angeles
within the past year. First, it had a
bank failure, by which a large num
ber of depositors lost their money;
next, small-pox prevailed in a zym
otic form ; after which came drouth,
to cap the climax. These consider
ations, the Republican thinks, should
induce forbearance, and if they do
not, to use the language of that pa
per, “one-hair of Los Angeles will be
driven into bankruptcy, and the re
mainder compelled to flee the coun
try.” Let us hope the Republican
overdraws the picture.
The English Postoffice is going to
employ much fewer women in telegraphy
because they can not work at night.
Young ladies are found to do very well as
railroad ticket clerks, except that they
are so fascinating that male passengers
dally at the ticket office and cause delay.
