Justice W. A. MeEtvey, of BiownevlUe,
had before him yesterdav Bl ehard Banks,
colored, under a charge of assault and
battery on the parson of Joseph Washing
lon a ooloied preacher. Banks was found
guilty and tlued S2O and costs. He gave
notice that ne would appeal to the circuit
c urt, and is now In the lockup watting
fol surety on his appeal bond. He will be
seut to hard labor tor the county should
he fall to give eatlefactoiy security for
hie appearance.

Died, In Girard. Ala., yesterday morn
ing, at 10:30 o’clock, Mr. W. M Kennedy
after a llngetlug illness with consumption,
aged 46 years. > Mr. Kennedy was a native
of North Carolina, and moved to this
oountrv a’ter the late war from Mecklen
burg, his native, town. When the Ural
drum beat summoning the sous oi the
south to her defense, he volunteered and
served with credit all through the war,
bearing the soars of battle on his person,
oue of,which, perhaps, hastened hie death.
He has been engaged tn various businesses
here since the war, and at the time of hie
death was carrying on the butcher busi
ness io Girard. He was well and favor
ably known in this city and section, and
had many friends who esteemed him tor
his character of straightforwardness ami
integrity. Though a stranger lu our
midst, aud having no relatives here, bls
death will be regretted by many. The
funeral will take place to-day it 9 o'clock.
