AN ACT to establish a circuit court o£ the United States
in and for the State of Caffloruia.
Be it enacted by the Senate and House of Bepresenta
fives of the United States of America in Congress as
sembled, That a judicial circuit shall be, and the same is
hereby, constituted, in and for the Sta e of California, to
i<• known as tiiU circuit court of the United Stale* for the
districts of California, term of which court shall be held
annually, in the'eity of San Francisco, on the first Monday
of July m eachjaud every year; and for this purpose a
nidtie shall be appointed, and the court hereby organized
•hall in ail things, have and exercise the same original jn
ri-dicticp os isfested in the several circuit courts of the
United States, tit organized under exi-ting laws, and shaii
cFo have and exercise the same appellate jurisdiction over
the di-trict coui& of the United States for the northern ami
f-outbern districtsVf California as by existing laws is vested
in the several circuit courts of the United States -over the
di-'Mct couits of tfe United States in their respective eir
cuVi-; and the said judge shall appoint a clerk, who shall
have the power to appoint a deputy, which clerk shall re*

di-trict of New York/
Six. 2. And be iltfiirthcr enacted, 1 hat said judge shall ;
have power to ordtr and hold such special or extra terms j
of said court may deem expedient, arid at such time j
or times as heshall, by his order, under his hand and seal, !
direci, addressed to the marshal and clerk of said court, at
!esh/fydays previous to the commencement of such
spe/nfTor extra term or terms, which order shall be pub
immediately in two or more _ of the gazetts of the
State ol California; aiid at any or ail of such special teuys
xh bu sines* of said court shall have reference to the itrirne- j
dial jy preceding tegular or special term, and be proceed
ed with in the same manner; and such proceedings shall be
to all intents and purposes, as valid as if the same had ta
ken place at a regular term of said court; all which terms
rhali be held at such place, in the said city of San Francis
co, as the marshal of the.. United States for the northern
district of California, whose duty it shall be to act as the
marshal of said court, shall procure for the purpose, under
the directions of said judge; and appeals from the proceed
ing* of the court organized under this act shall be taken to
tlic Supreme Couit of the United States, in the same man
ner,and on the same conditions, asappeals are taken under
**xi-ti"g laws from the other, circuit courts of the United
States.
9. And be it further enacted, That the judge of
said court shall have the same power to issue writs of ha
bcas corpus and other writs as is vested by law in other
judges of the United States.
Sec. 4 And be it further enacted , That in case the
judge of said court shall fail to attend at the time and place
of holding any regular or special term of said court before
the close of the fourth day after the commencement of such
teim, the business pending before said court shall stand ad
journed until the next regular term of said court, or until
the next special term ol the court, should one be ordered
under the authority of this act such regular
ttrrn.
Sec. 5. And be it further enacted, That the district
courts of the United States for the northern and southern
districts of California shall hereafter exercise only the ordi
nary duties and powers of the district courts of the United
Slates, except the special jurisdiction vested in the said dis
trict courts of California oyer the decisions of the board of
commissioners for the settlement of private land claims in
California under existing laws; and that appeals from the
judgments, orders, and decrees of either ol said district
courts of California, in the exercise of its ordinary jurisdic
tion, shall be taken to the circuit court organized by this
act in the same manner and upon the same conditions as
appeals may ho taken from the judgments, orders, or de
cree* ol the district coui ts to the circuit courts of the Uni
ted States.
Sec. 6. And be it further enacted, That the judge ap
pointed under this act shall, from time to time, or at any
time when in his opinion the business of his own court will
permit, and that of the courts ol the northern and southern
districts of California shall require, form part of, and pre
side over, the said district courts when either of them is en
gaged in the discharge of the appellate jurisdiction vested
in it over the decYjjoaaol the board of commissioner for the
settlement of private land claims in the State of California,
under ihe act of Congress entitled “An act to ascertain and
settle the private land claims in the State of California,”
passed March third, eighteen hundred and fifty one, and by
another act entitled “An act making appropriations for the
civil and diplomatic expenses of the government for the
year ending thirtieth of Juno, eighteen hundred and fifty
three, and for other purposes,” passed thirty first of August
eighteen hundred and fifty two; and it shali be the duty of
the clerks ofjfhe respective district courts of California to
give thirty djjSS’ written notice to the judge of the court or
ganized under this act of the time and place of the sitting
ol such district court for the discharge o i |uch appellate ju
risdiction; and in case the judge of such district court shall
fail, from sfckness or other casualty, to altend at such time
and place, ihe judge of the court organised under this act
is hereby aiithorized to hold said court find proceed with
the business of the court, in accordance with the provisions
prescribed for the regulation of said district court in the act
of Congress hereinberore referred to; and all appeals to
the Supieme Court of the United*States from the decisions
of-aid district court, whether held by the last mentioned
judge, or by him in conjunction with the district judge, or
by the district judge alone, shall be taken in the manner
prescribed by the act ol Congress passed on‘ the third day of
March; eighteen hundred and fifty-one, entitled “An act
to taiu and settle the private land claims in the State
ol California.”
Sec i. And be it Jurthrr enacted, That the salary of
the judge appointed under this act shall be four thousand
uve hundred dollars per annum, to commence from the data
ol iits appointment.
. H, And be it further enacted, That all laws and
pare ot laws militating against this act be, and the same
are hereby repealed.

ROOK ISLAND FACTORY.
UNDER the provisions of a Deed of Trust made to the un
dersigned by the Rock Island Factory, we will offer for
sale “nr Monday 23d day of April next, at the Rock Island
Factory, ail those tracts of land in ttis- State of ALbama lying
on the Chattahoochee River, to wit: Filty acres iu the South
East Quarter of Section 35, Township 18. Range 3', adjoining
1 the lands of Robert S. Hardavay ami William D. Cairns, in
Russell county, Alabama, and running up said river to the
north half of said section 35, belonging to Btewart and Fon
taine, and thence, running back due west so as to include said
Fifty acres. Also, all that tractor parcel of land lying on the
Chattahoochee River, in ihe South East Quarter ol Seclion 35,
Township 13, Range 30,in Russell County, Ala., adjoining the
si p of land in said section, on the South belonging to William
D. Cairns, and on the west bounded by land belonging to said
Cairns and on the north by the land of John Fontaine, §contain
ing fifty acres, more or less, together with the ri-ht o l w ay run
ning from eaio land to the south ;side of section 35;tuence
along said south line to section 34, continuing thence to tin
West Point road, as reserved in a deed made to Robert Taylor.
Aiso, all that parcel of laud lying east (of the Columbus
Road running to West Point through Somerville, which is con
tained in the South East Quarter of the South East Quarter of
Section 34, and twenty six and a half acres of laud ljing ad
joining to the same, iu the South West Quarter of the South
West Quarter of Section 35, and fourteen and one fourth acres
running due east, adjoining said land along the south line of
Section J 5, one hundred jaids in length, to the Chattahoochee
river, containing in all eighty and three fourths acres, all in
Township iB, and Range 30, in Russell county, Alabama. Aleo
the South east Quarter of the South east quarter of Section 34,
Township 18, Range 30, and the South west quarttr of the j
South east quarter, of said section: Provided, that these ast
tracts are not to extend west of the Columbus road. Andj all
and singular, the buildings, out houses, watercourses, water
privileges, advantages, hereditaments, and appurtenances,
whatever, to the said several parcels of laud belonging, or in
anywise appertaining or which the said Rock Island Factory
have acquired trom the State of Georgia by Legislative Enact
ment. Also, all the personal property to tiie said Factory be
longing, consisting of Machinery,Tools, Wagons, Muies, Hors
ses, Material for the manufacture of Paper, Manufactured Pa
per, and all and every part and parcel of the personal estate of
the Rock Island Factory The improvements on the land con
sist of a Paper Factory, Warehouses, (zuthous.es, and all the
conveiiiucies for operatives liecfcsia.y to carry on the same.

Estate of the Rock Island Factory for default in payment
of a portion of thebond# of said Company, and for other caus
es; and. as by the provisions of the Trust Deed, all the bonds
outstanding,Jwhether due or not due, are to be paid rateably out
of the proceeds of sale, you are hereby notified to present your
bonds to R. J. Moses, one of ,ihe Trustees, on or before the

ment on the same.

The signatures are well executed, apparently engraved, and
traced over with pen and ink. The p iper is thick, and of a
dingy yrito*, and the back of the counterfeit not printed in
red ink. The general appearance is rather good, but the fraud
