CONSTITUTIONAL AMENDMENTS
TO BE VOTED ON NOVEMBER 2, 1948
A PROCLAMATION
Submitting a proposed amendment to
the Constitution of Georgia, to be voted on
at the General Election to be held on Tues¬
day, November 2, 1948, proposing to the
qualified voters of the State of Georgia an
amendment to Article VII, Section IV, Par¬
agraph I, of the Constitution of Georgia of
1945 so as to authorize the General As¬
sembly to include in the Civil Service and
/or Merit System heretofore authorized by
constitutional amendment for Fulton Coun¬
ty any persons (other than officers elected
by the people) whose salaries or wages
are paid in whole or in part by the Treas¬
urer of Fulton County or out of funds be¬
longing to Fulton County; to ratify all ex¬
tensions in the coverage of said Civii
Service System heretofore made by the
General Assembly prior to the ratification
of this amendment; and for any other
purpose.

WHEREAS, by the votes of two-thirds
of the members elected to each of the two
Houses, the General Assembly at its 1947
Session proposed an amendment to the
Constitution of this State, as set forth in
a Resolution approved on the 28th day of
March, 1947, to-wit:

A RESOLUTION
Proposing to the qualified voters of

BE IT RESOLVED BY THE GENERAL
ASSEMBLY OF THE STATE OF GEOR
GIA :
SECTION 1
That Article 7, Section 4, Paragraph 1
of the Constitution of Georgia of 1945 be
and the same is hereby amended by adding
at the end of said paragraph the following
language: that General Ax
“Provided, however, the
sembly shall be authorized to include in
the Civil Service and/or Merit System
heretofore authorized by constitutional
amendment for Fulton County any persons
(other than officers elected by the peo¬
ple) whose salaries or wages are paid in
whole or in part by the. Treasurer of Ful¬
ton County or out of funds belonging to
Fulton County. All extensions in the cov¬
erage of said Civil Service System here¬
tofore made by the General Assembly to
persons other than employees of Fulton
County and employees and deputies of
county officers of Fulton County are by
this amendment ratified, confirmed and
continued in force, except as the same
may hereafter be changed or amended by
the General Assembly.”
SECTION 2
Whenever the above proposed amend¬
ment to the Constitution shall have been
agreed to by two-thirds (2/3) vote Houses of the
members elected to each of the two
of the General Assembly and the same
has been entered on their journals, with
the ayes and nays taken thereon, the
Governor shall be, and he is hereby au¬
thorized and instructed to cause such
amendment to be published in one or
more newspapers in each Congressional
District of this State and in one or more
newspapers in Fulton County for two (2)
months previous to the time for holding the
next general election, at which election
members of the General Assembly are
sen, and said amendments shall be sub¬
mitted to the people in said next general
election. All persons voting at said elec¬
tion in favor of adopting said proposed
amendment to the Constitution shall have
written or printed on their ballots the
words, “For ratification of amendment to
Article 7, Section 4, Paragraph 1 of the
Constitution authorizing the extension of
The Civil Service and/or Merit System in
Fulton County and ratifying its extension
by the General Assembly,” and all persons
opposed to the adoption of said amend¬
ment shall have written or printed on their
ballots the words, “Against ratification of
Amendment to Article 7, Section 4, Para¬
graph 1 of the Constitution authorizing
the extension of the Civil Service and/or
Merit System In Fulton County and ratify¬
ing its extension by the General Assembly.”
If a majority of the electors qualified to
vote and voting thereon in the State as a
whole shall vote in favor of the adoption
of said amendment, and also if a majority
of the electors qualified to vote and vot¬
ing thereon in Fulton County shall vote
in favor of the adoption of said amend¬
ment, when the returns shall be consoli¬
dated as required by law in elections for
members of the General Assembly, then
said amendment shall become a part of
Article 7, Section 4, Paragraph 1 of the
Constitution of Georgia of 1945 and the
Governor shall make proclamation thereof
accordingly.

or more or any number of garbage dis¬
posal districts without regard to uniformity
of area or population, and any such tax
or assessment, or both, so levied need not
be uniform within the County and need not
be uniform within any garbage disposal
district, notwithstanding the provisions of
Article VII, Section I, Paragraph III of
the Constitution; and for other purposes.

following new Paragraph, to-wit:
“The Board of Commissioners of Roads
and Revenues of Fulton County shall have
power to levy either a tax or an assess
ment or both upon any part of or all the
real property (and also if desired upon
which any occupants thereof) in said County
is outside the incorporated areas of
any City, Town or Municipality, for gar¬
bage disposal services and also for the
purpose of establishing, maintaining and
operating systems of garbage disposal, and
shall have power to divide said unincor¬
porated areas or any part thereof Into one
or more or any number of garbage disposal
districts without regard to uniformity of
area or population, and any such tax or
assessment or both levied need not be
uniform within the County and need not
be uniform within any garbage disposal
district, notwithstanding the provisions of
Article 7, Section 1, Paragraph 3 of the
Constitution.”
SECTION 2
Be it further resolved by the Authority
aforesaid, that when said Amendment
shall be agreed to by two-thirds vote of the
members elected to each of the two Houses,
said Amendment shall be entered on their
Journals with the yeas and nays taken
thereon, and shall by the Governor be
published in one or more newspapers in
each Congressional District, and in one
or more newspapers in Fulton County, for
two months previous to the time of hold¬
ing the next general election at which
election members of the General Assembly
are chosen, and said Amendment shall be
submitted to the people at said next
general election. AH persons voting at
said election in favor of adopting said pro¬
posed Amendment to the Constitution shall
have written or printed on their ballots the
words: "For ratification of Amendment
to Article 7, Section 4, Paragraph 1, of
the Constitution, authorizing assessment
and tax in Fulton County without regard
to uniformity for garbage disposal services
and systems hereby authorized.” And all
persons opposed to the adoption of said
Amendment shall have written or printed
on their ballots the words: "Against rati¬
fication of Amendment to Article 7, Sec¬
tion 4, Paragraph 1, of the Constitution,
authorizing assessment and tax in Fulton
County without regard to uniformity for
garbage disposal services and systems here¬
by authorized.”
If a majority of electors, qualified to
vote for members of the General Asseu*
bly, voting thereon, in the State as a
whole, and also a majority of said electors,
voting thereon, in Fulton County, shall
vote for ratification thereof, when the re¬
turns shall be consolidated as'required by
law in elections for members of the Gen¬
eral Assembly the said Amendment shall
become a part of Article 7, Section 4,
Paragraph 1, of the Constitution of this
State, and the Governor shall make
'proclamation thereof.

or places of business in any area of Ful¬
ton County outside the incorporated limits
of municipalities; and the right and pow¬
er to license and regulate taxicabs and
cars for hire in such unincorporated areas,
and the right and power to classify busi¬
ness and business enterprises and to as¬
sess different license fees and taxes against
different classes of business ; and so as to
provide that the Board of Commissioners of
Roads and Revenues of Fulton County shall
also have the right and power to regulate
all businesses and business enterprises in
any area of Fulton County outside the in¬
corporated limits of municipalities, in the
interest of the welfare of the citizens of
Fulton County, and to prescribe rules and
regulations concerning the same, and to
provide that violation of any regulation
adopted by the Board of Commissioners of
Roads and Revenues of Fulton County or
the failure to pay any license fee or tax
prescribed for any business shall consti¬
tute a misdemeanor punishable upon con¬
viction .thereof as prescribed by the genera]
laws of the State of Georgia; and for
other purposes.

majority of the electors qualified to vote
for members of the General Assembly vot¬
ing thereon in the State as a whole, and
also a majority of said electors voting
thereon in Fulton County, shall vote for
ratification thereof, when the returns snail
be consolidated as required by law in
elections for members of the General As¬
sembly the said Amendment shall become
a part of Art. 7, Sec. 4, Par. 1 of the
Constitution of this State and the Governor
shall make proclamation thereof.

board of education of a superintendent of
tlie county school system, and to prescribe
his qualifications and term of office; to
provide for the submission of the amend¬
ment for ratification or rejection by the

BE IT RESOLVED BY THE GENERAL
ASSEMBLY OF THE STATE OF GEOR¬
GIA;
SECTION I
That Article 8, Section 5, Paragraph 1
of the Constitution of Georgia be and the
same is hereby amended by adding at the
end thereof a new paragraph as. follows,
to-wit;
“The members of the County Board of
Education of Spalding County shall be
elected by the people at the same time and
for the same term that other county of¬
ficers are elected, and shall hold their
offices until their successors are elected
and qualified. Sixty days after the ratifi¬
cation of this amendment it shall be the
duty of the ordinary of Spalding County
to call an election for the purpose of elect¬
ing by the the qualified voters in each
school district of a member of the County
Board of Education from that school dis¬
trict. The members of the board who are
elected at that time shall hold office until
their successors are elected and qualified.
Should a vacancy occur in the office of
any member thus elected, a successor shall
be appointed by the judge of the Superior
Court for the unexpired term. The county
of Spalding, outside of the city limits of
the City of Griffin shall, by the Judge of
the Superior Court, the Clerk of the Super¬
ior Court, and the Ordinary, he laid off
and divided into five school districts to be
known, numbered and designated as school
districts Number 1, 2. 3. 4, and 5; the
geographical limits of such school dis¬
tricts may be changed and relaid off from
time to time in the discretion of the of¬
ficers herein named upon an unanimous
vote of the said officers so to do. One
A PROCLAMATION
Submitting a proposed amendment to the
ConsCtution of Georgia to be voted on at
the General Election to be held on Tues¬
day. November 2, 1948, proposing to the
qualified voters of the State of Georgia
an amendment to Article VII, Section VII,
Paragraph I of the Constitution of Geor¬
gia, so as to authorize the City of At¬
lanta to issue revenue certificates for the
purpose of making repairs and improve¬
ments in its Water Works System and San¬
itary Department: to provide for the pay¬
ment of certificates out of the revenues
derived from water or sanitary service
charges: to authorize the setting aside in
special funds a sufficient sum to retire
the revenue certificates to provide the
manner, form and method of issuing cer¬
tificates ; certificates to be issued by a
majority vote of the Mayor and General
Council and validated: to provide for the
allocation of anticipated receipts; to pro¬
vide that certificates shall not be a debt
of liability upon the City of Atlanta and
shall be payable from and chargeable only
upon the revenue derived from Water or
member from each of the above designat¬
ed school districts shall be elected to serve
on said board, and only the registered and
qualified voters in each school district
shall vote for the election of a members
from that district.
“Should the charter providing for the
operation of the Griffin Independent School
System be surrendered and the laws gov¬
erning the operation of the Griffin Inde¬
pendent School System be repealed, the
numbe rof members of the County Board of
Education shall be increased to 10 mem¬
bers, with 5 members being elected from
the City of Griffin, which shall be desig¬
nated as School District No. 6 of Spald¬
ing County; that within 60 days after the
ratification of this amendment, If the
charter of the Griffin Independent School
System shall have been surrendered the
ordinary of Spalding County shall call a
special election for the purpose of electing
5 additional members of the county board
of education from said school district,
who shall serve until the next election of
other county officers, when their succes¬
sors shall be elected. Only the registered
and qualified voters in this said school
district shall vote for the election of the
five members from said district.
“No publisher of school books or any
agent for such publisher or any person
who shall have a pecuniary interest in the
sale of books shall be eligible for election
as a member of the County Board of Edu¬
cation : and in said election, only the
qualified voters of the county residing In
that part of the county where the schools
are under the jurisdiction and control of
the county school superintendent shall be
eligible to vote.
“That from and after the ratification
of this amendment the Grand Jury of
Spalding County shall make no future ap¬
pointments of members of the county board
of education, but the present board shall
serve until their successors are duly elect¬
ed as above provided.
“No person shall be eligible to hold of¬
fice as a member of the County Board of
Education who is not of good moral char¬
acter, who has not at least a fair knowl¬
edge of the elementary branch of an Eng¬
lish education, who is not favorable to
the common school system, and who is
not a voter qualified to vote for the mem¬
bers of the General Assembly.
“The county school superintendent of
Spalding County shall be elected or ap¬
pointed by the County Board of Education
for a term not to exceed 4 years, and he
•shall hold such office until his successor
is elected a*d qualified. From and after the
ratification of this amendment the voters
of Spalding County shall no longer elect
the county school superintendent but the
present superintendent shall serve until
his successor is duly elected or appoint¬
ed as above provided by the county board
of education.
“Before any person shall be qualified or
eligible to hold office as county school
superintendent, he shall have had at least
two years practical experience in school
administration,' and he shall have complet¬
ed a minimum of five school years of col¬
lege and shall have graduated from an
an accredited college or university, and
shall hold the degree of Master of Arts
or an equivalent Master’s degree.”
SECTION II
BE IT FURTHER RESOLVED that when
this proposed amendment shall be agreed
to by two-thirds of the members elected
to each of the two Houses of the General
Assembly and tlie same shall have been
entered on their journals with the “ayes”
and “nays” taken thereon, the proposed
amendment shall be submitted to the peo¬
ple for ratification or rejection at the next
general election at which election mem¬
bers of the General Assembly are chosen,
at which election every person shall be
qualified to vote who is qualified to vote
for members of the General Assembly.
.Said amendment shall be published in one
or more newspapers in each congressional
district for two months previous to the
time of holding the election wherein said
amendment is submitted for ratification or
rejection. All persons voting in said elec¬
tion in favor of adopting the proposed
amendment to the Constitution shall have
written or printed on their ballots the
words “For ratification of amendment to
Paragraph 1, Section 5. Article 8 of the
Constitution providing for the election of
members of the Spalding County Board
of Education, and the appointment of a
county school superintendent by said
Board,” and all persons opposed' to the
adoption of said amendment shall have
written or printed on their ballots the
words "Against ratification of amendment
to Paragraph 1, Section 5, Article 8 of
the Constitution providing for the election
of member* of the Spalding County Board
of Education, and the appointment of a
county school superintendent by said
Board.” If a majority of the voters of the
State qualified to vote for members of the
General Assembly voting thereon, and If a
majority of the electors qualified to vote
for members of the General Assembly in
the County of Spalding voting thereon
ratify such amendment, the same shall be¬
come a part of the Constitution of this
State. The returns of the election shall
be made in like manner as returns for
members of the General Assembly, and it
shall be the duty of the Secretary of the
State to ascertain the result and to certi¬
fy the result to the Governor, who shall,
if such amendment be ratified make pro¬
clamation thereof.

Acting Governor of Georgia, do issue this
my proclamation hereby declaring that the
proposed foregoing amendment to the Con¬
stitution of Georgia is submitted, for rati¬
fication or rejection, to the voters of the
State qualified to vote for members of the
General Assembly at the General Election
to be held on Tuesday. November 2, 1948.
IN WITNESS WHEREOF, I have here¬
unto set my hand, and caused the Great
Seal of the State to be affixed, at the
Capitol in the City of Atlanta, this the
