A RESOLUTION
Proposing- an amendment to the Constitution
so as to authorize counties to purchase liability
this insurance; to provide for the submission of
amendment for ratification or rejection;
and for other purposes.
BE IT RESOLVED BY THE GENERAL
ASSEMBLY OF GEORGIA;
SECTION 1
Article VIT, Section VI, of the Constitution
is hereby amended by adding & new Para¬
graph, to be known as Paragraph III, to read
as follows:
“Paragraph III. The governing authority of
each county is hereby authorised in its discre¬
tion to purchase liability insurance to cover
damages on account of bodily injury or death
to any person or damage to property of any
1 person arising by reason of ownership, main¬
tenance, operation or use of any motor vehicle
by such county, whether as a result of a
governmental undertaking or not, and to pay
premiums therefor. The governing authority
is hereby authorized to levy a tax for such
purpose. In the event of purchasing such in¬
surance, the governmental immunity of the
county shall be waived to the extent of the
amount of insurance so purchased. Neither the
county nor the insurer shall be entitled to
plead governmental immunity as a defense and
may make only such defenses as could be
made if the insured were a private person
The county shall be liable only for damages
suffered while said insurance is in force. No
attempt shall be made in the trial of any
action to suggest the existence of any insur¬
ance which covers in whole or in part, any
judgment or award which may be rendered in
favor of the plaintiff. If the verdict rendered
by the jury exceeds the limitation of the in¬
surance. the court shall reduce the amount to
a sum equal to the applicable limitations stated
in the policy,”
SECTION 2.
When the above proposed amendment to tht
Constitution shall have been agreed to by two
thirds of the members elected to each of the
two branches of the General Assembly, and
the r>ame has been entered on their journals
with the “Ayes” and “Nays” taken thereon,
such proposed amendment shall be published
and submitted as provided in Article XII l.
Section I, Paragraph I of the Constitution of
Georgia of 1945, as amended.
The ballot submitting the above proposed
amendment shall have written or printed
thereon the following;
“For ratification of amendment to the Con¬
stitution so as to authorize counties to pur¬
chase liability insurance. the
“Against ratification of amendment to
Constitution so as to authorize counties to
purchase liability insurance.”
All persons aesiring to vote in favor of
adopting the proposed amendment shall vote
for ratification of the amendment, and all per¬
sons desiring to vote against the adoption of
the proposed amendment shall vote against
ratification. be ratified
If such amendment shall as pro¬
vided in said Paragraph of the Constitution,
it shall become a part of the Constitution of
this State. The returns of the election shall
be made in like manner as returns for elec¬
tions for members of the General Assembly,
and it shall be the duty of the Secretary of
State to ascertain the result and certify the
result to the Governor, who shall issue his
proclamation thereon.

A RESOLUTION
Proposing an amendment to the Constitution
so as to authorize the creation of a Brunswick
Ports Authority; to provide for the submission
of this amendment for ratification or rejec¬
tion; and for other purposes.
BE IT ENACTED BY THE GENERAL
ASSEMBLY OF GEORGIA;
SECTION 1
Article VII,‘Section VII, Paragraph V of
the Constitution, as amended, is amended by
adding at the end thereof the following:
“The General Assembly is authorized to
create an instrumentality and department of
the State of Georgia to be known as the
Brunswick Ports Authority, and to provide
for its powers and functions. Act number
314 of the Acts of the General Assembly of
1945 (Ga. Laws 1945, p. 1023) as amended by
314 of the Acts of the General Assembly of
bly of 1958 (Ga. Laws 1958, p, 82) is hereby
ratified and confirmed, so that the said Acts
shall have the same force and effect as if they
had been enacted subsequent to the ratification
of this amendment to the Constitution; pro¬
vided, however, that nothing herein shall pro-'
vent, the General Assembly from amending
said Acts, so as to add and enlarge powers
of the Authority.”
SECTION 2
When the above proposed amendment to the
Constitution shall have been agreed to by two
thirds of the members elected to each of the
two branches of the General Assembly, and
the same has been entered on their journal#

Section I, Paragraph I of the Constitution of
Georgia of 1945, as amended.

Constitution so as to authorize the creation of
a Brunswick Ports Authority.”

for ratification of the amendment, and all per¬
sons desiring to vote against the adoption of
the proposed amendment shall vote against
ratification.
If such amendment shall be ratified as pro.
vided in said Paragraph of the Constitution,
it shall become a part of the Constitution of
this State. The returns of jthe election shall
be made in like manner as returns for elec¬
tions for members of the General Assembly,
and it shall be the duty of the Secretary of
State to ascertain the resulit and certify the
result to the Governor, who shall issue his
proclamation thereon.
